Jason Theriault, 33, of Hudson, is facing a second OUI charge for fatal crash in Framingham.

WOBURN – Middlesex County District Attorney Marian Ryan has announced that Jason Theriault, 33, of Hudson, was arraigned today in Framingham District Court on charges of operating a motor vehicle under the influence of alcohol, 2nd offense, and motor vehicle homicide while operating under the influence of alcohol in connection with last night’s fatal pedestrian crash in Framingham. The alleged collision resulted in the death of Patrick Stratton, 24, of Framingham.

Judge David Cunis set bail at $5,000 cash and ordered the defendant not to drive, to not use alcohol or drugs, and to be subject to random screens. The next scheduled hearing, in this case, is Tuesday, February 9.

At approximately 8:00 p.m. Framingham Police responded to a report of a motor vehicle crash at the intersection of Route 9 and Prospect Street in Framingham. Upon arrival authorities found the victim deceased. The alleged suspect remained at the scene of the incident.

This case is being investigated by the Framingham Police Department, the Massachusetts State Police, and the Middlesex District Attorney’s Office.

These charges are allegations and the defendant is presumed innocent until proven guilty.

The prosecutor assigned to this case is Assistant District Attorney Nils Lundblad. The Victim Witness Advocate is Rani Scott.

CHICAGO, ILL. — 01/22/2016 — A Northwest Side man has been charged with DUI in a Norwood Park crash that killed a passenger in his car, according to Chicago police.

Mishel Lame, 19, was driving a BMW coupe around 7:30 p.m. Monday when he rear-ended another car in the 5100 block of North Nagle Avenue, police said in a statement. The car was pushed into other cars, and the BMW also hit a tree, police said. 

A passenger in the BMW, Marion Mario Tahiraj, 20, was taken to Advocate Illinois Masonic Medical Center and pronounced dead.

01/22/2016  –Washington State Patrol reports that Trooper D. Wilkes is investigating a crash that took place at 9:44 pm on Jan. 21, 2016 two miles north of East Wenatchee in Douglas County, Washington.

A boy, 16-years-old, was reported by the Trooper to have been consuming alcohol and is being charged following a trip to Central Washington Hospital. 

The boozing teenager was operating a black 2015 Toyota Camry at a high rate of speed eastbound on State Route 2, according to the State Patrol, when a combination of inexperience behind the wheel combined with an abundance of stupidity fueled by booze caused him to strike a Jersey barrier. The booze cruise continued as the Toyota traveled on its roof for a distance before coming to a stop.  The upside down Toyota Turnover then blocked traffic.

The Washington State Patrol reports that the makeover given the Toyota Turnover was complete, leaving the owner of the vehicle without wheels as it was totaled.

01/22/2016 —A Memphis Police officer is off the job after being arrested for drunk driving and drug possession.

Officer Brian Kalapu was arrested Sunday morning after crashing his personal truck into a tree on Mullin Station Road. Investigators said he left the scene after the crash.

During a search of his car, police say they found drug paraphernalia, including 2.8 grams of marijuana and items that would be used to smoke marijuana

Kalapu’s police equipment belt was also found in the car.

According to the arrest affidavit, officers found the 31-year-old about 20 minutes away from where the crash happened. He was at his home in southeast Memphis.  ....MORE

Ivy Ray Eberhardt 12th DWI gets life in prison in Texas

A 62-year-old Weatherford, Texas man was sentenced to life in prison Wednesday after pleading guilty to his 10th driving while intoxicated offense.  He also racked up two more DWI arrests in Colorado when he fled Texas.

District Judge Craig Towson told Ivy Ray Eberhardt he was “a second away from hurting someone really badly” as he announced the sentence, according to a news release issued by Parker County district attorneys.

“Part of my job is to protect the citizens of Parker County,” Towson told Eberhardt. “The only way that I can think of to do that from somebody that has 12 DWI arrests and 10 DWI convictions is to put you in a place that you can’t drive for as long as I possibly can.”

On April 13, 2014, Weatherford police said they responded a call about a reckless driver on U.S. 180 and saw Eberhardt swerving and driving in the wrong lane. When police pulled Eberhardt over, they said he told the officer he had consumed most of a 750-ml bottle of whiskey that was found in his vehicle.

Assistant District Attorney Jeff Swain said Eberhardt’s case is only now concluded because they had to wait for him to finish his sentence for a similar case in Colorado.

“Eberhardt cut off his electronic monitor, skipped bond and fled to Colorado where he was arrested for yet another DWI offense,” Swain said.

According to the Lakeport Police Department, on Friday, January 22, 2016, at approximately 10:30 PM, Lakeport Police Officers were dispatched to the 1000 block of Lakeport Blvd. to investigate the report of a head-on vehicle collision.  While en route to the scene officers were further advised that one of the involved drivers may be intoxicated.

Upon arrival, officers determined that two vehicles, a blue 2012 Scion IQ (Suspect Vehicle) and a red 1999 Honda CRV (Victim Vehicle), had collided head-on in the east bound lane of Lakeport Blvd.  The driver of the victim vehicle was identified as a 19-year-old Lakeport female who is approximately nine months pregnant. At the time of the collision is was not known if she suffered any serious injuries.  A 21-year-old Lakeport male was riding as a passenger in the Honda, and he suffered serious injuries including possible broken bones.  Both victims were transported to Sutter Lakeside Hospital for treatment.  No further information on their condition is available at this time.

During the investigation, officers gathered information to indicate that at the time of the collision, the suspect vehicle was traveling west in the eastbound lane of Lakeport Blvd. at up to 60 MPH.

