OFFICE OF THE COMMONWEALTH’S ATTORNEY
COMMONWEALTH OF KENTUCKY
30th JUDICIAL CIRCUIT
THOMAS B. WINE, COMMONWEALTH’S ATTORNEY

On Feb. 14, 2019, the Jefferson County Grand Jury returned an indictment against Roger D. Burdette regarding the December 24, 2018 incident wherein the semi-trailer truck being driven by Burdette struck the police vehicle of Det. Deidre Mengedoht while she was making a traffic stop on eastbound I64 at the Belvedere, a collision which resulted in her death.   Burdette has been charged with one count of Murder, four counts of Wanton Endangerment in the First Degree, Operating a Motor Vehicle under the Influence of Intoxicants–First Offense and Failure to Give Right of Way to Stopped Emergency Vehicle.

The Wanton Endangerment charges result from the fact that the crash also threatened death or serious physical injury to the four occupants of the motor vehicle which Detective Mengedoht had stopped.

Roger Burdette charged with murder of police officer on a traffic stop when driving a sewer authority truck on Christmas Eve 2018.

The case has been assigned to Division Eight of Jefferson Circuit Court and Burdette is expected to be formally arraigned there on Monday, February 18, 2019 at 1:00 p.m.  Assistant Commonwealth’s Attorney Kristi Gray is the prosecutor.

MSD apologizes for hiring an attorney for employee charged in LMPD detective’s death

LOUISVILLE, Ky. (WDRB) — The Metropolitan Sewer District is apologizing for hiring a lawyer for an employee charged with the death of a Louisville Metro Police detective.

MSD Executive Director Tony Parrott released a statement explaining that the initial decision to retain a lawyer for MSD driver Roger Burdette was based on information available after the accident. He said that after input from the MSD board and leadership, the decision was made to not be involved in Burdette’s defense.

“Since the accident occurred, I’ve heard from our employees and our customers, and I know they are hurting,” Parrott said in the statement. “I share in this pain. This is an extremely difficult time for the community and especially for those of us working in public service.” MORE

Statement from MSD Executive Director Tony Parrott — On behalf of MSD — Along with the Louisville community, MSD continues to mourn the loss of Louisville Metro Police Detective Deidre Mengedoht. Her death is a tragedy. Our deepest condolences go out to her family and the Louisville Metro Police Department who serve our community every day. I also want to provide clarification as we move forward. MSD’s initial decision to retain legal counsel for tractor trailer driver Roger Burdette was based on what we knew at the time of the accident — specifically, that an employee was involved in an accident while on the job and in an MSD vehicle.

After further consideration with the MSD Board and leadership, MSD decided we would not be involved in Mr. Burdette’s criminal defense. We understand that our initial decision has upset many and for that we apologize.

Please know that no written contract was formalized with the defense attorney and no MSD funds have or will be used for defense in Mr. Burdette’s criminal case.

In addition, MSD has begun the process to terminate Mr. Burdette’s employment through MSD and union contract processes. He has been on unpaid status since being arrested. Since the accident occurred, I’ve heard from our employees and our customers and I know they are hurting. I share in this pain.

This is an extremely difficult time for the community and especially for those of us working in public service. As public servants, we get into this line of work to strengthen the community in which we live. And we do that by working together. This accident involved one employee, not all of our employees. I value the work of our employees—performed day in and day out—to manage and treat wastewater, provide drainage solutions and protect residents from flooding. Providing safe, clean waterways for Louisville is our mission and I appreciate their partnership in rising to meet that challenge for the community.

Detective Mengedoht will be dearly missed.

MARYLAND: Queen Anne’s County Sheriff reports Repeat DWI Driver Gregory Jensen charged with DUI; A Hair Lash Away from Being a Killer While Crossing Centerline

STEVENSVILLE, MD. – TOO MUCH FIREWATER – This motorist, who identifies as “Indian” as his race with the MVA, didn’t learn from his first time at bat for DUI, he apparently continues to drive while impaired and was caught again. Sheriff Gary Hofmann reports that on Feb. 1, 2019, Deputy Benjamin Williams responded to the Route 8 near Bay City Drive, Stevensville, Md., for a report of a possible driver under the influence. While in the area, Deputy Williams observed a vehicle crossing the centerline towards oncoming traffic.

