HOLLO ENTERS GUILTY PLEA TO KILLING DOCTOR WHILE DRIVING DRUNK

From Flathead News Group:

A Columbia Falls man who allegedly killed a Nebraska man in a drunken head-on collision in Columbia Falls last

01/12/2016 — A Columbia Falls man who allegedly killed a Nebraska man in a drunken head-on collision in Columbia Falls last summer, has agreed to a plea bargain, according to Flathead County court documents.

Matthew Michael Hollo, 23, signed a plea agreement in December which could give him 10 years in prison in exchange for a guilty plea to a charge of vehicular homicide while under the influence.

Under the agreement with the Flathead County Attorney’s office, Hollo would get 30 years in the Montana State Prison with 20 years suspended with no parole restrictions. Hollo will also be responsible for any fines associated with the felony if he is found by the court to be able to pay. The charge comes with a maximum fine of $50,000.

Hollo will also be able to argue for a lesser sentence. But the court isn’t bound by the plea agreement and would be able to impose a stricter sentence.

The plea agreement also waives Hollo’s rights to testify, call witnesses and be tried by jury.

On June 6, Montana Highway Trooper Thomas Manz arrived at mile marker two on the North Fork Road over the viaduct in Columbia Falls. He found a head-on collision that had occurred at 3 p.m. had killed the northbound driver of a Toyota Land Cruiser.

Timothy R. Fangman, 68, of Omaha, Nebraska was declared dead at the scene. Fangman was a noted cardiologist.

Hollo was the other driver in a Dodge Ram pickup. He was treated for minor injuries at the scene. …MORE

From a classmate of Tim Fangman

Joe Hale informs us from Houston of Tim Fangman‘s death from an auto – truck accident June 6, 2015:

Timothy_FangmanI recently received an e-mail from Ann Reins Fangman (SMC ’68) in regard to the tragic death of her wonderful husband Tim in a vehicle accident on June 6, 2015.  I knew Tim from freshman year forward as he was on my wing of the third floor of Keenan.  He grew up in Omaha and graduated from Creighton Prep.   After Tim’s ND graduation he got his medical degree from Creighton and later spent a year or so at the Mayo Clinic before returning to his hometown of Omaha to practice cardiology.  (Tim’s dad is still living and is a well-known Omaha physician.)

Tim_Fangman_ND68yearbookTim was the only occupant in his SUV and was wearing his seat belt when his SUV (heading north above Columbia Falls, Montana to a cabin – near Glacier National Park) was hit head on by a truck that crossed over and struck the SUV on a viaduct. Alcohol and speed were factors in the accident. The other driver has been charged with motor vehicular homicide and is awaiting trial.

I last saw Tim and Ann after our 10th Year ND Reunion as I drove over to Omaha.  Tim and I traded a few e-mails during the last year or so.  I’ve circulated the news of Tim’s death to fellow Keenan and other ND classmates who knew him.  And my three-year ND roommate Tom Culcasi said his wife Judy (SMC ’68) would notify her SMC friends.  Gene “Skip” Schraeder replied that he could remember tiptoeing as his room in Keenan was close to Tim’s;  Skip didn’t want to jostle the needle while Tim’s stereo (once again) was playing Beach Boys recordings.   (I can’t think of a nicer way to disturb whatever peace existed in Keenan!)

Many really-nice comments in regard to Tim’s diligence and interest in his patients can be seen if you Google the obituary, etc. from the Omaha newspaper.  Tim was predeceased by his mother Jeanne and two granddaughters.  Along with Ann and Tim’s father, Tim is survived by a son, three daughters, 10 grandchildren, 3 brothers and 3 sisters.

From Flathead County Sheriff Chuck Curry:

Injuries and deaths resulting from people operating vehicles under the influence of alcohol or drugs are one of the most preventable tragedies in our society today.

