Will Jake still be laughing on November 1st?

From KSL

DUCHESNE — 2013-08-15— A jury trial has been scheduled for a Fort Duchesne man charged with DUI and texting and driving in connection with a January crash that nearly killed a Roosevelt woman.

Jake Antonio Arrats entered pleas of not guilty Thursday in 8th District Court to charges of DUI, a third-degree felony, texting while driving, a class B misdemeanor, and four other misdemeanor traffic offenses. After accepting Arrats’ pleas, Judge Douglas Thomas set a Nov. 1 trial date.

Roosevelt police say Keri Houston, 19, was sitting in a parked car Jan. 28 when she was sideswiped by Arrats. Houston’s door was open and her left foot was planted on the ground outside when the crash happened, causing a near-complete amputation of her leg in two places.

Arrats was driving under the influence and replying to a text message with the word “Haha” at the time, investigators said.

Doctors believe it was the quick thinking of good Samaritans — one of whom used his belt as a makeshift tourniquet — that saved Houston’s life.

After court Thursday, Jeff Houston said his daughter has undergone 11 surgeries, including one where doctors took 18 inches of muscle and tissue from her back …MORE

From Press Telegram

Long Beach, Ca., — 2013-08-16 — An emergency medical technician who allegedly was drunk and blacked out when he crashed his car into a tow-truck driver on the 405 Freeway in December is facing second-degree murder charges in a prosecution several legal experts say is very aggressive.

Faapuna Manu, 27, of Long Beach, was fatally struck about 2 a.m. Dec. 9 on the right shoulder near the Cherry Avenue on-ramp to the southbound 405 Freeway.

Raymond Burley, 26, of Los Angeles, who was driving a 2005 Toyota, swerved onto the right shoulder and struck Manu, who was standing at his tow truck inflating a spare tire. Burley also sideswiped a 2005 Mercedes-Benz that was parked on the shoulder with a flat tire.

In July, at the Long Beach Superior Courthouse, Burley was charged with one count of what is called a “Watson murder.” It refers to a precedent-setting 1981 California Supreme Court case, The People v. Watson, that set the stage for reckless drivers, including drunk drivers, who cause a fatal collision to be convicted of second-degree murder.

In People v. Watson, the court ruled that once someone has been convicted of a DUI, the person essentially acknowledges the dangers of driving while under the influence of alcohol ….MORE

From WKBW

Erie County Sheriff’s Deputies made a DWI arrest and a DWI/ Drugs arrest overnight.  These arrests are the 210th and 211th DWI arrests made by Sheriff’s Deputies in 2013.

In the first incident, Deputy Gene Nati was investigating an injury accident on Cummings Rd. in the Town of Newstead in which a Spencerport woman crashed her car into a ditch.  During the investigation it became apparent that the driver, 68 year old Roberta Evans, was intoxicated.  She was arrested for DWI and a breath test was administered to determine her blood alcohol content.  The test revealed her B.A.C. to be .16%, twice the legal limit.  Evans was released on appearance tickets returnable to the Town of Newstead Court at a future date.

In the second incident, Deputy Timothy Colling responded to a citizen complaint of a reckless driver who had struck a guard rail on Olean Rd. in the Town of Holland and then continued on down the road.  Deputy Colling was able to locate and stop the vehicle further down Olean Rd.  Further investigation showed that the driver, 32 year old Domenica Moran of Holland, was …MORE

2013-08-18 — An 18-year-old high school student accused of causing a deadly wreck while he was under the influence of multiple drugs and alcohol was given a $50,000 bond during a hearing on Friday.

As a condition of his bond, Daniel Woosley’s license will be suspended for 60 days. He is required to wear an ankle monitor and be drug tested, Judge James Ashmore ruled.

Woosley, a Greer High School student, wiped tears from his face as he listened to 7th Circuit Solicitor Barry Barnette present the case against him during the hearing. Woosley is accused of causing the death of 40-year-old Daniel Nelson of Boiling Springs in a wreck last summer on Highway 101 in Greer.

An Anne Arundel County Police spokesman says that Dwyer, the  55-year-old Annapolis resident who represents Maryland’s 31st District in the  House of Delegates, was taken into custody early Tuesday morning on Route 100  near Edwin Raynor Boulevard in Pasadena.

Authorities say that a patrol officer spotted Dwyer’s car, which bears House  of Delegates tags, driving erratically Route 100 just before 12:45 a.m.

After he was pulled over, the Delegate failed each of the three sobriety  tests he was given. Dwyer told the arresting officer that he was going home from  a bar in Baltimore and had earlier consumed two beers.

Dwyer was sentenced in May to 30 days in jail several months after he crashed  his boat last Aug. 22. Nine  people, including several children, were seriously injured in the crash.

Francis T. Roscioli Jr

From Morning Call

2013-08-20 —On Thursday, 21-year-old Francis T. Roscioli Jr. was in Northampton County Court facing a parole violation after he was allegedly caught drunk in June while driving the wrong way on a downtown Easton street.

On Sunday morning, Roscioli was back behind the wheel drunk, city police said, only this time he is accused of killing someone.

Passing another vehicle westbound on narrow Lehigh Drive about 2:10 a.m., Roscioli’s SUV fatally hit 35-year-old Abraham Rivera of West Easton, a pedestrian who was walking on the shoulder of the other side of road, police said.

Charges against Roscioli, of Wilson, are pending toxicology tests but are expected to be filed this week, said police Lt. John Remaley. Roscioli is believed to have been drinking at a downtown Easton nightclub, and showed signs of intoxication after officers arrived at the scene, Remaley said.

Just four days before, Roscioli had appeared before interim Northampton County Court Administrator Jill Cicero for a hearing on whether he had violated his parole from jail on a 2012 assault conviction. In legal paperwork filed in July, his parole officer cited the previous month’s drunken-driving charges and Roscioli’s failure to stay away from drugs and alcohol, court records show.

Cicero concluded Roscioli was a parole violator, but allowed him to remain free ….MORE
