California: Gamaliel Sosa charged with mowing down tree, wall and street sign in demonstration of driving prowess while DUI

2014-01-14 — Riverside Sheriff’s Department reports that on Sunday, January 12, 2014, at about 1:30 AM, officers of the Rancho Mirage Police Department responded to the intersection of Highway 111 and Bob Hope Dr., Rancho Mirage in regards to a single vehicle traffic collision.

This investigation determined that Gamaliel Sosa, age 24 of Indio, failed to negotiate a northbound turn onto Bob Hope Dr. from Highway 111.  Sosa drove over the center median of Bob Hope Dr., struck a tree, a small wall, an upright lane directional sign, and came to rest on the northwest corner of the intersection.   Sosa was found have been operating the involved motor vehicle under the influence of alcohol.  Sosa was arrested for driving under the influence and booked at the Riverside County Jail in Indio.

On Saturday, January 11, 2014 at 7:00 p.m. officers from the Palm Desert Police Department responded to California Drive and Michigan Drive, in reference to a traffic collision. The driver of a white GMC truck was traveling eastbound on California Drive just passing Michigan Drive. The driver of the GMC truck drove onto the sidewalk and collided into the front gate of the Palm Desert Country Club Villas at 77185 California Drive.

The investigation revealed that alcohol was a factor during this traffic collision. The driver of the GMC truck, Travis Pierce, age 32 from Palm Desert, was taken into custody for driving while intoxicated and booked into Riverside County Jail in the city of Indio. Pierce suffered no injuries as a result of the collision. Nobody else was injured as a result of this collision.

2014-01-16 — A judge has given a 20-year sentence, with 15 years suspended, to a Wolf Point man who killed his friend in a drunken-driving crash.

Appearing before Judge Gregory R. Todd on Tuesday, Justino Jason Hernandez apologized to the family of the friend he killed and asked for their forgiveness.

Hernandez, 23, pleaded guilty in October to felony counts of negligent homicide and negligent vehicular assault in the crash in August 2012.

Charging documents say Hernandez was drinking and driving a car from Wolf Point to Billings when it rolled off Interstate 94, killing one passenger, 21-year-old Kevor J. Martell, and injuring another, 21-year-old Alexander Bar.

Judge Todd gave Hernandez concurrent sentences of 20 years with 15 years suspended and 10 years with five years suspended to the Department of Corrections for the two charges — a sentence recommended jointly in a plea agreement.

In support of the sentence, Deputy Public Defender Roberta A. Drew pointed out that Hernandez has no prior criminal history, cooperated fully with investigators, is a veteran and took responsibility for the “horrible, tragic accident” that resulted in the “death of a close friend of his.”

As part of the sentence, Todd ordered Hernandez to complete a chemical dependency evaluation and comply with any subsequent recommendations. He also recommended Hernandez for a prison program aimed at helping those who have killed someone as the result of driving while intoxicated.

The judge also agreed to recommend Hernandez for Veterans Court once the man has finished his time in prison.

Enhanced Enforcement Results in 2,453 DWI Arrests
Third “DWI Confessions” Video Released, Highlights Consequences of DWI Arrest

​ST. PAUL, Minn. – Minnesota law enforcement agencies arrested 2,453 impaired drivers as part of an enhanced DWI enforcement campaign during Nov. 27-Dec. 31, 2013, according to preliminary DWI arrest information from the Minnesota Department of Public Safety (DPS) Office of Traffic Safety.

Based on preliminary data, there were 24,551 arrested for DWI in Minnesota in 2013. It is anticipated this number will approach 26,000 as data continues coming in and court cases are settled.

“The number of arrests made last month shows that too many of our drivers still make poor choices about drinking and driving,” said Donna Berger, Office of Traffic Safety director. “Our goal with these enhanced enforcement campaigns is to keep our roads safer and encourage drivers to make smarter decisions.”

The arrest numbers reflect statewide DWIs from 347 reporting agencies, including the Minnesota State Patrol, county sheriff’s offices and municipal law enforcement agencies.

The Minnesota State Patrol reported 546 arrests during the extra enforcement.

In the Twin Cities metro area, agencies with the most DWI arrests during the campaign included:

  • 86 – Minneapolis PD
  • 80 – St. Paul PD
  • 44 – Bloomington PD
  • 36 – Maple Grove PD
  • 31 – Eden Prairie PD
In Greater Minnesota, agencies with the most arrests included:
  • 38 – Wright County Sheriff’s Department
  • 32 – Duluth PD
  • 27 – Carver County Sheriff’s Office
  • 24 – Blue Earth County Sheriff’s Department
  • 23 – Red Lake Law Enforcement
The west-metro district of the State Patrol reported the highest alcohol-concentration in the state during the campaign – 0.34 – more than four times the legal limit of 0.08. This was followed by 0.33 from Lakes Area Police Department and 0.32 from Crookston, South Lake Minnetonka and St. Paul police departments. Twelve agencies reported their highest alcohol-concentration in an arrest was at or above 0.30.

