Kentucky: Megan McCoy killed by DUI wrong-way driver Jeffery Nelson, say police

2013-11-29 —A Murray man faces charges of second-degree manslaughter and a DUI after police say he was involved in a two-vehicle collision Thursday morning that left one woman dead.

Marshall County Sheriff’s Office deputies responded to an accident on U.S. 68/Ky. Hwy. 80 at about 5:30 Thursday morning in Aurora. According to the MCSO, Deputy Steven Oakley arrested Jeffery Nelson of Murray after police determined he had been allegedly traveling the wrong direction, striking another vehicle turning left onto the four-lane highway.

The driver of the other vehicle, Megan McCoy was pronounced dead at the scene, according to Dep. Coroner Barry Taylor.

The MCSO reported McCoy had crossed the two west-bound lanes of the highway where U.S. 68 splits from Ky. Hwy. 80. DUI driver in fatal wreck had prior DUI arrests
Nebraska — 2013-11-29 —- A Marquette man, 30 year old Christoper Hajek, has been charged with felony motor vehicle homicide in Monday night’s crash in Merrick county that killed a Columbus woman. 22 year old Amanda Ashe was pronounced dead at the scene of the accident on U.S. Highway 30 near Clarks. The arrest warrant revealed the defendant has had other scrapes with the law over the years.The defendant was arrested in Hall County on Friday, November 15 and was charged with driving under the influence of alcohol and domestic assault. Hajek was released from jail on bond in that case at 4:11 p.m. on Nov. 18th, less than five hours prior to the crash that claimed the life of Amanda Ashe.

An analysis of blood collected from the defendant after the crash revealed a blood/alcohol content of .158, or nearly twice the legal limit.

The defendant’s criminal history reveals a prior conviction for driving under the influence of alcohol in Colfax county in January of 2006 as well as convictions for willful reckless driving in Colfax county in 2003; driving during suspension and leaving the scene of an accident in Colfax county in 2003; driving during suspension in Platte county in 2004; driving during suspension in Nance county in 2005; driving during suspension in Madison county in 2005; reckless driving and leaving the scene of an accident in Platte county in 2008 and speeding in Adams county on October 4.

2013-11-29 — According to Caseyville Police, on Wednesday, November 27, 2013 at approximately 1:30 P.M. the Caseyville Police Department responded to the area of State Route 157 and Garden Avenue, Caseyville reference a traffic crash involving a vehicle and pedestrian.

Upon arrival of Caseyville officers, Jamel Rhodes was found deceased due to extensive bodily injuries sustained from an impact from a vehicle. The driver of the vehicle who struck the victim was transported to an area hospital for treatment due to minor injuries he sustained from the crash.

The results of the investigation were presented to the St. Clair County State’s Attorney’s Office for review.

On Friday, November 29, 2013 the St. Clair County State’s Attorney’s Office issued warrant numbers 2013-CF-017840 for the charge of Aggravated Driving under the Influence of Drugs, a class 2 felony, and 2013-CF-017840 for the charge of Reckless Homicide, a class 3 felony, charging Shaun J. Schmierbach, 32, of the 3200 block of Frank Scott Parkway, Belleville, Illinois with the above crimes.

Bond was set at $750,000. Shaun Schmierbach is currently incarcerated at the St. Clair County Jail for want of bond.

When we wrote about a Pierce County court giving a Kitsap County senior deputy prosecutor treatment for alcohol addiction in lieu of punishment, a number of readers railed against the deferred prosecution deal.

“She had a prior alcohol related incident where charges were reduced!! She was driving drunk with two 3-yr-olds in the car!! Why was deferred prosecution even on the table?” commenter SS487 asked.

I brought readers’ concerns to Pierce County Deputy Prosecutor Tim Lewis. In a nutshell, he said Barbara O. Dennis received no special consideration and only got the concessions to which she was legally eligible under state law.

“The way we approached this case is no different from how we approach any other DUI that comes through our office,” Lewis said.

The implication of Lewis’ statement is that anyone under similar circumstances should be able to expect the same treatment. Here are details of Dennis’ case and Lewis’ answers to questions raised by how it played out in court.

Dennis, 42, was driving Oct. 9 on Bond Road when her van rear-ended a Volvo that had stopped for a car that was turning. A Washington State Patrol trooper who responded noted Dennis smelled of alcohol. A test at Kitsap County Jail after her arrest showed blood alcohol levels of 0.144 and 0.134, more than the 0.08 legal limit. Two 3-year-olds were riding in Dennis’ car at the time of the accident.

