11/12/2015 — One man is dead, and another is behind bars after a two-vehicle collision late Wednesday morning, authorities said.
Phoenix police say, James Coughenour, 36, was impaired when his full-size pickup truck collided with a sports car near 41st Avenue and Union Hills Drive at about 11:30 a.m.
The car was travelling west along Union Hills when the truck attempted a left turn, clipping the car and pinning it against a light pole, Phoenix police Lt. Emilien Sapon said.
The collision left the sports car nearly wrapped around the pole, and its driver, 21-year-old Timothy Jordan, had to be extricated from the vehicle. Phoenix fire officials say he was taken to a hospital in very serious condition while the driver of the truck refused medical treatment.
Jordan died at the hospital, according to Sgt. Trent Crump, a Phoenix, police spokesman. ....MORE

MINEOLA, N.Y. – According to the Nassau County District Attorney’s Office, Acting Nassau County District Attorney Madeline Singas announced that County Court Judge Philip Grella issued a decision upholding the admissibility of the prosecution’s evidence after conducting a pre-trial hearing that concluded on September 30, 2015, in the aggravated vehicular homicide case against James Ryan.
The prosecution announced their readiness to try this case immediately, but the defense requested an adjournment until January 6, 2016, to obtain a complete collision reconstruction report from their expert.
On October 18, 2012, at 4:43 a.m. it is alleged that James Ryan was driving while intoxicated on the Long Island Expressway when he struck the back of a 2008 BMW causing the wheel to break and the BMW to become disabled while the defendant fled the scene toward exit 35, Shelter Rock Road. Ryan then collided with a 2005 Honda, seriously injuring its driver and causing his car to come to rest against the concrete center divider.
Thirteen-year veteran Nassau County Highway Patrol Bureau Police Officer Joseph Olivieri responded to the collision and within minutes was struck and killed by another motorist while he was tending to the drivers and the road was being closed down.
The defendant was indicted April 3, 2013.
After that, the indictment was dismissed as legally insufficient by the Hon. Jerald Carter on December 16, 2013, The District Attorney’s Office appealed the dismissal to the Appellate Division Second Department, which reinstated the indictment on February 4, 2015. The defense sought leave to argue before the Court of Appeals which was denied May 7, 2015.
The defense attempted to reargue the leave application that was also denied on July 28, 2015, exhausting all of the defense pre-trial appellate applications. “This prosecution represents the first time a DWI driver is being charged with an officer’s death under these circumstances, and I believe it is essential that we take on this unique fight for Police Officer Joseph Olivieri and his fellow officers who continue to be endangered by the criminal acts of others,” Acting District Attorney Madeline Singas said. “Officer Olivieri was killed in the line of duty because James Ryan was committing a crime when he drove drunk, crashed and fled the scene and those criminal acts put Officer Olivieri directly in harm’s way.”
Assistant District Attorneys Maureen McCormick and Michael Bushwack of Acting DA Singas’ Vehicular Crimes Bureau are prosecuting the case. Ryan is represented by Marc Gann and Zeena Abdi, Esqs.The charges are merely accusations, and the defendant is presumed innocent until and unless found guilty.
Florida: Highway Patrol charged Wesley McHenry with DUI manslaughter; killed Candie Laramore

BAY COUNTY, Fla. (11/12/2015) – The Florida Highway Patrol arrested a man on charges stemming from a fatal crash in Calhoun County in August.
According to troopers, Wesley McHenry is facing DUI manslaughter, vehicular homicide, and DUI with serious bodily injuries charges.
They say the vehicle driven by McHenry was traveling on County Road 275 heading toward Highway 20 at the same time as a vehicle driven by Mark Laramore. Troopers say McHenry didn’t stop at the stop sign and hit the passenger side of the Laramores’ vehicle, killing Candie Laramore who was sitting in the passenger seat.

