Oregon: State Police charge Derek Martin with DUI after crash

Oregon State Police (OSP) troopers arrested a Eugene man Wednesday morning on multiple charges stemming from a DUI-I related crash on Interstate-5 south of Eugene.

According to Lt. Rob Edwards on January 29, 2014 at approximately 5:45 a.m., a 1986 Subaru wagon operated by CHRISTOPHER EVANS, age 64, from Albany, was northbound on I-5 in the left lane.  A 2000 Ford pickup, operated by DEREK MARTIN, age 29, from Eugene, was also northbound in the right lane at the same location.

The Ford pickup crossed into the left lane and collided with the Subaru wagon.  The Ford pickup came to an uncontrolled rest partially blocking the roadway.  The Subaru Wagon came to an uncontrolled rest in the grass median.

EVANS received non-life threating injuries and was transported by ground ambulance to Sacred Heart Medical Center at Riverbend.

MARTIN was arrested at the scene for DUII – Alcohol, Reckless Driving, and Assault IV.  Additionally, Martin received a citation for Refusing a Breath Test.  MARTIN was transported and lodged at the Lane County Jail.

All involved parties were wearing safety restraints.

OSP was assisted at the scene by ODOT and Goshen Fire and Rescue.

California: Temecula Police charge James Desmond with DUI in running down jogger; had his 7-year-old kid in his car at Del Rey X Pina Colada

2014-01-30 — According to Riverside County Sheriff’s Department, on January 28, 2014, at about 6:30 PM, officers from the Temecula Police Department responded to the intersection of Del Rey X Pina Colada in the City of Temecula regarding a report of a vehicle that struck a pedestrian resulting in major injuries.

Upon arrival, officers located an injured jogger in need of medical assistance and one vehicle, a grey Volkswagon sedan with moderate front end damage. The Volkswagon contained a male adult driver and a 7 year-old female juvenile passenger who were uninjured in the collision. The injured jogger was transported to a local hospital for the treatment of major injuries sustained as a result of being struck by the Volkswagon.

Initial investigation revealed that the driver of the Volkswagon was traveling north on Del Rey and struck the jogger who was running south on Del Rey on the west side of the street. The driver was found to be under the influence of alcohol and or drugs.

The driver of the Volkswagon, 37-year-old James Desmond of Murrieta, was arrested for driving under the influence of alcohol and or drugs resulting in injuries and child endangerment.

2014-01-30– A Lewiston-Altura school bus driver is accused of being drunk when he crashed the bus into a tree with kids on board.

54-year-old Karl Herber is facing charges of 3rd degree The incident happened around 4:45 Tuesday afternoon. The Winona County Sheriff’s Office says the Herber’s bus crossed the center line and was facing on-coming traffic before it went into the ditch and hit a tree. Five children were on board at the time. Nobody was hurt.

Authorities say Herber’s blood alcohol content at the time of the crash was .09. The legal limit for commercial drivers is .04.

2014-01-30 — The warden at the Federal Medical Center in Rochester is speaking out following his arrest and conviction for driving while intoxicated.

The incident happened on New Year’s Eve in Rochester. 52-year-old Brian Jett was charged with two counts of misdemeanor DWI. He plead guilty January 21st to one count. Another count was dismissed.

In a statement, Jett says, “In response to the DUI arrest, it is with deep regret and that I confirm my arrest which occurred on December 31, 2013. I am currently dealing with this personal manner and fully accept responsibility for my actions.”

Jett added, “Law enforcement officers have a responsibility to respect the law and I apologize for my lapse in judgment. Despite this personal set-back, I can assure you of my continued dedication to the Federal Medical Center and the Rochester community.”

Jett was sentenced to a year probation, as well as fines and fees. He remains employed at the Federal Medical Center. The Federal Bureau of Prisons wouldn’t comment on any disciplinary action.  MORE

2014-01-31 — A Bluffton man has been charged with felony driving under the influence after a one-car wreck Tuesday night in Bluffton killed his passenger, according to the S.C. Highway Patrol.

Eduardo Santos-Gomez, 22, was driving a maroon 1996 Mitsubishi Eclipse east on Bluffton Parkway when his car struck a raised median near the entrance of the Lakes at Myrtle Park apartments about 9:20 p.m., Senior Trooper Hannah Wimberly said. The car then hit a tree off the right side of the road.