The Kitsap County Prosecutor’s Office referred the case to Pierce County to avoid a conflict of interest. On Oct. 22, Dennis was charged with driving under the influence.

Dennis was charged with DUI in 2007 by Pierce County prosecutors. The charge was reduced to first-degree negligent driving, an alcohol-related misdemeanor, after Dennis complied with certain court-ordered conditions.

2013-12-01 — According to the Riverside County Sheriff’s Department Sergeant B J Adams, on Saturday, November 30, 2013 at 1:47 AM, La Quinta Police officers responded to the area of Avenue 52, west of Washington Street, to investigate a single-vehicle traffic collision. Their investigation revealed the driver was traveling west on Avenue 52 in a white Ford Fusion when the car struck the center median. The driver lost control, crossing the west bound lanes of Avenue 52 before striking the north curb, a palm tree, and a brick wall. Michael Hernandez, 28 years of La Quinta, was uninjured during the traffic collision, but was arrested for driving under the influence of alcohol and/or drugs. The suspect was taken to a local hospital for a precautionary medical clearance and was booked into the Riverside County Jail in Indio.

Mercedes Mama Slammed into Rear End of Toyota; Lori Arvizu Busted for DUI

At 11:49 PM on Friday, November 29, 2013, officers from the Palm Desert Police responded to a non-injury traffic collision in the area of Highway 111 and San Marcos Avenue in Palm Desert. A gray Toyota Corolla was traveling west in the #2 lane of Highway 111 when it was suddenly rear ended by a dark-colored 2013 Mercedes, causing moderate to major damage to both vehicles. The female driver of the Mercedes was unable to remember what lane she was in or how the incident occurred and she displayed visible symptoms of alcohol intoxication. A dedicated DUI Enforcement Officer responded to the scene and conducted an investigation, at the conclusion of which Lori Arvizu, 50 years old of La Quinta, was arrested for driving while under the influence of alcohol. No one was injured in the collision but both vehicles needed to be towed away from the scene. Arvizu was booked into the county jail in Indio.

The Palm Desert Police and the Riverside County Sheriff’s Department would like to caution all motorists to never drink and drive. All drivers are encouraged to immediately call 9-1-1 if they see a suspected drunk driver on the roadway.

According to Riverside County  Sheriff’s Department, on Saturday, November 30, 2013, at 5:59 PM, the Coachella Police Department responded to a reported hit and run traffic collision involving two vehicles on Avenue 52 and Jennifer Way. The investigation revealed a white Toyota Tundra was traveling westbound on Avenue 52 when it failed to yield prior to turning, causing a collision with a white GMC Yukon.

The driver, Sagrado Orellana, age 37 of Coachella, drove away from the scene. He was later arrested at a residence in the 52000 block of Jennifer Way. Orellana was arrested for hit and run and suspicion of driving while impaired with alcohol. Orellana was transported to a local hospital for precautionary medical treatment.

BAY CITY, MI— 2013-12-02 Crying as they spoke, the widow and daughters of a man killed in a drunken driving crash told a Bay County judge how their lives have been altered, as the man who caused the death hung his head and looked on.

The loved ones of Beaverton’s Elbert H. Nelson addressed Bay County Circuit Judge Harry P. Gill on Monday, Dec. 2, during the sentencing hearing for 26-year-old Ryan P. James. James on the evening of Nov. 11, 2012, was driving a 1999 Pontiac Bonneville on North Shore Road in Pinconning Township when he crossed the center line and collided head-on with a Chevrolet Impala driven by Nelson, 56 at the time. Emergency responders pronounced Nelson dead at the scene.

James in October pleaded no contest to single counts of operating a motor vehicle while intoxicated causing death, operating a motor vehicle while intoxicated causing serious injury and failure to stop at the scene of an accident when at fault resulting in death, all felonies. In exchange, the prosecution dismissed one misdemeanor count of operating a motor vehicle while intoxicated, second offense.

Gill sentenced James to two terms of 75 months to 15 years and one term of 40 to 60 months in prison. The terms are concurrent. The judge also gave James credit for 263 days already served and ordered him to pay $500 in restitution.

Jamette J. Nelson, Elbert Nelson’s widow who was in the vehicle with her husband when he was killed and herself injured, was the first of those affected to speak to the judge.

PANAMA CITY  —2013-12-02 — A Panama City trucker was sentenced to more than nine years behind bars Monday after he pleaded no contest to a count of vehicular homicide for driving his semi-truck into the back of a moving Jeep.

