Salute to a fallen deputy from La State Trooper

A Louisiana State Trooper pays final respects to a fallen deputy.

2013-08-10 —Houma, LA- Shortly after 1:30am this morning, Louisiana State Police Troop C investigated a fatality crash on LA 182 in Terrebonne Parish where a passenger was killed and two drivers were arrested for driving while intoxicated.
The investigation revealed that a 1991 Nissan Maxima was traveling east on LA 182 just west of LA 660 in Terrebonne Parish.  The Maxima was being driven by Wilbur Macias-Mercado (H/M age 41) of Houma, LA.  The Maxima attempted to make a left turn into a private parking lot and turned into the path of a 2004 Cadillac CTS that was traveling west on LA 182.  The CTS was being driven by Kyle Naquin (W/M age 22) of Bourg, LA.
The CTS struck the Maxima on the right side and spun the Maxima into the parking lot where it struck a 1997 Chevrolet Silverado that was parked and unoccupied.  The front seat passenger in the Maxima, Rosa Benlavida (H/F of Houma), received fatal injuries in the crash and was pronounced dead on the scene by the Terrebonne Parish Coroner’s Office.  Both drivers received minor injuries in the crash and refused medical treatment at the scene.
Everyone involved was wearing a seat belt at the time of the crash.
Alcohol impairment was a factor in the crash.
Macias-Mercado was found to be more than double the legal limit of .08g% and was arrested for Vehicular Homicide, Failure to Yield While Turning Left, and No Driver’s License.  Naquin was found to be over the legal limit and was arrested for DWI 1st and Driving Under Suspension.  This crash remains under investigation.
Troopers remind everyone to remain safe on the roads and never get behind the wheel of a vehicle if you have had any alcoholic beverages.  While not all crashes are survivable, proper use of seat belts can greatly decrease an occupant’s chance of death and may greatly reduce the extent of injury.
Louisiana law requires every vehicle occupant, front seat and back seat, to be properly restrained day or night.  Taking the time to buckle up every trip and every time is the single most effective thing you can do to protect yourself in a crash.
Motorists that witness hazardous situations are urged to call *LSP (*577) and report that activity to the Louisiana State Police.

LIVINGSTON LA. — UPDATE — 2013-08-11– According to the Louisiana State Police, shortly after 4:00 pm on Sunday, August 11, 2013, Samuel Doherty III was placed under arrest and charged with two counts of Vehicular Homicide. The arrest came after toxicology results showed Doherty to have been under the influence of several controlled dangerous substances at the time of the crash. Doherty was booked into the Livingston Parish jail on the above charges.

UPDATE – At approximately 7:30 pm on July 28, 2013, Bryan Payne succumbed to injuries received in the crash. He was pronounced deceased by doctors at Our Lady of the Lake Hospital in Baton Rouge. This crash remains under investigation, and charges are still pending.

Denham Springs – On Saturday, July 27, 2013, shortly before 9:00 pm, Troopers from Louisiana State Police Troop A began investigating a two vehicle fatal crash that occurred on LA Hwy 64 (Magnolia Beach Rd.) west of LA Hwy 1028 in Livingston Parish. The crash took the life of 20 year old Livingston resident Mickel L. Tetreault.

The initial investigation by State Police revealed that the crash occurred as 28 year old Baton Rouge resident Samuel Doherty III was driving a 2013 Chevrolet Silverado westbound on LA Hwy 64. At the same time, 22 year old Bryan Payne of Denham Springs was driving a 1997 Ford pickup truck eastbound on LA Hwy 64. For unknown reasons, Doherty’s Silverado crossed over the center line into the eastbound lane of travel and struck Payne’s vehicle head-on.

Troopers urge the public to remain vigilant while driving at all times. Never drive a motor vehicle when impaired or fatigued. Always remain buckled up while in a vehicle, regardless of seating position. Avoid distracting activities, especially the temptations of electronic devices that can substantially divert a driver’s attention away from the road, and always obey all traffic control devices.

No snowboarding in prison for David Torroni Jr., right, Judge Mary Hoak

The District Attorney’s Office sent out a press release after the hearing.

“While we appreciate that the court agreed that a prison sentence was appropriate in this case, we are nevertheless deeply disappointed that the length of the sentence was only five years,” Barkey stated in the release. “Our community can be assured that our office, together with law enforcement partners in the district, will continue to aggressively prosecute drinking or drugged driving to the full extent of the law.”

From Craig Daily Press

Hot Sulphur Springs – 2013-08-11— Shackled and wearing jail-issued clothing, a snowboarder, who just a year ago was an Olympic hopeful training with the Steamboat Springs Winter Sports Club, pleaded for leniency Friday after making the biggest mistake of his life.

The crash resulted in the serious injury of Todd Craft and the deaths of his good friends Megan Ritter and Brian Houle. The three were driving to Steamboat to spend Thanksgiving with Ritter’s mother, Elaine Houck, and her husband, Jim, who have lived in Steamboat for 12 years.

Torroni was charged with six felonies. Instead of going to trial, he chose to plead guilty to three felonies as part of a plea bargain ….MORE

Ronnie Burdette Dodd: he didn’t get a death sentence, he didn’t get a life sentence, for his 17th DWI conviction he was only given seven years in the slammer…

Editorial Opinion: Citizens need to realize that weak impaired driving laws for DWI DUI OWI by alcohol or drugs are due to weak lawmakers in the state legislatures who likely spend a lot of time boozing it up when in session, commuting from one cocktail party to another hosted by lobbyists and attending booze-filled fundraisers for themselves and their friends.

From Citizen Times

ASHEVILLE – 2013-08-12— A Swannanoa man will spend at least seven years in prison following his 17th conviction for driving while impaired over the past three decades.

Ronnie Burdette Dodd’s blood-alcohol level was three times the legal limit when he was pulled over on Old U.S. 70 on Jan. 29.

Buncombe County District Attorney Ron Moore said the case should serve as a warning that his office is serious about prosecuting drunk drivers, but he wishes state law carried harsher penalties with mandatory jail time for first offenders.

“It’s just a blessing that (Dodd) didn’t have a wreck and someone didn’t get seriously injured or killed,” Moore said. “We have too many impaired drivers who get into wrecks and kill or maim innocent people.”

Dodd, 55, of Northeast Avenue, pleaded guilty in Buncombe County Superior Court ….MORE

Moore said he’d like to see first-time offenders sentenced to jail.

“In North Carolina for a first offense you don’t serve a minute in jail,” he said. “You generally get a 60-day suspended sentence….”