This is unacceptable. Although drinking and driving is a societal problem, law enforcement agencies are often the last line of defense when it comes to preventing the worst from happening. We, however, cannot do it alone. It is not possible to catch every driver under the influence who may be on the road at any given moment. The Montana Legislature has toughened DUI laws over the years, which has helped to reduce the number of first-time and repeat offenders. Cultural awareness of the problem has also helped. Organizations such the Flathead County DUI Task Force, Mothers Against Drunk Driving, Flathead CARE and STOP Underage Drinking in the Flathead; have helped to spread the word about lives ended too soon due to someone’s decision to get behind the wheel after drinking alcohol. The Flathead County Sheriff’s Office works with students in schools to understand the consequences of making bad decisions, including drinking and driving.

The enforcement of DUI laws is, of course, imperative and it is a responsibility that our agency takes very seriously. The deputies are dedicatedto the enforcement of these laws, and unfortunately, they stay very busy.

In 2011, 874 people were arrested for driving under the influence in Flathead County.

Acevedo charged with DUI homicide; killed his passenger in triple rollover

On November 28, shortly before 4:00 P.M. Yamhill County Sheriff’s Deputies responded to a single-vehicle crash near the intersection of Burns Road and Brown Road in the community of Whiteson.

Deputies arrived on scene and discovered a 1996 Chevrolet Cavalier in the ditch. The vehicle had crashed with two occupants. The driver, identified as Jose Manuel Acevedo, 42 of McMinnville was assisted from the vehicle by a witness. The lone passenger, identified as Maria Edith Naranjo Chavez, 48, of McMinnville died on scene as a result of the crash.

The initial investigation indicated the vehicle had been driving northbound on Burns Road when it lost control and entered the ditch, rolling over an estimated 3 times. Speed and alcohol appear to be factors in the crash.

Acevedo was arrested on criminal charges related to the incident. He is currently being held at the Yamhill County Jail on one count each of DUII and Criminal Negligent Homicide with a bail of $155,000.

The case remains open and under investigation by the Yamhill County Sheriff’s Office and the Multi Agency Traffic Team (M.A.T.T.). Anyone with information on this crash is urged to contact Deputy Rebecca Mayer at 503-434-7506 or mayerb@co.yamhill.or.us.

Montana Highway Patrol trooper dragged by DUI suspect Abraham Spotted Elk, on probation for murder 011316

From KULR

01/13/2016 — The U.S. Marshals Service has confirmed the man, 61-year-old Abraham Spotted Elk, who punched and drug a Montana Highway Patrol trooper after a traffic stop was on supervised release for homicide.

He was originally arrested for the 1986 killing of a man in Lame Deer.

The U.S. Marshals put him under arrest while he was in the hospital. According to Capt. Keith Edgell with Montana Highway Patrol, Spotted Elk was supposed to be released from the hospital Monday morning but now will be spending more time there for unknown reasons.

Spotted Elk’s chase with MHP ended in the suspect driving through a concrete barrier down an embankment on the S 27th St. overpass.

The trooper involved was not injured.

Highway Patrol is working with the County Attorney’s office to file charges against Spotted Elk, including felony assault of a peace officer.

ORIGINAL STORY:

A man was sent to the hospital, and will be spending the first part of the new year in jail after a car chase tonight.

It started when a Montana Highway Patrol trooper pulled over on a car on 1st Ave. because registration was not properly displayed. Sgt. Phillip Freed with MHP said when the trooper got to the drivers window, he saw a large bag of what they assume was methamphetamine. The trooper asked to see the bag, the driver pulled it out and that is when the driver punched the trooper in the head. The driver then started to drive off, dragging the trooper for 10-15 feet.

Highway Patrol chased the driver until he drove through a concrete barrier and down an embankment towards I-90 on the S 27th St. overpass.

Sgt. Freed says the man was taken to the hospital with a foot injury.

The trooper did not sustain any injuries.

Sgt. Freed says they believe alcohol was a factor in the crash. The man was also currently on federal probation.   ….MORE

Franklin County DWI sobriety checkpointNew Year’s DUI Enforcement Cites 396 Impaired Drivers

January 13, 2016 – Traffic Safety – The Heat Is On Results In 7,376 DUI Arrests In 2015.

STATEWIDE — For the 396 drivers arrested for impaired driving during The Heat Is On New Year’s enforcement, 2016 started on a low point — behind bars. Running from Dec. 30 until Jan. 4, the Colorado Department of Transportation (CDOT), Colorado State Patrol (CSP) and local law enforcement agencies successfully partnered for the year’s final The Heat Is On DUI enforcement period. The 396 arrests are an increase from the 367 arrests made during the same period last year.