Judge Michael Overstreet sentenced Dennis Fuller, 44, to nine years and three months in prison, and his driver’s license will be revoked for three years after he’s released. Fuller pleaded no contest to vehicular manslaughter; the state didn’t pursue additional charges of DUI manslaughter and DUI with serious bodily injury.

Analysts with the Florida Department of Law Enforcement found methamphetamine and marijuana in a sample of Fuller’s blood drawn after the March 19, 2012, crash on U.S. 98 west of Mexico Beach. The crash killed Chris Herudzinksi and sent Dana Becker and Jadwiga Stojkowski to the hospital with serious injuries.

But attorney Waylon Graham, who represented Fuller, said those analysts could not testify that the levels of drugs in his blood were high enough to have caused Fuller to have been impaired at the time of the crash.

STOKES COUNTY, N.C. — 2013-12-02 — A 20-year-old man was sentenced to a month in jail, admitting he hit and killed a Stokes County woman after he had been drinking and driving.

Jacob Taylor Nunn, of King, who was 19 at the time of the accident in August 2012, pleaded guilty in a Stokes County Superior Courtroom as part of a plea agreement.

Nunn admitted he hit and killed Jennifer Nieberle on Edwards Farm Road near King after drinking and driving. He was also charged with leaving the scene of the accident and underage drinking.

Prosecutors say he left the scene after hitting Nieberle, then later called his father. At first, they said, Nunn told his father he might have hit a deer. According to the prosecution in court today, Nunn later said, “She was wearing white shorts.”

An autopsy revealed Nieberle died instantly.

It was her 33rd birthday.

Nieberle’s sister, Sonya Nieberle, said the past year has felt like one long nightmare.

“She was just a joy to be around and the life of the party. She was just always trying to help everyone,” Sonya said. “We were planning on having birthday celebration and instead we ended up with funeral food in the fridge.”

A memorial is still set up on road where Nieberle died, only blocks from her mother’s home.

“She was walking to the top of this hill to see the falling stars that night because it was her birthday,” Nieberle’s mother Debby Nieberle remembered. “She loved there was a meteor shower every year around her birthday in August. She loved to walk. She loved nature and being outdoors and watching the stars.”

“There are really no words,” Debby said slowly. “People tell me it’s supposed to get easier as time goes by, but I can’t see that happening right now.”

Family and supporters for both Nieberle’s family and Jacob Nunn were in court Monday.

For the first time since the accident more than a year ago, Nunn briefly addressed the Nieberle family. “I am very sorry for your loss. I never meant for anything like that to ever happen,” he said through tears.

His lawyer told the judge this was “not an appropriate case for an active sentence.”

Nunn’s thirty day jail sentence will be followed by supervised probation.

“As a family we’re glad he got some time. We were afraid not even one day would be served,” admitted Sonya. “I felt like there was not much remorse shown. We’re glad this part of it is over with.”

They say Nieberle will be remembered as an animal lover who encouraged spay and neuter causes and loved her dog, Cocoa. She was especially close with her maternal grandmother.

Debby added, “I hope this sentence is going to be closure so that maybe [Nieberle] can rest in peace now.”

Text: On 11-30-13 at approximately 2131 hours, the Alaska State Troopers Bureau of
Highway Patrol, Girdwood Team, stopped a 1999 Oldsmobile Bravado after it was called in as a REDDI.  It was reported the vehicle ran another motorist off the roadway on O’Malley Road in Anchorage and was driving southbound on the Seward Highway.
The vehicle was stopped near mile 101.5 of the Seward Highway.  The driver, Gregg Walter Brandlein, age 61 of Kasilof, was found to be impaired while operating under the influence of alcohol and in possession of marijuana.  He was arrested for DUI, MICS VI, and Reckless Driving.  Brandlein was additionally charged with Refusal to submit to a chemical test.  Brandlein was transported and remanded to the Anchorage Jail, held without bail.

