CALCASIEU PARISH, LA — 2013-08-27 -Two men have been booked on fourth offense DWI for the second time, according to a news release from the Calcasieu Parish Sheriff’s Office.
David G. Prater, 58, of Westlake, and Michael P. Miller, 33, of Sulphur, are accused in separate cases.
Authorities said Prater, who has a prior vehicular homicide conviction, was arrested around 10 p.m. Friday following a traffic stop near the intersection of Davis Road and Goss Road in Westlake. A deputy spotted a pick-up truck swerving onto the shoulder and into the opposing lane of travel several times.
“When the deputy approached the truck and spoke with the driver, Prater, he detected a strong odor of alcohol emitting from his breath, along with slurred speech and he appeared very unsteady on his feet,” the release states.
Authorities said Prater refused to perform a standard field sobriety test and also refused to submit a breath intoxilyzer test.
Prater was convicted of vehicular homicide and DWI fourth offense in 2006.
He was booked into Calcasieu Correctional Center and charged with DWI fourth offense, careless operation and no driver’s license.
Bond was set at $252,000.
Authorities said Miller was arrested for the second time on a fourth offense DWI on Saturday.

2013-08-27 — A Saratoga Springs man died Monday, a day after a Jeep he was in rolled down a Utah County mountainside.
Trevor Nielson, 36, was hospitalized Sunday evening at the University Hospital intensive care unit in “extremely critical condition,” said Utah County sheriff’s Sgt. Spencer Cannon. KNOXVILLE — A 49-year-old Sevierville man with a history of DUI convictions faces an aggravated vehicular homicide charge in a fatal three-vehicle crash Friday on Gov. John Sevier Highway.
Scott C. Spangler also is charged in Knox County with possession of drug paraphernalia, vehicular assault and driving while his driving privilege had been revoked, warrants show.
Spangler, who has an extensive criminal record, is accused of driving into and killing motorist Benjamin Woodruff, 38, of Knoxville, who was stopped in a turn lane on the highway. The crash occurred about 6:20 p.m. near Austin Park Lane, according to the Tennessee Highway Patrol.

At David Odom’s funeral last October, 300 mourners recalled a fun-loving husband, father of three, dear friend, and co-worker who lived most of his nearly 40 years around Lake Worth.
At the Palm Beach County Courthouse on Monday, some of Odom’s closest survivors again shared their memories while urging a lengthy prison sentence
for William Michael Melendez, the drunken driver who shattered their lives on Oct. 1, 2012.
Circuit Judge Charles Burton listened to Odom’s loved ones describe their anguish, and he heard Melendez, 35, speak of his “shame and guilt” while pleading guilty. Then Burton sent the Lake Worth man and repeat convicted felon away to state prison for 25 years.
The punishment is five years longer than requested by the State Attorney’s Office, and nine years longer than the defense wanted, but still less than the 30-year maximum possible sentence for the crime of DUI manslaughter and failure to render aid.
“You’re sitting here today having taken another human life, whether intentional or not,” the judge told Melendez.
Burton bemoaned such senseless tragedies keep happening because “nobody seems to learn” from the dangers of substance abuse.
“Drugs and alcohol, it’s destroying our society, it’s amazing,” he said.
Court records show Melendez had a .185 blood-alcohol content, more than twice the legal limit of .08. But he took the wheel of his Chrysler Sebring and plowed into Odom’s Mercedes at 4:05 p.m., on Military Trail, south of Melaleuca Lane. Melendez, unemployed and driving on a suspended license, also had cocaine and marijuana in his system.

WEST CHESTER – A Common Pleas Court judge on Wednesday found a Lincoln University student guilty in a 2011 fatal crash, a verdict that may see him sent to state prison for at least three years.
Judge Anthony Sarcione found Phillip Tomsic guilty of homicide by vehicle while driving under the influence, aggravated assault while DUI, involuntary manslaughter, recklessly endangering another person, and related charges, after hearing the case without a jury for three days earlier this month.
Tomsic was at the wheel of a borrowed car on Nov. 4, 2011 when it slammed into a tree on Ashum Road just off the Lincoln University campus in Lower Oxford. He and two friends, Anthony Vernon Washington and Kadeem Fulmore, had gone to get Chinese food at an Oxford restaurant and were on their way back to the campus when the crash occurred. Police said the car was travelling at an excessive rate of speed when it left the road and hit the tree.