“CDOT, CSP and local law enforcement will continue The Heat Is On campaign in 2016 to ensure the safety of all drivers on the road,” said Darrell Lingk, Director of the CDOT’s Office of Transportation Safety. “In addition, CDOT will introduce a new education campaign this summer about the dangers of driving under the influence.”

103 statewide law enforcement agencies collaborated in the New Year’s campaign, with the highest DUI arrest totals coming from the Aurora Police Department (58), Colorado State Patrol (49), Denver Police Department (37) and Colorado Springs Police Department (23).

“Law enforcement across the state is aware New Year’s Eve is a time when people like to enjoy a few drinks,” said Col. Scott Hernandez, Chief of the Colorado State Patrol. “We want everyone to know that driving impaired is not worth the risks in any circumstance, and the 396 arrests indicate far too many people are driving impaired.”

To help curb the urge to drive under the influence, the Regional Transportation District (RTD) and MillerCoors offered free rides on all RTD bus, mall and rail routes on New Year’s Eve. The program provided free transportation to 144,000 Coloradans. MillerCoors also distributed 300 cab vouchers in Ft. Collins and Greeley.

“Through our partnership with RTD, Coors Light provided a record number of free rides, taking countless cars off the road so people could ring in the New Year safely,” said Gene Giron, Responsibility Initiatives Manager for MillerCoors. “We hope this program will encourage Denver-area residents to make a plan for a safe ride home from their celebrations throughout the year.”

The New Year’s crackdown capped off a year with 12 The Heat Is Onenforcement periods. There were 7,376 total arrests made during these heightened periods, a decrease from 7,825 in 2014. The highest arrest totals occurred during the Spring Events (1,870 arrests), Fall Festival (1,486 arrests) and Labor Day (1,030 arrests) enforcement periods.

Boozing Barrister dragged firefighter for 25 feet as she drove around fire scene

Morgantown Police Department reports that a motorist attempted to drive around an active fire department scene and in the process ran into a firefighter working at the incident. She was charged with DUI.

The Morgantown Police Department responded to Richwood Avenue on Nov. 19, 2015, at approximately 23:30 hours for a vehicle accident involving a Morgantown Fireman.

The Morgantown Fire Department was responding to an alarm call on Richwood Avenue near the intersection of East Prospect Street. The Fire Department arrived on scene and upon exiting the fire truck, a fireman was struck by a vehicle. The vehicle went left of center and was trying to pass the fire trucks when the accident occurred.

The fireman was transported to Ruby Hospital with non-life threatening injuries. The name of the fireman will be released after notification to his family is made.

The driver of the vehicle, Yasmine Rosette Ghantous of Morgantown was charged with DUI with Injury in this accident. Ghantous was processed and taken to Mon County Detention Faculty awaiting arraignment.

Ghantous was admitted to the bar to practice law in West Virginia in 2013, according to the West Virginia Record. Apparently she spent some time at another bar before hitting the firefighter.

WBOY reports reveal that Morgantown Fire Chief Mark Caravasos said that the attorney dragged the firefighter 20-25 feet and ran over his leg before stopping.

Florida: Brent Taylor pleaded guilty to DUI manslaughter for killing motorcyclist James Thorndyke

From Panama City News-Herald

PANAMA CITY – 01/13/2016 — A local man involved in a fatal drunken crash with a parked motorcyclist has laid himself at the mercy of the court, according to court records.

Brent Alexander Taylor, 20, entered a plea of no contest Jan. 7 to DUI manslaughter in connection with the December 2014 death of 33-year-old James E. Thorndyke, who was killed while taking a break from riding his motorcycle along State 77.

The court accepted the plea as authorities perform an investigation in preparation for Taylor’s sentence hearing. However, the sentence will not come as a result of negotiations with the prosecution, but rather solely at the discretion of the judge in the case, court records indicated.

Several friends of Thorndyke, also known as “Bizkit,” have filed correspondence with Judge Brantley Clark Jr., calling for the maximum penalty. One went as far as to say that Taylor “deserves no mercy.”