Santos-Gomez and his passenger, 22-year-old Jose Alfredo Santos-Garcia of Bluffton, were trapped in the car, Beaufort County Deputy Coroner David Ott said. Both were wearing seat belts.

Santos-Garcia was pronounced dead at the scene, Ott said.

Santos-Gomez was taken to Memorial University Medical Center in Savannah. Upon his release, he was charged with felony DUI and no S.C. driver’s license and taken to the Beaufort County Detention Center,

When the other driver started yelling at him and threatening to kill him, off-duty police officer Michael Ladda didn’t know what to think.

Ladda was driving his Mazda south on Interstate 95 through Delray Beach just after 1 a.m. Monday when a GMC Yukon SUV pulled up alongside him, he said.

The Yukon’s angry driver, later identified by authorities as Edward J. Hoover, 34, of Fort Lauderdale, was not only shouting but gesturing that he had a gun, according to a Florida Highway Patrol arrest report.

“He was so irate that you couldn’t understand anything, he was screaming his head off,” said Ladda, a police officer in the small Palm Beach County town of Lake Clarke Shores.

Ladda said he doesn’t know Hoover, has had no prior contact with him, and couldn’t think of a reason why Hoover would be so upset. He said the incident erupted after he initially tried to pass Hoover’s SUV when it appeared to have intentionally slowed down.

Ladda said he accelerated to pass, and that’s when he saw that the SUV driver was gesturing at him and yelling that he would kill him.

Behind them on the highway, another driver, identified in the report as Bobbi Lynne Gabler, 39, of Boca Raton, was in her Nissan Maxima. She pulled alongside the SUV and rolled her window down, asking the driver to slow down.

Hoover’s response? Gabler told troopers he waved a gun at her and rammed her car on the front driver’s side, sending her off the highway and on to the grassy embankment, according to the arrest report.

Ladda, the off-duty officer, saw this and wanted to get Hoover’s license plate number. He said he got behind Hoover’s Yukon and followed him while notifying the Florida Highway Patrol.

“It’s bizarre,” Ladda said of the incident. “And it’s my duty to act. He was a danger to other drivers and I just felt it necessary to follow him at a safe distance.”

2014-01-31 — ERWIN – An Erwin woman was arrested last week for allegedly using her position as a local restaurant employee to express her frustration over a prior arrest by spitting in the food of Unicoi County Sheriff’s Department Chief Deputy Frank Rogers.

Amanda D. Engle, 29, 270 Rock Creek Road, was arrested Thursday and charged with disorderly conduct.

According to the arrest report written by Rogers, Rogers went to the Erwin Pizza Hut on Thursday to pick up pizzas he had ordered by phone earlier. Engle did not ask Rogers for his name, but rang up the pizzas and advised Rogers that the pizzas were still in the oven and that the food would be ready in a few minutes.

“I sat down on the bench which is straight in front of the counter,” Rogers wrote in his report. “The pizza oven is directly behind the counter. As the defendant removed the pizza from the oven I observed her cut her eyes and look at me. The defendant then leaned over the pizza that she had began to slice, and I observed her spit on the pizza which had been purchased by me.”

DPS Makes 1,400 DWI Arrests During Holiday Effort

AUSTIN – Texas Department of Public Safety (DPS) troopers made more than 1,400 DWI arrests during a special enforcement period from Dec. 13 – Jan. 2. The 21-day DWI enforcement effort included funding from a Texas Department of Transportation (TxDOT) grant.

“These enhanced patrols are designed to protect the lives of all travelers by taking impaired drivers off Texas roadways,” said DPS Director Steven McCraw. “The holidays are packed with celebrations, which means an increased potential for drinking and driving, and I’m confident DPS efforts helped prevent potentially deadly crashes.”

DPS Highway Patrol troopers made 1,490 DWI arrests during the holiday enforcement effort, and 289 of those arrests were a direct result of the increased patrols. The TxDOT grant allowed increased patrols in high-risk locations during the times when alcohol-related crashes are most frequent.

DPS enforcement also resulted in more than 24,800 speeding citations, 2,960 seat belt/child safety seat citations, in addition to 1,070 fugitive arrests, and 790 felony arrests during this time period.