Deputy Williams conducted a traffic stop and made contact with the driver and identified him as Gregory Jensen, 55, of 213 Beachside Drive, Stevensville, Md.. While speaking with Jensen, Deputy Williams detected an odor of alcohol coming from Jensen’s breath. Jensen also had slurred speech and difficulty standing. Based on his investigation and his observations, Deputy Williams placed Jensen under arrest for driving under the influence. Jensen was later released to a sober party. Jensen will be showing up in Queen Anne’s County District Court on April 4, to explain to a Judge why he was crossing the centerline and endangering the lives of others.

Jensen was arrested for DWI by Maryland Transportation Authority Officer M. Walter on Oct. 26, 2015. In a plea deal in Queen Anne’s District Court on Feb. 1, 2016, Queen Anne’s County States Attorney Lance Richardson, Jensen entered a guilty plea to DWI. THE DEAL: In return for pleading guilty, Jensen was given a verdict of Probation Before Judgement and was given ZERO days in jail and a $500 fine. Richardson cut the fine in half to $250 in the deal arranged for Jensen by his attorney, David W. Fischer, of Glen Burnie, Md.

HANG DOWN YOUR HEAD DAVID DULEY!
Boozing DUI Driver David Duley Took Power Nap while parked in middle of highway

STEVENSVILLE, MD. – When the need to snooze arrives, it cannot be denied. Police say that on Jan. 25, 2019 at 11:54 am, Deputy First Class Alex Cooper responded to the 200 block of Baltimore Road, in Stevensville, Md., in reference to a suspicious vehicle. What was suspicious? It was in the middle of day and some character was passed out behind the wheel as the pickup was stopped with the motor running in the middle of the road.

Police say that DFC Cooper observed a white 2012 Ford F-250 in the roadway which was running with the driver sprawled unconscious in the driver’s seat. While attempting to wake the driver, identified as David Duley, 53, of 109 Birch Road, Stevensville, Md., DFC Cooper detected an odor of alcohol coming from the vehicle and conducted standardized field sobriety tests on Duley.

Based on the test results, Duley was placed under arrest and charged with driving under the influence of alcohol.  Duley has a court date of March 28, 2019 in Queen Anne’s District Court and attorney William A. Stavros of Towson, Md., is listed on court records as his mouthpiece to somehow find a way to get him off of the DWI and six other traffic charges.

Pot and Booze Go Together Like a Horse and Carriage for Michael Bratcher; Warming Up for Drunk Pickup Driver Rodeo Olympics

CENTERVILLE, MD.  While in the area of Rt. 18, and Hibernia Road, in Centreville, Md., Queen Anne’s County Sheriff Deputy J. Bradley observed a red 2009 Chevy pick-up truck parked sideways in the middle of the roadway.

Police say that Deputy James Bradley conducted a traffic stop and made contact with the driver, identified as Michael Aaron Bratcher, 54, of 140 Scottown Road, Queenstown, Md.

While speaking with Bratcher, police say that Deputy Bradley detected an odor of alcohol coming from Bratcher’s breath, a delicate aroma different from the garlic and spicy mustard which may have been left over from the previous day’s dinner.

A Strong Whiff of Weed

Deputy Bradley also detected an odor of marijuana coming from the vehicle. A probable cause search of the vehicle was conducted. Alcoholic beverages and marijuana were located in the vehicle. During his investigation, Deputy Bradley also learned that Bratcher’s license was revoked and suspended. Bratcher was issued a civil citation for the possession of marijuana less than 10 grams. Bratcher was also arrested and charged with:

  • Driving While Impaired by Alcohol
    • Driving Under the Influence of Alcohol
    • Failure to stay right of center
    • Negligent driving
    • Driving on revoked license
    • Driving on suspended license
    • Failure to display a license
    • Driving without a license

Bratcher has a court date set for March 29, 2019 in Queen Anne’s District Court.

Bratcher hasn’t had much use for driver’s permits since losing his when he entered a guilty plea to DWI in Queen Anne’s District Court on Oct. 22, 2003. Bratcher was arrested by Queen Anne’s Sheriff Deputy Eric Goodman on June 26, 2001 as he operated a 1990 Chevy when stopped at the Kent Island Crown Gas Station on Thompson Creek Road. In a plea deal with the Queen Anne’s County States Attorney, no trial was needed. THE DEAL: Four months in jail and a fine of $350.00.