2014-01-17   A Little River man is jailed on $50,000 bond in connection with a fatal vehicle crash that killed a 27-year-old woman, according to authorities. —    Austin Brady Cedar, 20, of Little River was booked into J. Reuben Long Detention Center at 5:20 p.m. Wednesday and charged with felony driving under the influence with death results, according to jail records. Cedar is being held on $50,000 bond.

Cpl. Sonny Collins with the S.C. Highway Patrol said that Cedar had been hospitalized since the Jan. 12 crash and was recently released so he was formally charged.

Crystal Grizzards, 27, of Little River died at the scene from injuries she suffered in the crash that happened about 6:10 a.m. Jan. 12, Horry County Chief Deputy Coroner Tamara Willard said.

Narrative
On the 1ST day of January, 2014, at approximately 5:23AM, while in the
250 block of W. Third St. S., in the City of Fulton, County of Oswego, State of New York, the defendant, Victor E. Garcia, was arrested for Driving While Intoxicated, Driving While Intoxicated BAC >.08%, and Failed to Keep Right.
On the above mentioned date, at approximately 5:03AM, while in the 400 block of W. Third St. S., City of Fulton, the defendant did operate a motor vehicle in a southerly direction while traveling on the east side of the roadway in the northbound lane of traffic, and did so while in an intoxicated condition. Said intoxication was shown by the defendants glassy eyes, slurred speech, the odor of consumed alcoholic beverage emanating from his breath and his failure of the following Standardized Field Sobriety Tests: Horizontal Gaze Nystagmus, Walk and Turn, and One Leg Stand. The defendant submitted to a preliminary alcohol screening test which resulted in a positive screening for the presence of alcohol. The defendant submitted to a breath test while at the Police Department which resulted in a blood alcohol content of greater than .08%.

SUSPECTED DUI DRIVER FROM DELAWARE KILLED IN MARYLAND CRASH

(MILLINGTON, MD) — 2014-01-18– An erratic driver who refused to stop for police in Delaware was killed early this morning when he apparently lost control of his vehicle and crashed into a vacant house in Kent County, MD.

The man is identified as Adam M. Hughes, 25, of Clayton, Delaware. He was pronounced dead at the scene of the crash, which occurred near the intersection of Rt. 291 and Crane Street, in Millington. His body will be taken to the Office of the Chief Medical Examiner in Baltimore for an autopsy.

Shortly after 2:00 a.m. today, Maryland State Police at the Centreville Barrack were notified by Kent County central dispatch of a single vehicle crash that occurred in Millington. Responding troopers found Delaware police already on the scene where a 2004 Saturn SUV had crashed into a vacant house. The driver, later identified as Hughes, was the only occupant of the vehicle.

Maryland State Police learned the driver had been seen driving erratically in Delaware. An officer from the Clayton (DE) Police Department had attempted to stop the vehicle, believing the driver may have been operating under the influence. The driver refused to stop. Police followed the vehicle into Maryland on Rt. 291, attempting to stop it.

When the suspect vehicle neared Crane Street, the preliminary investigation indicates the driver ran off the right side of the road and struck a curb. The vehicle then crossed back over the centerline, rotated 180 degrees and ran off the left side of the roadway. The vehicle struck a utility pole and then ran into the vacant house.

The Maryland State Police Crash Team responded to conduct a detailed crash investigation. The investigation is continuing.

FOREST PARK 2014-01-18 - The man charged with DUI in connection with a crash that killed two women on the Eisenhower Expressway in west suburban Park Forest Sunday is behind bars on a $350,000 bond.

Aaron I. Moore, 26, of Chicago was charged with two counts of aggravated DUI resulting in death, two counts of aggravated driving under the influence of drugs resulting in death, and two counts of leaving the scene of a fatal crash, according to Illinois State Police. In bond court Tuesday, Moore was ordered held on a $350,000 bond, according to the Cook County Sheriff’s office.

About 3:45 a.m. Sunday, a 1998 Ford Windstar van stalled in the eastbound center lane on I-290 near the First Avenue exit when it was rear-ended by a 2012 Dodge Durango SUV, according to a statement from ISP.

The Ford’s driver, 30-year-old Evelette Rivera, and back seat passenger, 29-year-old Krystle Hernandez, both died on impact, according to police and the Cook County Medical Examiner’s office. Rivera, of the 2900 block of North Merrimac Avenue; and Hernandez, of the 3700 block of West Grand, were pronounced dead at the scene at 3:55 a.m., the medical examiner’s office said.

Moore and a 25-year-old woman who was in the SUV with him were taken to a hospital with non-life-threatening injuries, according to police. Moore is scheduled for a preliminary hearing Friday in Maywood.  Read

2014-01-18 — Attorneys for Williamson County’s former public information officer argued in court today that a DWI charge against him should be dropped because a state trooper forgot to administer part of a sobriety test.