Prosecutor Bob Sombathy said Taylor entered his plea directly with the court after the State Attorney’s Office did not budge on punishment negotiations. Sombathy said he did not offer Taylor a plea agreement because of the strength of the evidence against him in the case and the desire of Thorndyke’s family to pursue the maximum penalty.

Taylor could face between 10 and 15 years in prison when he is sentenced Feb. 4.

According to Florida Highway Patrol reports, Taylor continued driving ….MORE

James Thorndyke

James Edward “BIZKIT” Thorndyke,
age 33, was taken from this earthly stop and rests in the arms of our loving Lord Jesus. James was killed on Sunday morning while standing beside one of his favorite enjoyments, his 2008 Harley-Davidson Road King. To all who knew “Bizkit”, his quick wit, willingness to help a friend or stranger in need and his love of his family and friends will be deeply missed. James was born December 6, 1981 in Hampton, VA to Kenneth and Judy Batte Thorndyke. At three months of age he traveled to Budapest, Hungary with his parents and sister. He was always “brother” to his sister and kids in the neighborhood. As a child, he traveled and lived in Europe, Mississippi, and finally called Florida home. He was a graduate of the first class of Arnold High school in 2001, and originally attended Bay High School (sometimes known as Cornfed in school). He went on to work with the City of Panama City Beach, as a Class C Waste Water operator (or as he would say “a hockeyologist”). He celebrated his 33rd birthday on Saturday night with a bonfire and PLENTY of FRIENDS. His time was spent on the creek with friends, riding his motorcycle, taking his nephew fishing and talking with him were all so very important to him. He was also an active member of Shaddai Temple, and Pythagoras Lodge, and attended other Masonic Lodges in the area. He is preceded in death by his paternal grandparents Earl and Iris Thorndyke his maternal grandparents Otho and Barbra Batte, his father’s foster parents Charles and Nancy Brown and nephew Matthew Croyl. He is survived by his mother Judy and father Kenneth Thorndyke of Panama City Beach, FL, his sister Kenndra Thorndyke Croyl (Adam) and nephew Brayden of Phoenix, AZ, Uncles Karl Thorndyke of Chicago, IL and Otho Roy Batte (Linda) Brewton, AL, Aunts Sara Davis (Dale) of Okemah, OK, Patricia Walker (Jerry) of Kiln, MS, numerous cousins, also mourn his passing. He is rejoicing with friends and family that have preceded him. He will be missed by family and friends that love him here. Bizkit was a casual guy and would want nothing less for his memorial than leather vests, jeans, boots, shorts or flip flops, and are all good. If you knew James “Bizkit” Thorndyke you knew you had a friend! In lieu of flowers, give live plants, or make donations to Shriners Children Hospital in memory of James Thorndyke. The family will receive friends from 5:00 to 8:00 p.m., Friday, December 12, 2014 at Woodlawn United Methodist Church, 219 Alf Coleman Rd, Panama City Beach, FL 32407. Funeral services will begin at 1:00 p.m., Saturday, December. 13, 2014, at Woodlawn United Methodist Church, with Pastor Joe Lay officiating. In lieu of flowers, donations to Shriners Children Hospital in memory of James Thorndyke.

Levy County Sheriff Bobby McCallum

Levy County Sheriff Bobby McCallum

From the Levy County Florida Sheriff:

On November 25, 2015, at approximately 4 PM, a concerned citizen contacted the Levy County Sheriff’s Office to report a reckless driver.  The caller stated they observed a blue Ford pickup truck traveling north on US 19 from the Inglis area.  The truck was being driven in an erratic manner and had nearly collided with several vehicles.

More concerning was that the caller observed a child (reported to be approximately 4 years of age) inside the vehicle.  The child was not restrained in a car seat and was being shaken about in the vehicle.

Deputy Ryan Sullivan responded to the call and observed the vehicle traveling northbound near Gulf Hammock. Deputy Sullivan observed the vehicle being operated in an erratic manner and saw it nearly collide with another vehicle.  He also observed the small child standing in the rear seat of the vehicle.

