From Gaston Gazette

07/28/2014  — A Gastonia woman was charged with DWI early Saturday morning after driving into the South Fork of the Catawba River with her children in the rear seat.

Connie Jo Penland, 26, was driving north on Lowell-Spencer Mountain Road in Gastonia at approximately 12:31 a.m. Saturday when she approached the intersection of Sutton Carpenter Road, State Trooper W.T. Davis said.

Penland failed to stop at the intersection, according to Davis, then drove off the road and straight ahead for approximately 30 yards, and then went down an embankment and partially into the river.

“I’d estimate her speed at 35 to 40 miles per hour,” Davis said. “I don’t believe speed was a factor, but alcohol was.”

Eight to 12 inches of water ran into the car’s passenger compartment, Davis estimated.

Penland’s two children, 6 and 7 years old ….MORE

DWI Killer Mike VanWagner laughed about his wrecked car on FB

From Star-Tribune

Minneapolis, Minn. — A 16-year-old Brooklyn Center boy clung to life for days before dying after a suspected drunken driver, without a valid license, fled one crash on a north-metro highway and ran into the teen’s car down the road moments later, authorities said.

Jason F. McCarthy, of Brooklyn Center, remained in North Memorial Medical Center on Wednesday after his family posted on CaringBridge over the weekend that “the injuries to Jason during the impact of the accident were too much for him to survive. Jason is currently on life support so family can get here and say goodbye.”

The State Patrol on Tuesday confirmed the death of McCarthy, who would have been a junior at Champlin Park High School, where he intended to return to the cross-country team for a third season.

The back-to-back crashes occurred midafternoon on July 22 along Hwy. 252 in Brooklyn Park, with both involving Michael J. Vanwagner, 24, of Coon Rapids, according to the State Patrol.

On the Saturday before McCarthy died, Vanwagner posted photos of what was left of his vehicle on his Facebook page and wrote, “That’s her front end after I got done with her lol.” He signed that message with a smiley face.

Under a second photo, he commented: “I’m all good slept a day in the hospital then came home and did yard work lol.”

Vanwagner acknowledged posting the images and said in an interview Wednesday, “I didn’t even know I hit somebody. I just thought I hit something.” The photos and the accompanying comments were deleted Wednesday night.

It was on Wednesday, he added, that he learned that “another kid died” as Vanwagner was heading to a friend’s home in north Minneapolis.

“Police came and arrested me [Wednesday] morning and let me out because the charges won’t be coming for months,” he said.

Vanwagner said, “I know I’m looking at spending time in prison, so I’m trying to spend…..MORE

Virginia: Lawyer Mark Sgarlata pleaded guilty to killing Patrick and Leia Wrenn in DUI crash

Attorney Mark Sgarlata pleaded guilty to killing Patrick and Leia Wrenn while he drove DUI

From NBC 4 News

LEESBURG, VA.  08/03/2014 —A Virginia lawyer pleaded guilty Friday in a DUI crash that killed an Ashburn couple last fall.

Mark Sgarlata pleaded guilty to two counts of manslaughter and one count of DUI in the Loudoun County crash that killed Patrick and Leia Wrenn.

The Wrenns were killed as they rode together on their Harley Davidson motorcycle in the early-morning hours of Oct. 6, 2013. They were just about a mile from home, on Ashburn Farm Parkway, when they were struck and killed by Sgarlata’s BMW sedan.

Police said Sgarlata was driving drunk. A breath test at the scene showed a .223 alcohol level, and one taken later registered .15, almost twice the legal limit.

A deputy at the scene wrote in the arrest records, “Sgarlata had slurred speech with a heavy odor of alcohol coming from his breath. Sgarlata was unsteady on his feet and was found with his pants unbuckled and shirt unbuttoned. Mr. Sgarlata admitted to drinking 5 glasses of wine before the crash.”

On Friday, as he pleaded guilty, he told the judge that was “the best way to put all this behind us.”

But that’s not so simple a task for the victims family.

“[I] just take it a day at a time, and just kind of see what they would want me to do,” said Leia Wrenn’s daughter Tonya Adkins outside the Leesburg courthouse Friday morning.

Sgarlata faces between one and 20 years in prison on each of the manslaughter charges, which are felonies. He is out on bond, but is due to turn himself into authorities Aug. 7, with a sentencing hearing scheduled for December.

Family members said they plan to return to the courthouse for Sgarlata’s sentencing to deliver victim impact statements.

“I couldn’t imagine doing it…. I just don’t see how it’s even a possible thought to get behind the wheel when you’re drinking,” Adkins said.

The Wrenns were motorcycle enthusiasts and belonged to the Iron Order Motorcycle Club. They spent the last day of their lives with the group before heading for home.

“They loved it. That was just something they enjoyed,” Adkins said. “And they enjoyed being together.”

The Wrenns would have celebrated their seventh wedding anniversary the week after the crash.

Sgarlata had been arrested for a previous DUI in March 2011, but the charge was pleaded down to a reckless driving charge, according to records uncovered by News4. He had a restricted license for six months after that incident.

Montana: police charge both Cal Erickson Mullen and Jason West with fatal DUI Interstate 15 crash

From Montana Standard

Fatal DUI -

08/06/2014  — Authorities say both drivers involved in a fatal crash on Interstate 15 were under the influence of alcohol at the time.

Both Clancy men face felony charges in the death of a 38-year-old man.

One of the vehicles in the June 14 wreck was carrying people who were celebrating their 20th high school reunion.

One of the drivers, 22-year-old Cal Erickson Mullen, turned himself in Tuesday afternoon on a warrant for vehicular homicide while under the influence and negligent vehicular assault.

Mullen is accused of having a blood alcohol content of 0.265, which is three times the legal limit, when he crashed his pickup near Montana City. Charging documents say Mullen had been drinking at a Helena bar and was heading home when he failed to negotiate a curve. He lost control of the truck, which landed in the opposite lane facing oncoming traffic.

He then exited the truck. Prosecutors say he made no effort to warn oncoming vehicles or alert authorities of the wreck and this negligence caused the death and injuries.

A 2010 Nissan Murano driven by Jason West, 42, was carrying three passengers. The group had been celebrating its reunion in Clancy and was headed to Helena for breakfast at about 1:30 a.m.

The Nissan collided with Mullen’s unoccupied pickup. Investigators …MORE