LANSING 11/12/2015 — State Representative John Kivela was arrested late Monday night just outside of Lansing for operating under the influence.
Representative Kivela released the following statement about the incident:
“I am truly sorry to my wife, family, and constituents for letting them down. I have battled with alcoholism for most of my adult life. My dependence on alcohol has become a problem, and I plan to seek treatment immediately.”

LANSING – State Rep. John Kivela, D-Marquette, was arrested Monday night for operating under the influence just outside Lansing.
According to Officer Derek Koenigsknecht of the Clinton County Sheriff’s Office, Kivela was booked in the Clinton County Jail around 10 p.m. and released at 9 a.m. Tuesday.
The sheriff’s office does not plan to release any further details pending arraignment, which is scheduled for Nov. 19 in the 65th District Court, Koenigsknecht said.
Details of the arrest are unknown.
“I am truly sorry to my wife, family and constituents for letting them down,” Kivela was quoted as saying in an email distributed by Grassroots Midwest Tuesday afternoon. “I have battled with alcoholism for most of my adult life. My dependence on alcohol has become a problem, and I plan to seek treatment immediately.”
Officials in Kivela’s office confirmed the lawmaker was arrested Monday evening, but referred all questions to Grassroots Midwest Tuesday afternoon. A representative from Grassroots Midwest said there are no further comments beyond the statement released Tuesday.
According to the group’s website, Grassroots Midwest is described as a bipartisan grassroots advocacy firm.

LAKELAND, Fla. — An assistant state attorney representing the 10th Judicial Circuit State Attorney’s Office has resigned from his position following a DUI arrest Saturday night in Lakeland.
Kyle Robert McNeal, 31, was arrested after leaving the Linksters Taproom at 5125 Highway 98 in Lakeland after a bartender notified police that McNeal left the premises “highly impared,” according to the arrest report.
McNeal was pulled over after Polk County Sheriffs deputies observed him drive his Acura four-door vehicle over a raised curb island while going through a nearby McDonald’s drive-thru. He then failed to stop at a stop sign.
The deputy continued to follow McNeal, who proceeded to cross over a double yellow line and the white fog line “multiple times.” The deputy then conducted a traffic stop to see if the driver was sick or impaired.
McNeal did not immediately stop for the deputy and continued to drive to a Lakeland address. As the deputy approached the driver, he observed McNeal putting a piece of gum into his mouth, according to the report.

Oregon: State Police say Leovigildo Torralba Arzola was DUI & rear-ended taxi, killed Martha Cruz Aldama
A Woodburn, Oregon woman is dead and Salem man is in jail on DUI manslaughter charges after a booze cruised ended when the DUI driver rear-ended a taxi, killing a passenger.
According to the Oregon State Police, on November 15, 2015 at 2:43 AM Oregon State Police Troopers (OSP) responded to a two vehicle fatal crash on SR HWY 99 near Belle Passi Road just outside of Woodburn city limits.
According to Senior Trooper Frank Hagen, vehicle #2, a 2000 Honda Odyssey, was traveling southbound on HWY 99 E near milepost (MP 34) when it was rear-ended by vehicle #1, a 2002 Chevrolet Avalanche.
Vehicle #2 was a taxi and was operated by Erica Perez Perez, age 31, from Woodburn. Vehicle #1 was being operated by Leovigildo Torralba Arzola, age 29, from Salem.
Vehicle #2 was also occupied by three passengers and they have been identified as: (right front) Eliceo Armmenta Arredondo, age 41, from Beaverton; (left rear) Francisco Aguilar Munoz, age 45, from Hillsboro; (right rear) Martha Cruz Aldama, age 34, from Woodburn. Safety restraints were being used by the front passenger and driver and it is unknown if seat belts were being used by the rear passengers. Martha Cruz Aldama was pronounced deceased at the scene.
Alcohol is being considered as a contributing factor for the crash. Leovigildo Torralba Arzola has been lodged at the Marion County jail for driving while under the influence of intoxicants, reckless driving, reckless endangering person (x3) and manslaughter II. Additional charges may be considered as the investigation continues.
OSP was assisted by Woodburn Police Department, ODOT, OSP-Criminal Division, Hubbard PD, Keizer PD, and Marion County District Attorney’s Office.