Deputy Sullivan initiated a traffic stop and made contact with the driver, Joshua Robert Vogel from Palm Harbor, Florida.  Vogel smelled of an alcoholic beverage and admitted that he had consumed two beers earlier.  Deputy Sullivan found a 4-year-old female child in the backseat of the vehicle. The child was not restrained but was found to be uninjured.  Sgt. Carl Rogers responded to the traffic stop scene and stood by with the child until a relative arrived to take custody of her.

Vogel agreed to submit to field sobriety exercises.  He was unable to satisfactorily complete the exercises and was arrested for DUI by Deputy Sullivan.  During the search incident to arrest, Deputy Sullivan found a glass smoking pipe that contained burnt marijuana inside it.  The pipe was found on the console of the pickup truck.

After being arrested, Vogel became belligerent. He resisted Deputy Sullivan’s attempts to handcuff him.   Vogel cursed and threatened Deputy Sullivan. He was transported to the Levy County Detention Center where he refused to provide a breath sample and again cursed and threatened Deputy Sullivan and Detention Staff.

Vogel was charged with DUI, Child Neglect, Corruption by Threat Against a Public Servant, Possession of Cannabis, Possession of Drug Paraphernalia and Resisting Officer Without Violence.  Vogel’s bond was set at $10,000.00, and he was released after posting the bond on November 26, 2015.

SOUDERTON MAN CHARGED WITH HOMICIDE BY VEHICLE WHILE DUI IN DEC. 27 FATAL CRASH

NORRISTOWN, Pa.–Montgomery County District Attorney Kevin R. Steele and Horsham Township Police Chief William Daly announce the filing of charges against Corey Adam Mitchell, 26, of Souderton on the charges of Homicide by Vehicle while Driving Under the Influence and related offenses for causing the death of his friend Erik Detweiler, 25. The victim was living in California and was visiting his family at their home in Quakertown.

The charges stem from a two-vehicle accident that occurred Sunday, Dec. 27, 2015. Officers from the Horsham Township Police Department responded at 2:12 a.m. to the intersection of County Line Road and Easton Road for a two-vehicle accident involving a 2006 Hyundai Tiburon, driven by the defendant with Detweiler in the passenger seat, and a tractor-trailer.

The crash investigation, conducted by the Horsham Township Police and the Montgomery County Detective Bureau, found that the defendant was driving northbound on Easton Road and entered into the left-turn lane with the intention of turning left onto County Line Road. The defendant proceeded into the intersection at an angle, going through a red traffic light and directly into the path of the tractor-trailer. The tractor-trailer struck the passenger side of the defendant’s vehicle, killing Detweiler.

The investigation revealed the defendant was driving with his vehicle headlights off and drove through a red traffic signal when turning left onto County Line Road. Additionally, an analysis of the defendant’s blood found a blood alcohol concentration of .154% and the presence of marijuana.

The defendant is expected to turn himself in early next week and will be arraigned. The case falls under the jurisdiction of Magisterial District Judge Harry J. Nesbitt. A preliminary hearing will be scheduled at the time of the arraignment.

The case will be prosecuted by Assistant District Attorney Sophia Polites.

Dean Crislip was killed in a tragic motorcycle accident on Saturday night, March 21st. He was a big man with a big heart and an even bigger laugh. It was distinctive. It was infectious. He loved to let it out at the end of every sarcastic comment he could make.

He was very outgoing and never met a stranger. He was incredibly welcoming and made everyone feel like they were a part of any group. That gruff exterior was countered by a big softie on the inside.

Dean Crislip killed by DUI driver Pasco Co Fla.

He never took life too seriously, but was always there to lend a helping hand whenever he could. He was a good shoulder to cry on.

Dean played softball with the Suncoast Softball League for the better part of the last 14 years. He spent much of his time on the HoHo’s (now MetroChefs) and his current team, Woofpack.

His partner, Aaron Davis, also plays in the SSL for the Renegades. Faced with the loss of his partner, Aaron is going to be dealing with costs associated with his tragedy.

Hopefully, we can come together as a family, the Suncoast Softball League and help defray some of the expenses.

Even if you are not a member of the SSL, we ask that you contribute anything you can so we can make this burden on Aaron as minimal as possible.