Prosecutors said that the charge against John Foster should be upheld because the rest of the sobriety tests provided enough clues for the trooper to arrest Foster.

Williamson County Court-at-law Judge Tim Wright said he planned to watch the videotape of Foster’s arrest but would not make a ruling on the case until at least Monday if not later next week.

Foster has been on administrative leave since he was arrested June 29, 2013. The leave was paid until about two weeks ago when it became unpaid, said Fred Thomas, a sheriff’s spokesman.

The court hearing Friday focused largely on the testimony of Department of Public Safety Trooper Joseph Stuart, who arrested Foster on June 29, 2013, on Interstate 35 north of Georgetown.

Stuart said he was alerted by dispatchers of a black BMW in Cedar Park and also on Interstate 35 that had been running red lights, driving at speeds up to 100 miles per hour and swerving.

When Stuart pulled the BMW over on Interstate 35 he found out that Foster was driving it and told him that he was being stopped for speeding. According to a video of the stop, Stuart asked Foster why he was speeding.

“There’s no reason,” said Foster, who later added that he was going to see a friend in a hospital in Temple, according to the video.

Stuart then asked Foster if he had been drinking, according to the video. “Not at all,” Foster said.

Stuart said in court Friday that he could smell alcohol coming out of the car and that Foster was “shaking pretty bad” when Foster handed the trooper his identification.

DPS Police arrested a 26-year-old man early Sunday and charged him with 4th Offense DWI.

According to a report, officers came upon a vehicle being operated by Larry Woodard of Arcadia Louisiana, which was parked, running and had the lights on. The vehicle was located on 6th ave. in downtown Baton Rouge.

The report states that Woodard was asleep behind the wheel and the officer tried several times to wake him.

Once Woodard was awake and speaking to the investigating officer, the report notes that the officer detected a strong smell of an alcoholic beverage coming from Woodard.

Woodard told the officer that he was on his way home and that he had 6 12-oz beers prior to driving.

Woodard refused a standard field sobriety tests and was transported to the downtown DPS Police station, where he also refused to submit to a breathalyzer test.

He was charged with 4th Offense DWI and transported to EBR Parish Prison where he is currently being held on a $75,000 bond.

BAKERSFIELD, Calif. – The intersection of Fairview Road and Monitor Street was closed early Friday morning due to a deadly head-on collision.

According to the Bakersfield Police Department, the accident happened at about 12:40 a.m.

Officers arrived and found that a GMC pickup truck had slammed into a Ford Fusion. The investigation revealed the driver of the pickup truck, Joseph Maine, 26 of Bakersfield, was traveling westbound on Fairview Road when he struck the Ford, which had been traveling northbound on Monitor Street.

OXFORD, Miss. (WTVA) — A St. Louis man faces charged of aggravated DUI in the death of two Ole Miss students in a car accident in November.

Arthur Leuking, 21, voluntarily reported to a judge Friday morning after a warrant was issued for his arrest.

Leuking was the driver of a car that wrecked on Highway 7 near University Avenue on November 9.

Christopher Grimaud, 20, of St. Louis and Kevin Eagen, 18, of St. Charles, Missouri died of injuries suffered in the accident.

2014-01-19 — The Lake Elsinore Police Department conducted a DUI/Driver’s License Checkpoint on January 17th, 2014, as part of the city of Lake Elsinore’s commitment to public safety.  This checkpoint was one of many that have been or will be conducted throughout the year in the city.  The checkpoint was located El Toro Cutoff and Highway 74 in the city of Lake Elsinore.  The goal of the DUI Checkpoint was to remove impaired and suspended drivers from the roadway and raise public awareness of the dangers of driving under the influence of drugs and alcohol.

Pedestrian Struck and Killed by DUI Driver in Sandy – driver fled but then walked back to the scene.
Sandy Police responded with Sandy Fire Department personnel to a car vs pedestrian crash on Beers Avenue at Hood Street in Sandy at about 11:30 PM on Friday. The pedestrian, Michael Topliff, 41, of Sandy, was struck in the intersection by a vehicle headed northbound on Beers Avenue. He was transported by ambulance to Emanuel Hospital, where he died of his injuries Saturday morning.The driver of the vehicle that hit Topliff initially fled the scene, but returned on foot and turned himself into responding officers. Philip Krogstad, 32, of Sandy, failed field sobriety tests at the scene and was arrested for DUI. Krogstad’s BAC was measured at .14%, within one hour after the crash. He was lodged at the Clackamas County Jail on charges of DUI and Assault in the third degree. His bail is currently set at $32,500. In light of Topliff’s  death, it is likely Krogstad will face additional charges.

Krogstad’s vehicle, a blue 1999 Ford Escort (earlier reported to be a Mustang), was found in the parking lot of his apartment complex a block from the crash. It was impounded and will be processed for evidence. The Clackamas County Sheriff’s Office Criminal Reconstruction and Forensic Team (CRAFT) responded to the scene to assist in the investigation.