11/15/2015 —- A Sacramento man was charged with vehicular manslaughter and felony DUI after a two-car collision on Highway 99 early Saturday killed a passenger in the other car.
The California Highway Patrol said Jian Saeteurn, 34, was arrested at a residence after fleeing the scene on foot. Officer Michael Bradley, a CHP spokesman, was unable to provide any details on where Saeteurn was caught.

Maryland: State Trooper busted by a state trooper for DUI after overturned his vehicle in crash

Maryland Trooper Charged With DUI After Flipping His Wheels
(ELKTON, MD) — (Editor’s Note: A Maryland State trooper will likely be applying for a job as a pizza delivery guy if he can keep his driver’s license. But it’s doubtful he will keep his job as a state trooper. When a police officer is doing his or her job properly and charges another officer with a DUI, is the best indication to the public that laws are applied fairly)
He is identified as Trooper Thomas C. Hobbs, 26, who is assigned to the Aviation Command as a rescue technician at the Frederick Section. Troopers issued citations to Hobbs at the hospital, charging him with driving under the influence of alcohol, driving while impaired by alcohol, negligent driving, and reckless driving. His police powers have been suspended, and he has been suspended from duty with pay.
Shortly after 12:30 a.m. today, Maryland State Police troopers from the North East Barrack responded to the report of an overturned vehicle on Rt. 279, north of Appleton Road, Elkton. The first trooper on the scene found the driver, the only occupant of the vehicle, still inside the vehicle. The driver, later identified as Hobbs, exhibited signs indicative of someone under the influence.
Emergency medical service personnel removed Hobbs from the vehicle and transported him by ambulance to Christiana Hospital. Troopers continued their investigation at the hospital, and solid evidence indicated Hobbs was under the influence. He was charged accordingly.
Maryland State Police commanders were notified. The North East Barrack commander responded and suspended Hobbs’ police powers. The State Police Internal Affairs Unit was also notified and will be conducting an investigation.
Hobbs has been employed by the Maryland State Police for 17 months. All troopers remain in a probationary status until they have completed 24 months with the Department. He remains a patient at the hospital at this time.

Riverside County Sheriff’s Department reports DUI arrests:
PALM DESERT, CALIF. (11/26/2015) — Riverside County Sheriff‘s Sgt. Chris Willson reports that on Friday, November 20, 2015, at 1:54 A.M., officers from the Palm Desert Police Department responded to a single-vehicle traffic collision on Magnesia Falls Drive and Rutledge Way in Palm Desert. The investigation revealed a blue Ford Focus sedan was traveling westbound on Magnesia Falls Drive when the driver lost control of the vehicle and collided into the center median, disabling the vehicle. There were no injuries as a result of the collision.
The driver was identified as Tyler Gill, 24, of Palm Desert. Gill was arrested on suspicion of driving under the influence of alcohol/and or drugs. Gill was transported to a local area hospital for evaluation prior to being booked into the Riverside County jail in Indio.

A Gay Old Time in Lincoln MKZ
La Quinta Police report that on Tuesday, November 24, 2015 at 11:18 P.M. the La Quinta Police Department responded to the 51000 block of Calle Paloma reference a traffic collision. Preliminary investigation revealed a Lincoln MKZ was backing out of a driveway and accelerated backwards striking a wall to a residence across the street.
The driver of the Lincoln identified as Laura Gay, age 41 of La Quinta, was arrested for suspicion of driving while under the influence of alcohol/drugs. Gay was taken to a local area hospital as a precaution prior to being booked into the county jail in Indio.
Honda said: “Roll me over, lay me down and do it again!”
According to the Riverside County Sheriff’s Department on Friday, November 13, 2015 at approximately 11:06 P.M., Coachella Police responded to the 86 Expressway south of Dillon road regarding a single-vehicle rollover traffic collision. The investigation revealed the driver of a gray 2005 Honda Civic was traveling southbound on the 86 Expressway and left the roadway. The Honda continued westbound through the open desert and rolled over.
The driver of the Honda, Marlene Limon, 30 years old of Coachella, was evaluated and placed under arrest for suspicion of driving under the influence of alcohol and / or drugs. Limon was taken to a local hospital for precaution prior to being booked for driving under the influence.