Scott R. Leland will be sentenced this morning for driving drunk and causing a crash that killed Willoughby Police Officer Jason Gresko.
Leland, 45, previously pleaded guilty in Lake County Common Pleas Court to aggravated vehicular homicide and OVI.
On Sept. 21, Leland was driving southbound on Harmony Lane in Willoughby. At the same time, Gresko was driving northbound with his emergency lights on, responding to Lake Health’s West Medical Center to help another officer with an unruly patient.
Leland, who had drank alcoholic beverages before driving and voluntarily submitted to a blood test after the crash, had a blood alcohol content

Highway 116 south of Sebastopol opened early Wednesday after being closed for about 10 hours following a crash into a power pole by a suspected drunken driver.
The roadway, a major route connecting the west county with Highway 101 in Cotati, was opened just after 6:30 a.m., according to the CHP.

A Stafford man was arrested after police said he was driving drunk and caused a crash in the mid-county area.
Officers were called to the area of Hoadly and Purcell roads for a crash around 1:30 a.m. Tuesday, Prince William police spokesman Jonathan Perok said.
The driver of a 2007 Lincoln Navigator was headed northbound on Dale Boulevard when he “disregarded the red traffic signal” at the Hoadly Road intersection and collided with a 2002 Honda Accord which was going west on Hoadly Road, Perok said.
The Lincoln’s driver tried to leave, but police said the SUV “became inoperable” nearby.
Investigators determined the driver of the Lincoln, who was not hurt, was at fault for the crash, was driving under the influence of alcohol and was in possession of marijuana, Perok said.
The driver and passenger of the Honda were taken to the hospital for “significant but non-life threatening injuries,” according to Perok.

A man who admitted to driving drunk and causing a deadly wreck in Lackawanna County two years ago is going to prison.
Sean Barrett of Dickson City was sentenced to between one and a-half and four and a-half years in prison Wednesday morning.
The crash killed one of Barrett’s best friends, Kyle Locker of Dalton. It also injured two other women who were inside the vehicle.
One of them told the judge that her “whole world has been turned upside down since that night.”
Barrett is now confined to a wheelchair himself. Leaving court, he was full of remorse.
“I’ve told them many times before that I’m truly sorry and I always will be,” Barrett said.
The crash that Barrett was involved in happened on Interstate 81 in Dunmore in August 2011. Barrett admitted he was drunk and speeding when he drove off the road and hit a utility pole.
“It really is a selfish act for someone to drive under the influence. He was twice the legal limit, a little better than twice the legal limit, speeding, we didn’t have to be here today,” Deputy District Attorney Bob Klein said. …..MORE

From NBC4 — 2013-08-30 — Washington, D.C. Councilman Marion Barry’s son was charged with driving under the influence and possession of marijuana in Virginia earlier this month.
Police observed 33-year-old Marion Christopher Barry driving a gray PT Cruiser erratically in Hampton about 9:10 p.m. Aug. 16, authorities said.
After stopping Barry, officers found he was carrying suspected marijuana, police said. A search of the vehicle revealed more suspected marijuana and synthetic marijuana.

An Annapolis man was sentenced Friday to four years in prison for running over and killing a 71-year-old woman moments after she walked out of her church in Northeast Washington.
Joel R. Bromwell, 32, pleaded guilty in May to involuntary manslaughter and driving under the influence. The victim, Ruby Whitfield, had been a beloved cafeteria worker at Sidwell Friends School, retiring in 2008 after 44 years there.
Bromwell faced up to 30 years in prison, but prosecutors said in D.C. Superior Court documents that he should be credited for acknowledging his conduct and for “showing a willingness to undertake the hard work of amending his life.”
Two friends who saw Whitfield get hit and dragged down Florida Avenue on March 21 called the sentence too lenient. One said the images have forced her into therapy. The other, Jessie Thaxton, said: “That’s all he got? That’s nothing for taking a person’s life in a hit-and-run. He would get more than that for killing an animal.”

BARTOW— 2013-08-31| A 29-year-old undocumented immigrant was sentenced Friday to nine years in prison for a fatal hit-and-run crash that killed a young veteran who had recently returned home from Iraq.
William Pennock, 22, who served in the U.S. Army, died from injuries in an Oct. 3, 2010, crash on Wabash Avenue and George Jenkins Boulevard in Lakeland.
His mother, Kathleen Pennock, said the pain of losing her son felt like someone ripping her heart out of her chest.
“We finally had him back home with us,” she said. “I was totally hysterical. I could not believe my baby boy was dead.”