On January 26, 2014 at approximately 3:00 AM New York State Police charged  Mark S. Sonner, age 22 of Ashville, NY for Driving While Intoxicated after responding to a report of a vehicle in a ditch on ST-394 in the Town of North Harmony.  Upon arrival Troopers noticed a strong odor of alcohol coming from the driver and after field tests placed him under arrest for DWI and transported him to SP Jamestown for processing.  Breath test results showed a BAC of .18%.  Sonner was issued appearance tickets for the Town of North Harmony Court and was released.

2014-02-01 - Fredonia Troopers arrested a South Dakota man for Driving While Intoxicated
Early Saturday morning following a hit and run accident.  Fredonia Troopers arrested  John Spray, 33, of South Dakota, early Saturday morning following a hit and run accident on Vineyard Drive in the Town of Dunkirk.  Spray ran into the back of another vehicle coming out of Applebee’s around 1210 am and then fled the scene.  He was located by Troopers at the Comfort Inn just across the street.  He was found to be intoxicated following his failure of field sobriety tests.  He was arrested and processed at the station and his BAC was found to be .14 %.  He was arraigned in the Town of Dunkirk Court and was remanded to the Chautauqua County Jail on $7000 cash bail or $14,000 property bond and is to appear back in court at a later date.

2014-02-01 –On January 30th at about 2:00 AM Clarence Troopers stopped a white Landrover on Transit Rd in the Town of Lancaster for No Front Plate, Moving From Lane Unsafely, Excessive Window Tint and Failure to Signal Turn. The operator identified as James M. Breidenstein age 43 of Birdsong Pkwy in Orchard Park showed signs of intoxication. He failed roadside sobriety tests and was placed under arrest for DWI. Mr. Breidenstein submitted a breath sample for testing which revealed his Blood Alcohol Concentration (BAC) to be .09%. He was issued traffic tickets and is scheduled to appear in the Town of Lancaster Court on a later date.

The Trooper located Elizabeth S Simmons age 44 of Salt Rd. in Clarence in a white Dodge Neon with the motor running in the parking lot of Passport Wines & Spirits on Main St in Clarence. While the Trooper checked the well bring of Ms. Simmons he noticed a strong odor of alcohol and she showed signs of being highly intoxicated. Ms. Simmons stated she had driven to the liquor store and had been there for about ten minutes. Ms Simmons failed roadside sobriety tests and was placed under arrest for driving while intoxicated (DWI). She submitted a voluntary breath sample for testing which gave a Blood Alcohol Concentration (BAC) reading of .23%. Ms. Simmons was subsequently  charged with Aggravated DWI (BAC greater that .18%). She was issued traffic tickets and is scheduled to appear in the Town of Clarence Court on a later date.

Boozing driver couldn’t keep her car upright in Arkwright
2014-02-01 — On January 30, 2014, a Fredonia State Trooper responded to County Route 72 in the Town of Arkwright for a report of a vehicle off the roadway. Upon arrival, the operator, Tricia Cole, 42, of Sinclairville, NY, was found unconscious in the vehicle and had to be awakened. The trooper was able to keep the operator alert and talking until EMS responded to remove her from the vehicle. Investigation revealed the vehicle was traveling southeast on CR 72 when she lost control of her vehicle exiting the north shoulder of the roadway, striking a ditch and coming to rest in a field. The operator was transported to Brooks Memorial Hospital by the Cassadaga Volunteer Fire Department.

Three arrested for selling booze to minors

2014-02-01 — On January 30, 2014, State Police and Franklin County Stop-DWI conducted an Underage Drinking Initiative in Franklin County which resulted in the arrests of three people for prohibited sale of an alcoholic beverage to a person under the age of 21.

During the detail, 16 retail establishments were checked and 13 were found to be in compliance. As part of the investigation, an underage volunteer was sent into each business in an attempt to have the clerk sell the minor alcohol.

The following individuals were arrested at the respective business and charged with one count of Prohibited Sale of Alcohol under the age of 21, an A misdemeanor under the Alcohol Beverage Control Law:

Tina J. Parent, 43 years old of Chateaugay, at Wendy’s Quick Stop, Chateaugay, NY

Wilson H. Knechtel, 23 years old of Chateaugay , Lavigne’s IGA, Chateaugay, NY

Matthew R. Collette, 45 years of Bombay, Collette’s One-Stop, Bombay, NY

All were issued appearance tickets returnable in the respective town courts.

2014-02-01 — New York State Police report that on January 23, 2014, at approximately 1 a.m., State Police responded to report of a possible intoxicated operator on State Route 37 in the Town of Massena.

State Police located the vehicle, a 2001 Mitsubishi Mirage.  The operator, Gail A. Goodenough, 62 years old of Massena, was subsequently was arrested for driving while intoxicated.

Her blood alcohol content was determined to be .20%.  Goodenough was charged with Aggravated Driving While Intoxicated for having a blood alcohol content of .18% or greater (misdemeanor). She was also ticketed for drinking alcohol in a motor vehicle,  unsafe backing and failure to keep right.  She is to appear in the Town of Massena Court on February 5, 2014 at 5 p.m.

2014-02-01 — Police report that on January 18, 2014 at approximately 2:30 a.m., State Police in Ogdensburg responded to State Route 37, in the town of Waddington to assist United States Border Patrol with a report of an intoxicated motorist.

A Border Patrol agent had conducted a traffic stop on 2005 Chevrolet pickup truck and found the operator, 42-year-old Marie L. Zarzycki, of Madrid, to be intoxicated. Zarzycki also had an open beer in the center console of the vehicle.

Zarzycki was arrested for driving while intoxicated. Her blood alcohol content was determined to be .21%.  She was charged with aggravated driving while intoxicated (misdemeanor) for having a blood alcohol content of .18% or higher. Zarzycki was also ticketed for consumption of alcohol in a motor vehicle. She is to appear at the Town of Waddington Court on February 5, 2014 at 4 p.m.

2014-02-01 —- Some FOLKS decide when and where they will smoke, drink, shoot up and ingest their drugs and booze and insist on sharing the effects of doing so with the rest of the motoring public. The New York State Police report on this story: On January 15, 2014 at approximately 12:15 p.m., State Police observed a blue 1998 Buick Regal parked facing west, on the shoulder of County Route 23, in the Town of Chateaugay, with it’s directional flashing.  The trooper pulled up behind the vehicle to check on the welfare of the operator. 29-year-old Jeffery W. Holcombe, of Chateaugay, was found in possession of a glass smoking device containing marihuana. He was subsequently arrested for Driving While Ability Impaired by Drugs and Unlawful Possession of Marihuana. He was also ticketed for uninspected motor vehicle.  Holcombe is to appear in the Town of Chateauguy Court on January 27, 2014 at 600 PM.

Previously, on January 14, 2014, at approximately 9:49 a.m., Holcombe was operating a 2004 Jeep Cherokee on State Route 95 in the town of Bombay. State Police initiated a traffic stop on Holcombe’s vehicle for a cracked windshield. He was arrested for Driving While Ability Impaired by Drugs, and Possession of Hypodermic Needles. He was also ticketed for having a cracked windshield.

Two other passengers in the vehicle, John E. Deragon, 44 years old of Clinton, NY and 22-year-old Issac A. Harwood of Burke, NY, were also arrested for Unlawful Possession of Marihuana. All three men were issued appearance tickets and are to appear at the Bombay Town Court on January 21, 2014 at 3 p.m.

DWI driver plays hide and seek in the woods with cop

2014-02-01 —  On January 14, 2014 at approximately 7:30 p.m., State Police in Tupper Lake responded to State Route 421 in the town of Piercefield for a report of a person driving while intoxicated.

A Department of Environmental Conservation Officer had initiated a traffic stop on a 1999 Chevrolet pick-up truck, to investigate a report of Encon law violations. The officer attempted to detain the operator for driving while intoxicated. The operator, 23-year-old Matthew J. Wilczak, of Verona, NY, refused to cooperate and then ran into the woods. The DEC officer took Wilczak into custody after a brief struggle.

When troopers arrived, Wilczak refused sobriety tests. He was charged with driving while intoxicated, and Resisting Arrest. He was arraigned in the Town of Piercefield Court and remanded to St. Lawrence County Jail in lieu of $500.00 cash bail, $1000.00 bond.

 Turn signal violation gives alert of DWI driver

2014-02-01 – On January 29, 2014, troopers at SP Sidney arrested Randy A. Leizear, 58, of Bainbridge, NY for driving while intoxicated with a reportable BAC result of .15%. The arrest resulted from a vehicle and traffic law stop for a turn signal violation on Maple Street in  Afton, NY.  The investigation determined that he was intoxicated while driving at that time.  Mr. Leizear was issued tickets returnable to the Village of Afton Court on February 3, 2014.

2014-02-01 - On January 31, SP Ithaca troopers arrested Annie V. Quach, 30, of Ithaca, NY for driving while intoxicated with a reportable BAC result of .17%.  The arrest was the result of a property damage accident investigation which occurred on St. Route 79, near Pine Tree Road in Ithaca, NY.  The investigation determined that Ms. Quach was intoxicated when she drifted off the roadway, in a 2003 Porsche Cayenne, and struck a utility pole.  Ms. Quach was issued tickets returnable to the Town of Ithaca Court on February 6, 2014.

2014-02-01 — On January 29, 2014, troopers at SP Margaretville arrested Shannon E. Almon, 25, of Hobart, NY for driving while intoxicated with a reportable BAC result of .14%. The arrest resulted from a motor vehicle crash investigation on the Dry Brook Road in Middletown, NY.  The investigation determined that Ms. Almon was intoxicated when she drove off the roadway and down an embankment. Her passenger was transported to Margaretville Hospital for minor injuries.  Ms. Almon was issued tickets returnable in the Town of Middletown Court on February 13, 2014.

SAN JOSE, Calif. — 2014-02-01 –A 27-year-old man has been arrested on suspicion of felony DUI following a two-car crash on state Highway 85 in San Jose late Thursday night that killed a 19-year-old man, California Highway Patrol officials said.

Kylendra Kumar, 27, of San Jose, was booked into Santa Clara County Jail this morning after being treated for injuries suffered in the rollover crash reported at 11:28 p.m. Thursday on the northbound side of Highway 85 south of Camden Avenue, according to the CHP.

When officers arrived, a black 2010 Nissan was resting on its wheels on the highway’s right shoulder and a red 1966 Volkswagen Beetle was on its roof and blocking the first and second lanes, CHP officials said.

First responders at the scene gave medical aid to Kumar for minor injuries and tried to extract the other driver from the Volkswagen, according to the CHP.

Kumar and the badly injured victim were eventually transported to Santa Clara Valley Medical Center, where the Volkswagen driver later died, CHP officials said.  ….MORE

DUII INJURY CRASH ON JASPER ROAD NEAR SPRINGFIELD (PHOTO)
A Springfield man was arrested by Oregon State Police (OSP) troopers for multiple crimes in a DUII related injury crash on Jasper Road near Springfield.

On January 31, 2014 at about 4:00 p.m., a 2004 Dodge pickup, driven by JASON GIBBS, age 29, from Springfield, was westbound on Jasper Road in the 36000 Block.  A 1991 Chevrolet car, driven by CARISA STEELE, age 20, from Lowell, was westbound in front of the Dodge pickup.  The Dodge pickup attempted to pass the Chevrolet car on a corner while an on-coming car was approaching.  The Dodge pickup came back into the westbound lane and crashed into the Chevrolet car.  The Dodge pickup rolled and came to an uncontrolled rest in the middle of Jasper Road.  The Chevrolet car went off the roadway and collided with a power pole.

A passenger in the Dodge pickup, RYAN MULLINS, age 18, from Cottage Grove, was ejected during the crash.  MULLINS was transported by ground ambulance to Sacred Heart at Riverbend with critical injuries.  GIBBS and STEELE were both transported by ground ambulance to Sacred Heart at Riverbend with minor injuries.  Investigators believe that GIBBS and STEELE were wearing safety belts and that MULLINS was not.

OSP troopers contacted GIBBS at the hospital where he was subsequently arrested for DUII, two counts of Assault III, Reckless Driving, and 2 counts of Reckless Endangering.

OSP was assisted at the scene by ODOT, Lane County Sheriff’s Office, EPUD, and Goshen Fire Department.  The road was closed for several hours during the investigation.