The driver of the suspect vehicle was identified as 31-year-old Kelseyville resident Athina Marlene Cook.  Emergency medical units from the Lakeport Fire Protection District (LFPD) evaluated Cook at the scene and determined that she did not have any injuries requiring her to be transported to a hospital.  Officers evaluated Cook, determined that she was intoxicated and placed her under arrest.  During the investigation, officers determined that Cook was currently on probation for a prior drunk driving conviction.

Officers transported Cook to Sutter Lakeside Hospital where she submitted to a blood alcohol test and was also medically cleared for booking.  Her blood alcohol results are not currently available.  Cook was then transported to the Lake County Correctional Facility where she was booked for felony drunk driving causing injury, reckless driving on a highway, driving while on drunk driving court probation, reckless driving causing a specified injury, reckless driving with injury and for being in violation of probation. She remains in custody on an NO BAIL hold.

Lakeport Police Officers last arrested Cook for drunk driving on October 7, 2012,  at approximately 2:00 AM after she came close to hitting an officer and three citizens on Armstrong St. while driving with a blood alcohol level of more than twice the legal limit.  In this case, the officer was only able to order the citizens out of the way, and himself get out of the way within seconds of being hit.

01/24/2016 — Riverside County Sheriff’s Department Sgt. Michael Gaunt reports that on Thursday, January 21, 2016, at 10:10 PM, officers from the Indian Wells Police Department responded to a call of a three-vehicle traffic collision located at westbound Hwy 111 and Indian Wells Lane, Indian Wells.

The driver of the vehicle, Harrison Hunter Abramson, 26, from Tampa, Florida, collided with the rear end of a vehicle in front of him in the westbound number two lane of Hwy 111. The force of the collision caused the second vehicle to collide with the rear end of a third vehicle in the westbound number two lane of Hwy 111. The drivers and occupants of the second and third vehicle were not injured.

The investigation revealed Abramson was operating a motor vehicle while under the influence of alcohol. Abramson was booked into the county jail in Indio after he was medically cleared from a local hospital.

The Riverside County Sheriff’s Department encourages the motoring public to not operate a motor vehicle while under the influence of alcohol or drugs.

Jesus Yzabel 30 charged with manslaughter Tucson AZ fatal122216 Tucson Police

A 30-year-old man was arrested, following a fatal collision involving a motorcyclist on the south side Friday night, authorities said.

Jesus Yzabel was arrested on suspicion of second-degree murder, aggravated DUI, endangerment and criminal damage, after his truck crashed into a motorcycle in the area of East Ajo Way and South Kino Pkwy, killing the rider, said Sgt. Kimberly Bay, a Tucson Police spokeswoman.

Shortly after 7:30 p.m., police and Tucson fire responded to reports of a crash between a motorcycle and truck, and when they arrived, both vehicles were on fire, Bay said.

Firefighters extinguished the blaze and provided medical treatment to the motorcycle rider, who was transported to Banner-University Medical Center, due to life-threatening injuries.

After arriving at the hospital, 52-year-old Norman Enfinger was pronounced dead, Bay said.  ….MORE

ARKANSAS —12/10/2013 –A Springdale man is behind bars after allegedly hitting his spouse in the face with a phone and assaulting her with a knife, after he suspected her of cheating on him. Police said three children were present during the fight.

Jesus Yzabel, 28, was arrested Monday night on suspicion of aggravated assault, domestic battery and forgery. He remained Tuesday in the Washington County Detention Center on $5,000 bond, according to the Washington County Sheriff’s Office.

He has a Jan. 8 arraignment date, and a separate court date set for Dec. 11, according to the Sheriff’s Office.

A preliminary report from the Washington County Prosecutor’s Office states Yzabel caught his spouse texting another man and suspected she may be cheating on him. The two started arguing, and Yzabel broke the woman’s phone, the report states. ….MORE

Nevada Highway Patrol Trooper Christopher Wirtanen DUI arrest Washoe County jail after being arrested by Reno Police

RENO, Nev. — 01/26/2016 — A Nevada Highway Patrol Trooper was arrested and charged with driving under the influence, according to records and multiple law enforcement agencies.

Nevada Trooper Christopher J. Wirtanen, 39, was booked into the Washoe County Jail on Friday morning on violation 484C.110.2A: DUI alcohol and/or drugs 1st offense, according to jail records.

Reno Police Officer Timothy Broadway said Wirtanen was arrested at around 2:30 a.m. on Friday. According to Reno Municipal records, bail for Wirtanen was set for $2,000, but he was released on his own recognizance.

Nevada Department of Public Safety Public Information Officer David Gibson confirmed that Wirtanen is a trooper and was off-duty at the time of his arrest. ...MORE

Sheriff hits out at critically-acclaimed 10-part Netflix series based on murder conviction that hints his department framed the suspect – saying it’s a ‘skewed’ movie and not a documentary.

The show, which was released on Netflix this week, follows the story of a mechanic convicted of killing a freelance photographer Teresa Halbach.

He was arrested for the slaying just two years after he was released from prison, 18 years after a jury found him guilty of a crime he didn’t commit.

The documentary-makers focus on the idea Avery was set up, after he filed a $36 million civil lawsuit against Manitowoc County, which would have drained them or a large part of their resources.

A quote at the beginning of the first episode sets the tone: ‘Law enforcement despised Steven Avery. Steven Avery was a shining example of their inadequacies, their misconduct.’

Manitowoc County Sheriff Robert Hermann, who joined the department the same year Avery was wrongly convicted of rape, told the Herald Times Reporter his officers would have had no reason to frame an innocent man and the filmmakers have taken the events out of context.

His department, he says, has received a number of negative phone calls and emails, some from other states and overseas. Read more:
