Texas Judge busted for DWI“Please let me go home. I live a couple of miles away … you are going to ruin my life. I worked hard for 25 years to be where I am today,” the court document states.

McALLEN — Court records released on Monday give insight into the night that a police officer stopped an appeals court judge for speeding and ended up arresting her for suspicion of driving while intoxicated.

On Saturday, shortly after 1:21 a.m. a McAllen police officer was driving near the area of North 23rd Street and Freddy Gonzalez Avenue, where he saw a woman driving a silver two-door Lexus at 69 mph in a 55-mph zone, the officer said in his police report.

Nora Lydia Longoria, a justice for the 13th Court of Appeals had been driving the vehicle when the police officer stopped her and eventually arrested and charged her with DWI.

Longoria posted a $2,000 bond and authorities released her from jail shortly after 10 a.m. the same day; the charge is a Class B misdemeanor.

The driver in a one-vehicle accident that killed a man in East Peoria early Sunday was cited for driving under the influence, police said Monday.

Matthew B. McDonald Jr., 23, of East Peoria, was identified Monday as the fatal victim by the Tazewell County Coroner’s Office.

He was a passenger in the vehicle driven by Jacob L. Lehmkuhl, 22, of 1011 Lister, Eureka, East Peoria Police Sgt. Brian Despines said in a news release.

Despines said Lehmkuhl was located in an area near the accident at the intersection of Meadows Avenue and Pleasant Hill Road and was arrested for DUI.

He said police responded at about 1:30 a.m. to the accident ….MORE

07/16/2014  —-On Tuesday, July 15, 2014 at 1:35 pm, Palm Desert deputies responded to a non-injury hit and run traffic collision at Fred Waring and Cook Street.

One of the involved vehicles fled the scene prior to the arrival of the deputies. The vehicle was located in a parking lot about a mile away.

Deputies identified the driver of the vehicle as Jose Clariond, age 51, of Mexico.

Clariond was arrested for hit and run and driving under the influence of alcohol. Clariond was booked into the Riverside County jail in Indio.

Please see the following letter that has been sent to Judge Miller of the District Court in Annapolis and the State’s Attorney’s office. This letter directly impacts the AACPD in that your job is already difficult. Having drunk drivers get away with nearly no consequence is deplorable. Not to mention his father, uncle and brother are all Anne Arundel County Police officers. He should have known better. Thank you for allowing me to share.To the Honorable Judge Thomas Miller III,

My husband and I sat in your courtroom on May 21, 2014 in the afternoon regarding the case State of Maryland vs. Devin Fraser. I cannot express the disappointment and frustration I have in the State of Maryland Judiciary System.

My husband was nearly killed 8 months ago by Devin Fraser who was driving drunk. He tried to pass my husband on the shoulder, hit my husband at speeds in excess of 98 mph (the police could only estimate his speed after he hit my husband, flipped his car, then slid 441 feet into the median and was ejected because he also was not wearing his seat belt). His blood alcohol level was .22. This was an act of total disregard and carelessness. His actions also closed Route 100 Westbound for 5 1/2 hours.

You gave him 18 months probation, 6 months jail time with all but 2 days served. Your reasoning? You said because he had been in the Marine Corps and served in Iraq you were reducing his sentence. Using this reasoning sir, my son-in-law who has done two tours in Afghanistan with the Marines should be able to get away with almost anything. My son and son-in-law are both Marines. There is no family who is more loving toward the Marine Corps or any other branch of the military. I fail to see your reasoning. The Marine Corps instills strong beliefs in being accountable for your actions and that drinking and driving is NEVER acceptable. In fact, if this young man had been in the Marine Corps when this happened the consequences would have equaled the crime.

To add to this injustice my husband was never told about or given a victim’s impact statement. In fact, he was not asked if he would like to say anything to this person. The witness to the accident, who was also subpoenaed, was not asked to speak. However, you allowed Mr. Fraser to speak to my husband (without asking if my husband objected) and “apologize” for what he did. Do you know how that felt sir? The message walking out of that courtroom was the victim has no rights but the person who almost killed another because of his actions has considerations given to him?

Sir, I do not know the law. But what I do know is this young man made a conscious decision to get behind his wheel, without a seatbelt, and drive over 100 miles per hour-all while drunk. He is 28 years old. His father, uncle, and brother are all Anne Arundel County Police Officers. His training as a Marine taught him his actions were wrong. And now, he has to spend a weekend in jail. And my husband? No one asked about him. He lost his job because of his injuries. Our lives have been impacted beyond belief and will never be the same. The emotional and physical damage done cannot be justified with 2 days in jail. Where is the justice? How can his actions be condoned by the courts?

My husband is now 61 years old, out of work, and in constant pain. Devin has a job, a life, and little consequences to his actions. I pray, sir, that you or your family never have to deal with a situation as grave as this one. The State of Maryland has, once again, proven
that it is a state full of contradictions and exceptions.

These three rulings by Judge Miller includes that of Devin Fraser and shows what a weak and inept Judge that Miller has become since being appointed to the District Court Bench. There seems to be little protection for the public when even probation is suspended.

Lexington, SC (07/19/2014) – A man who served time on a drunk driving conviction in connection with a 2011 fatal crash has been sentenced on a second DUI charge.