Text: On 12/1/13, at approximately 2200 hours, Alaska State Troopers with the Bureau of Highway Patrol conducted a traffic stop on a Ford truck weaving on Trunk Rd at College Dr near Palmer. Investigation revealed the driver, Joseph Cleaver, age 33 of Palmer, was driving under the influence of alcohol while possessing a loaded firearm in the vehicle with 2 children under the age of 6 while his license was in Revoked status. It was discovered Cleaver had 3 previous convictions for DUI, two of the convictions were within the last 10 years making this DUI a Felony DUI.
Cleaver was remanded to the Mat-Su Pre-Trial Facility for Felony DUI, MIW 4th Degree, Endangering the Welfare of a Child in the 1st Degree (X2), Endangering the Welfare of a Child in the 2nd Degree (X2), and DWLR with bail set at $7500 + CATP. Passenger, Darren Hildebrand, age 30 of Anchorage, was found to be intoxicated and was arrested for MIW 4th Degree and Endangering the Welfare of a Child in the 2nd Degree (X2). Hildebrand was remanded to the Mat-Su Pre-Trial Facility with bail set at $1500.

Text: On 11-29-13 Alaska State Troopers contacted Andrew Hotch (38 y/o of Klukwan) near his residence in Klukwan after finding his vehicle abandoned in a ditch on the Haines Highway at milepost 22. The investigation revealed that Hotch was intoxicated and had lost control of the vehicle.  Troopers also found Hotch was in possession of apx. 1/4 oz of marijuana.  Hotch was arrested at 1635hrs. for DUI and Misconduct
Involving Controlled Substances 6 and transported to Haines.  A breath sample obtained from Hotch under the Alaska Implied Consent Law showed his BrAC to be .261%.  Bail was set at $1500 and he was jailed pending arraignment.

Text: On 11/28/13 at approximately 1738 hours, Alaska State Troopers responded to a residence on Vecera Dr. in Wasilla for a report of disturbance.
Investigation revealed Wilbur Kingsley, age 54 of Wasilla, drove while under the influence of alcohol and on a revoked license to the residence. Further, Kingsley subjected a family member to offensive physical contact and interfered when the family member dialed 911.  Kingsley was arrested and remanded to the custody of the Mat-Su Pretrial Facility and held without bail.

On 11-30-13, at approximately 1741 hours, AST attempted to conduct a traffic stop on a Chevy pickup truck for speeding near the intersection of Beaver Lake Road and Rochella Place in Big Lake. The vehicle failed to yield for
approximately 1.5 miles before stopping at Lodge Road. Investigation revealed the driver, identified as 54 year old Big Lake resident Buddie Holmgren, had a Revoked license for Felony DUI. Further investigation revealed Holmgren was on Probation for Felony DUI x2, as well as Assault 3rd Degree. Holmgren was arrested and transported to MSPT where he was held with bail to be set at arraignment.

Text: On 11-28-13, at 2324 hours, Alaska State Troopers with the Bureau of Highway Patrol observed a 2001 Dodge Caravan lose control while performing a turn causing it to travel into the opposite lane before going into the ditch where it became stuck on Lucille St near Nelson Ave.  The driver was identified as Jared P. Laskowski, age 28, of Wasilla.  An investigation revealed Laskowski was operating the vehicle while impaired by alcohol and he was placed under arrest for DUI.  Laskowski was also found to have two prior convictions for DUI within the last ten years making this DUI arrest a Felony.  Laskowski was also found to be driving with a revoked driver’s license, having a minor under the age of 18 in the vehicle at the time of his arrest and violating the conditions of his release from a recent arrest.  Laskowski was transported and remanded into the Mat-Su Pretrial Facility where he was held on a total of $5000 bail plus a court approved third party.

Nicholas Perry Hansel, who was driving the Chevrolet Tahoe carrying nine other Washington and Lee students, has been charged with DUI and is being held at the Rockbridge Regional Jail, according to state police.

ROANOKE, VA. 2013-12-04 —A Washington and Lee University student died and three others were left hospitalized early Tuesday morning after the packed SUV they were riding in overturned north of campus, officials said.

Kelsey H. Durkin, a senior from New Canaan, Conn., died in the wreck, the university said.

The driver, 21-year-old Nicholas Perry Hansel, was charged with driving under the influence and was being held at the Rockbridge Regional Jail on Tuesday afternoon, said Virginia State Police spokesman Sgt. Rob Carpentieri. He was also charged with refusing to be tested for drugs or alcohol.

Hansel, of New Orleans, is listed as a sophomore in the university’s student directory.

Eight other Washington and Lee students were in the 2006 Chevrolet Tahoe when it ran off the right side of rural Turkey Hill Road near Bethany Road, hit a tree stump and overturned about 1:30 a.m., Carpentieri said.

The school announced the wreck in a note to the campus from President Kenneth Ruscio.

