McALLEN — 2013-12-18 — A veteran McAllen police officer resigned from his job after the Texas Department of Public Safety arrested him on suspicion of drunken driving during a holiday enforcement surge.

On Friday, the DPS and the McAllen, Edinburg and Pharr police departments began a joint operation to increase their manpower targeting drunken drivers during the holiday season.

Saturday morning, a state trooper arrested Officer J. Omar Ybarra, 46, who was charged with one count of driving while intoxicated and was processed at the Hidalgo County Jail before being released.

Ybarra was driving a Ford F-150 early Saturday morning near the intersection of Earling and Cesar Chavez roads in San Juan when a state trooper pulled him over for speeding, said Sgt. Johnny Hernandez, DPS spokesman.

During the traffic stop, Ybarra showed signs of intoxication, but when asked by the trooper to take a breathalyzer he refused, Hernandez said.

FORT WORTH, Texas — 2013-12-19 — Prosecutors in Texas are trying again to put a teenager in jail who was sentenced to 10 years probation after acknowledging he killed four people while driving drunk.

The county prosecutor is asking a juvenile judge to put 16-year-old Ethan Couch in jail on two cases of intoxication assault that he says are still pending in court.

2013-12-20 —Two Pennsylvania State Police investigators said Ronald D. Hall Jr. told them he thought the passenger in his Jeep had fled after Hall crashed the Jeep into a tree early on the morning of Oct. 17.

The passenger, Aaron P. Schaefer, 42, was actually lying outside of the vehicle, dead.

Hall, 43, would later state that he thought he had too much to drink and was “buzzed” at the time of the crash. Asked what he thought his blood-alcohol content might have been, Hall said about 0.15 percent, Trooper Samuel Laureto testified during Hall’s preliminary hearing on Wednesday afternoon.

McKean District Judge Denise Stuck-Lewis held Hall, of Millcreek Township, for trial on all charges that state police filed against him in the fatal accident. The charges include homicide by vehicle while driving under the influence, homicide by vehicle, aggravated assault by vehicle while DUI and one count of aggravated assault by vehicle that prosecutors added at the start of Wednesday’s hearing.

Hall remains free on $75,000 bail.

Hall is accused of driving drunk when his Jeep went out of control and crashed at Tow and Eaton Roads in Fairview Township on Oct. 17 at about 12:20 a.m. Blood-alcohol testing on Hall several hours after the accident showed he had a blood-alcohol content of 0.074 percent, below the 0.08 percent threshold for driving drunk under the law, according to case documents.

But Erie County Assistant District Attorney Mark Richmond said in presenting a report by Erie County Forensic Pathologist Eric Vey, M.D., into evidence that Vey was able to calculate through “reverse extrapolation” that Hall’s blood-alcohol content at the time of the crash was 0.154 to 0.18 percent.

Richmond opened Wednesday’s hearing with testimony from a man who came upon the accident scene and found Schaefer dead. State police Trooper Jeffrey Vincent then testified that after responding to the accident call, he ran the Jeep’s plate and learned it was owned by Hall, then found an address for Hall in paperwork inside the Jeep.

Vincent said he and another trooper went to the address and spoke to Hall’s relatives, who reached Hall by telephone. He was at his girlfriend’s house in Erie, and police went there at about 4:30 a.m. on Oct. 17, Vincent said.

On 20 Nov 2013 at 10:43 PM a deputy stopped a vehicle operated by Nicole Morris Twiford, 46, of Salisbury, for erratic driving and crossing a double yellow line. The deputy subsequently arrested Twiford for DUI. Twiford was released on Personal Recognizance after an appearance in front of a District Court Commissioner.

On 20 Nov 2013 at 11:15 PM a deputy stopped a vehicle operated by John Mark Smith, 40, of Salisbury, for speeding and crossing a double yellow line. The deputy subsequently arrested Smith for DUI. Smith was released upon the issuance of citations.

Assault & Battery on a Law Enforcement Officer [LEO] – On January 1st at 6:10 AM, officers of the Prince William County Police responded to the area of Myrtlewood Dr and Avenel Ln in Dumfries (22026) to investigate a crash.