A judge ordered Robert Darren Craft, 40, to serve nine months in jail this week for a count of DUI second offense. The latest incident took place back in December of last year, when he was pulled over after an officer said he was driving suspiciously. Officers said he failed field sobriety tests.

In addition to the jail time, Craft was ordered to pay a fine and got five years probation. He began his sentence Wednesday

CORNELIUS, ORE. —  Two roll-over crashes, about two hours apart, were influenced by drivers who were intoxicated.  A passenger in one of the vehicles seriously injured an arm.  Both drivers were arrested.

On Friday, July 18, 2014, at about 4:06 p.m., deputies responded to a report of a roll-over crash near 32380 NW Hornecker Rd. in unincorporated Washington County near the City of Cornelius.   The driver, 26-year-old Wert Russert from Hillsboro, lost control of his 2003 Chevy pick up truck and left the roadway.  The truck rolled at least once and came to rest on its wheels.  Fire crews had to cut off the top of the truck in order to remove the passenger, a 17-year-old male.  The passenger was transported to Emanuel hospital with an injured arm.

Deputies investigating the crash determined Mr. Russert was intoxicated and he was arrested for Driving Under the Influence of intoxicants and Assault in the Fourth Degree.

About two hours later, at 6:09 p.m., in the community of Laurelwood, deputies responded to another roll-over crash at the intersection of SW Laurelwood Rd. and SW Parmele Rd.  The driver, 25-year-old Jason Eaton of Beaverton, lost control of his 1997 Dodge pick up and rolled it an unknown number of times.  Both he and his 24-year-old passenger were not hurt.  Deputies determined that Mr. Eaton was under the influence of alcohol and arrested him for DUII.

AUSTIN, Tx. (07/19/2014) – A man convicted of his seventh DWI was sentenced to life in prison Wednesday.

In May 2013, Burnet County officials say 46-year-old Terry Lynn Stevens was arrested for his seventh and last driving while intoxicated charge. He has a lengthy criminal record.

Documents show Stevens’ past is riddled with DWI convictions, spanning more than two decades and in six Texas counties. It includes seven convictions including the most recent.

He’s been in prison twice for DWI in 1996 and 2004.

Stevens could end up spending 60 years behind bars.

PHOENIX (07/23/2014) – Sentencing for a man charged in the hit-and-run death of a Phoenix police officer has been delayed. It was scheduled for Tuesday morning.

It was over a year ago that Phoenix Police Officer Daryl Raetz was killed during a DUI stop.

Jesus Cabrera-Molina, the man accused of hitting him with his SUV, was set to learn his punishment on Tuesday morning, but it has been postponed to September 12.

He pleaded no contest to negligent homicide and leaving the scene of a fatal injury accident after originally pleading not guilty to charges of  manslaughter and leaving the scene of an accident.

Prosecutors say Raetz was conducting a DUI stop back in may of 2013 when Cabrera-Molina hit him and drove off.

Cabrera-Molina had originally been arrested on drug charges, but investigators were eventually able to figure out that vehicle pieces from the scene matched parts missing from Cabrera-Molina’s SUV.

Court papers also show he told police that he had been drinking and doing cocaine the night of the accident. ….MORE

Little Creek, Del. – Delaware Troopers are investigating a single vehicle crash that killed two Dover men.

The incident occurred at approximately 7:05 p.m. Monday July 21, 2014 as Benjamin W. Hibbler, 26 of Dover, was operating a 2001 Chevrolet flatbed tow truck (AA Towing & Rollback Service Inc.) northbound on Bayside Drive (SR9) north of North Little Creek Road.

As the vehicle entered a left curve, its right side tires traveled off the east edge of the roadway and due to its apparent high rate of speed, the truck began to rotate and cross both lanes of travel while spinning in a counter-clockwise motion. The truck then exited the west side of the roadway and struck a large metal telephone pole with the passenger side door and came to a stop.

Benjamin Hibbler, who was not properly restrained, was transported to Kent General Hospital where he later died as a result of multiple traumatic injuries.

A passenger, Michael J. Shahan, 23 of Dover, was not properly restrained and was pronounced dead at the scene.

The State Police Collision Reconstruction Unit is continuing the investigation into this incident.  Speed and alcohol may be contributing factors in this collision.  SR9 between North Little Creek Road and White Oak Road was closed for approximately three and a half hours while the crash was investigated and cleared.

Synopsis :   Denton Police charged Jacob Lee, 20 of Denton, with DWI.  Police responded to Savannah
Overlook for a report of someone knocking on doors in the neighborhood.  Police spoke with a
witness who advised they were awakened by what sounded like a motor vehicle collision.  The witness
advised they observed a vehicle leaving the area but that vehicle returned and the operator,
identified as Lee, got out of the vehicle and started walking toward the witness’s residence.   The
witness stated it was obvious that the subject was intoxicated and called the police.

Police observed damage to Lee’s vehicle and also observed damage to another parked vehicle in the area. Investigation revealed the Lee had backed into the parked vehicle. Police noticed a strong odor of alcoholic beverage on Lee’s breath and person and requested he submit to series of standardized field sobriety tests. Based on the results of those tests Lee was taken into custody for suspicion of DWI. Lee submitted to a
breath test the results of which were .20. Lee was then issued citations for the above violations
and released to a responsible person after signing for the citations.