Durkin, 21, was in a rear seat and taken to Carilion Stonewall Jackson Hospital in a private vehicle, where she was pronounced dead on arrival, Carpentieri said. She wasn’t wearing a seat belt and was thrown from the SUV, the sergeant said.

Hansel suffered minor injuries and was treated at Stonewall Jackson before being taken to jail.

Carpentieri said two other students involved in the wreck were initially taken to Stonewall Jackson but later airlifted to the University of Virginia Medical Center. One was in critical condition there Tuesday afternoon, and another listed in good condition, a spokeswoman said.

Another student was airlifted to Carilion Roanoke Memorial Hospital, where a spokesman said the student was in good condition Tuesday afternoon.

Other students in the SUV were treated at the Lexington hospital and released, and some declined care, Carpentieri said.

Some models of Chevrolet Tahoes can seat up to nine passengers, according to the automotive website Edmunds.com. State police Sgt. Bob Black said it’s not illegal for rear seat passengers 18 and older to be unbuckled and not in a proper seat in a vehicle. It’s not recommended, though.

The university said it was making counselors available for students and staff.

“There are no words to express the grief we feel over the loss of someone taken from us so suddenly and tragically,” Ruscio said in the letter about Durkin’s death. “In the days ahead, in the weeks and months ahead, our sadness will be lessened only by the memories of her time with us.”

News of the wreck and Durkin’s death began to filter around the university’s Lexington campus Tuesday morning.

“I know that it’s just barely sinking in for everyone, not just myself,” said Meredith Hardy, 22, a senior from North Carolina. “All I have are memories of good times and laughter with her. She cared about people and knew how to make you smile. I knew I could always count on her for a good joke that picked up my spirits.”   ….MORE

2013-12-05 — Thomas Conroy and his wife Penni were driving to their Acreage home after a day of errands. Penni Conroy was driving when investigators say Karmela Roy drove into the opposite traffic lanes and collided with the Honda Accord’s passenger side where Thomas Conroy was sitting.

The crash killed Thomas Conroy, a 76-year-old father, grandfather and great-grandfather and left Penni Conroy injured.

“He was a terrific guy,” Penni Conroy said of her husband of 21 years. “He was just a good guy.”

Roy, who lives near the Acreage, faced a Palm Beach County judge Wednesday morning after she was booked on charges of DUI manslaughter and vehicle homicide for the Nov. 7 wreck.

The 36-year-old woman was already in the jail, however, on criminal charges connected to a Nov. 20 wreck in which investigators say she left the scene. In that crash on PGA Boulevard near Ellison Wilson Road, Roy left the injured motorcyclist — Philippe Touya of North Palm Beach — on the ground, according to Palm Beach County Sheriff’s traffic investigators.

Judge James Martz ordered Roy be held without bond Wednesday morning.

2013-12-05 — A Twin Lakes, Wis. man pleaded not guilty Thursday morning to aggravated DUI, reckless homicide and other charges related to his allegedly striking and killing one Waukegan pedestrian and injuring another while driving under the influence of heroin.

Aaron Stoen, 26, has remained in Lake County Jail on $500,000 bond since his arrest.

Waukegan police said Stoen’s vehicle left the roadway near Sunset Avenue and Oneida Road and hit the two victims at about 12:30 p.m. Oct. 26.

Both victims were described as seriously injured, and one, a male, died after being taken to Advocate Condell Hospital in Libertyville, while the second, also taken to Condell, survived and is expected to recover.

Police said that “investigators discovered a small amount of what appeared to be heroin and drug paraphernalia” in Stoen’s vehicle, and that he subsequently provided a statement indicating that he “used heroin prior to the accident but remembered nothing of the incident.”

Police said Stoen’s driving privileges in Illinois and Wisconsin were revoked at the time of the accident due to DUI-related offenses.   ….MORE

2013-12-05 — A Wisconsin man charged with reckless homicide and aggravated DUI for killing one pedestrian and injuring another in a Waukegan traffic accident hours after using heroin pleaded not guilty in Lake County court early Thursday.

Aaron B. Stoen, 26, of Twin Lakes, remains held in the Lake County jail in lieu of $500,000 bail in the Oct. 26 accident at Sunset Avenue and Oneida Place on Waukegan’s north side.

Police said the two victims were walking in a residential area near that intersection going door-to-door while selling satellite television packages when the vehicle driven by Stoen went out of control, jumped the curb and struck them.

Both men were taken to Advocate Condell Medical Center in Libertyville with serious injuries. One man died the next day from his injuries, while the second is expected to make a full recovery.