According to Oregon State Police, on 11/25/2015 at about 1:06 AM the Lane County Sheriff’s Office received a complaint of a single vehicle crash on Washburn Lane west of Junction City. Upon arriving, they found a male passenger deceased. The Oregon State Police Collision Reconstruction Unit responded to assist with the investigation.
Preliminary information indicates a 2016 Dodge Charger was traveling on Washburn Lane when the driver left the roadway and struck a power pole. The passenger, William T BARNETT, age 29, of Junction City was pronounced deceased on scene.
The driver, later identified as Lee W VOLGARDSEN, age 41, of Eugene, fled the scene on foot before emergency vehicles arrived. He was later located and his residence. VOLGARDSEN was taken into custody and transported to the Lane County Jail where he was charged with Manslaughter in the Second Degree.
Alcohol use is being considered a contributing factor. Police say that this is an ongoing investigation more information will be released when it becomes available.
Florida: Highway Patrol charged Keith Pumphrey with DUI manslaughter for killing

A Melbourne man was arrested today by Florida Highway Patrol troopers after an October crash near Titusville left a 20-year-old woman dead.
Keith Pumphrey, 22, suffered critical injuries in the Oct. 10 crash that killed 20-year-old Keri De Mott, who was from Orlando. Troopers traveled to a Jacksonville rehabilitation center to arrest Pumphrey after an investigation revealed that his blood alcohol level was 0.132 percent at the time of the crash.

NORTH LAS VEGAS, NV (11/27/2015) — North Las Vegas police identified the person accused of hitting and killing a teenage pedestrian before driving away from the scene Tuesday.
Police arrested Anthony Lauria, 28, in connection with the crash that took place on North 5th Street near Lone Mountain Road.
According to police, the crash happened at 12:20 p.m. when a black Ford Fusion was traveling northbound on 5th Street and left the roadway. The vehicle struck the teen, identified by the Clark County Coroner‘s Office as 16-year-old Bobbie Grayson, of North Las Vegas, who was also walking northbound on the sidewalk, near a gutter area.
Evidence and witnesses lead officers to track the vehicle to a nearby neighborhood. Lauria, who was identified as the driver, was taken into custody without incident.
First responding medical personnel pronounced Grayson dead at the scene.
Police believe alcohol was a factor in the crash. Lauria was booked on felony counts of driving under the influence resulting in death and duty to stop at the scene of an accident resulting in death. He was also booked on failure to maintain travel lane. Read more:

Derek Cincevich 29 of Hooksett NH charged with DWI by Hooksett Police 102115
HOOKSETT, N.H. (11/28/2015) — An honest impaired driver! According to Hooksett Police, on October 21st, 2015 at 12:13 AM, Officer Mannon responded to the parking lot of the Irving at 28 West River Rd. to check the welfare of a male sleeping inside a vehicle. When Officer Mannon approached the vehicle, its engine was revving. The male occupant in the driver’s seat was slumped over the wheel, sleeping with his foot on the gas while the vehicle was running. Officer Mannon was able to wake up the male and he was identified as Dereck Cincevich, 29, of Hooksett, N. H.
While speaking with Cincevich, it became apparent that he was under the influence of alcohol. Cincevich was asked to submit to field sobriety tests which he at first agreed to. While Officer Mannon was explaining the tests, Cincevich suddenly put his hands out and told Officer Mannon that he was not doing the tests and to arrest him.
Cincevich was placed under arrest for driving while intoxicated without incident. At the Hooksett Police Department, Cincevich agreed to a breath test and the results showed his breath alcohol content a 0.13. Cincevich was released on $2,000 personal recognizance bail and it scheduled to appear before the 6th Circuit Court in Hooksett on November 4th, 2015.