During the investigation, officer arrested the driver of one of the vehicles for driving under the influence. After the driver was arrested, a passenger of the same vehicle, attempted to get to the driver who was in the backseat of a police cruiser.

That passenger, after ignoring multiple requests from the officer, was arrested for disorderly conduct. As that passenger was being arrested, a second passenger, identified as the accused, exited the vehicle and approached the officers. During the encounter, the accused kicked one of the officers and attempted to push past him. No injuries were reported.

Following the investigation, the accused was also arrested. No injuries were reported.

JACKSONVILLE, Fla. 2014-01-04– A Jacksonville man who lost his father almost seven years ago in an automobile accident, has taken steps to put his father’s killer back in prison for probation violations.

Carl Harms lost his father James, a 24-year Navy veteran, in April of 2007 in a four vehicle crash on I-10 in Gulfport, Mississppi. He was on his way to see his daughter in Hammond, Louisiana.

The fatal accident was caused by 24-year-old Alicia Carmack. She was sentenced to 25 years for DUI causing a death, and leaving the scene of an accident.

A judge suspended 15 years of that sentence, and she served less than four years before getting out early in December 2012. Soon after that Harms looked her up on the internet, hoping to see her living a better life.

“I wanted to see that her life had changed, that my father’s life was worth something,” said Harms.

Harms says the conditions of her probation were not using alcohol, staying away from bars and not leaving her home county and Gulfport, Mississippi without permission. What he found on Facebook told a different story over a several month period. He found pictures of Carmack partying and drinking at various clubs, and postings of a trip with friends out of state to Baton Rouge, La.

“Every picture I found, did not want to see them, but every picture I found it was like getting that call all over again, like getting that call over  again, that he was killed. To see that she was disrespecting and dishonoring my father’s life, by taking a life and not owning up to it.”

Harms sent the photos to Mississippi authorities and several political leaders. Within two hours she was arrested, one year to the day after she got out of prison. Harms said in addition to disrespecting his father, she was disrespecting innocent lives in the community where she lived.

ATLANTA - 2014-01-04 —An Atlanta Police Department supervisor was arrested for allegedly driving while under the influence, FOX 5 has learned.

Atlanta Police Lt. Maurice Dodd allegedly struck a water hydrant on Piedmont at Farr roads in Buckhead early New Year’s Day. Investigators believe that the vehicle struck the hydrant with such force that it was propelled into a parked car, which sustained significant damage. As Dodd sat in his damaged personal vehicle, a female patrol office came up to check on the situation and said she spotted two open beers in the vehicle’s cup holders.

Dodd was arrested on DUI and other charges. At the jail, Dodd allegedly resisted the female officer, who had to call a corrections officer to take Dodd to the ground so that he could be handcuffed.

“It’s always frustrating when you have any officer arrested, but more specifically about our middle managers and managers of our department. Clearly we are held to higher standards,” said APD Chief George Turner.

Dodd is on paid leave pending a meeting with Chief Turner, which is scheduled to be held next week.

Turner issued a letter to the all APD officers stating that there have been too many members of the force charged with DUIs. In 2012, up to eight officers were involved in some kind of DUI situation.

2014-01-04 —The Baton Rouge Police Dept has arrested Sherwood Taylor, 61, 42714 Yokum Rd, Ponchatoula, and charged him with 6th Offense DWI.

According to a report, Taylor was involved in “several motor vehicle accidents” in the 8800 block of Florida Blvd sometime around 5:45pm Friday night, January 3rd.

The investigating officer stated that upon contacting Taylor, he noticed Taylor had bloodshot eyes and was having trouble balancing. Taylor was given a standard field sobriety test which he performed poorly on.

Investigators took Taylor to a nearby police station, where he refused a breathalyzer test.

Taylor was taken into custody and charged with 6th Offense DWI, Driving Under Suspension and Reckless Operation. He was transported to EBR Parish Prison where he is currently awaiting bond.