Midnight on the Highway to Heaven Express while DUI Lands Christian Keller in Slammer

GRASONVILLE, MD. – Another possible entrant into the Drunk Pickup Driver Rodeo might be the guy from Delaware that Queen Anne’s Sheriff  Sergeant  Hampton observed operating a black 2014 Dodge Ram pickup barreling along Rt. 50 eastbound at Station Lane in Grasonville, Md., on Jan. 20, 2019 at 12:24 am.

Police say that Sgt. Hampton conducted a traffic stop and made contact with the driver, identified as Christian Lee Dyche Keller, 46, of 397 Waterway Drive, Frederica, Delaware.

While speaking with Keller, Sgt. Sean Hampton reportedly detected an odor of alcohol coming from Keller’s breath and decided to conduct standardized field sobriety tests on Keller. From Delaware County Daily Times – Editorial: Getting repeat DUI offenders off our roads

“Devastatingly troubling.”

That’s how Delaware County District Attorney Katayoun Copeland described the circumstances surrounding the fatal crash that took the life of a 45-year-old Brookhaven woman in Upper Chichester Saturday night.

We could add a few others.

Senseless. And criminal.

David Matthew Strowhouer, a 30-year-old man from the Newtown Square section of Willistown Township, now faces charges in connection with the Saturday night fatal crash on Market Street in Upper Chichester Township.

Police now allege Strowhouer was under the influence of alcohol when he veered into the oncoming lane and slammed head-on into another vehicle. It would not be the first time.

In fact, this would be the sixth time Strowhouer would face charges of driving under the influence in a string of arrests in both Chester and Delaware counties.

Only this time it turned deadly. Police say Strowhouer’s SUV veered into the oncoming lane and slammed into another car. Denna Eckman was killed. Her husband Chris Eckman was seriously injured.

Police say Strowhouer was driving with a suspended license, the result of one of his previous DUI arrests.

He had done prison time on at least one of his previous DUI arrests in Delaware County, serving a one-to-five-year sentence in 2017. He was on parole at the time of Saturday night’s accident.

That will come as little comfort to the family of Eckman. That will give them something in common with the Hannagan family of Chester County, who lobbied for tougher sentences for drivers convicted of multiple DUI offenses. Their son and daughter were killed when their vehicle was struck by a drunken driver.

David Matthew Strowhouer 30, of Willistown, Chester County. Delaware County District Attorney

The truth is there is little the state or law enforcement can do if someone decides they are going to get behind the wheel. Suspending a person’s license does not prevent them from driving, regardless of whether they are impaired.

But they can’t drive from prison.

And that finally may be the way David Matthew Strowhouer is removed from the road.

That’s because state law has changed, and provides much stiffer sentences for drivers who rack up multiple DUI offenses.

The legislation, championed by former state Sen. John Rafferty, R-44 of Montgomery County, and Sen. Scott Martin, R-13 of Lancaster County, took the three-year mandatory sentence for a person convicted in a fatal DUI accident from three years to five years. A person with multiple DUI offenses, as Strowhouer does, would face up to seven years in prison. MORE

Chester County man faces sixth DUI – as well as homicide charge – for fatal crash in Delco

FROM THE PHILLYVOICE.COM – Chester County man faces multiple criminal charges in the aftermath of a fatal hit-and-run crash last weekend in Upper Chichester, Delaware County, prosecutors said.

The defendant, 30-year-old David Strowhouer, of Willistown, Chester County, allegedly was drunk at the time of the crash on Feb. 16. Strowhouer has five prior DUI convictions.

Police responded to the crash around 9:20 p.m. in the 3300 block of Market Street, where they found a Subaru WRX with a male and unresponsive female passenger trapped inside. A Dodge Ram pickup truck with severe damage was also found at the scene.

Investigators say they determined that Strowhouer, allegedly driving the pickup, crossed over the double yellow line and struck the Subaru. He then allegedly fled on foot.

Strowhouer had attended his mother’s funeral earlier that day and allegedly had been drinking alcohol, police said. When he returned to the crash scene, he allegedly told police that his cousin from Puerto Rico had been driving the car and that the two men were on the way to buy cocaine at the time of the crash.

Authorities say they believe that Strowhouer was lying about his cousin driving the pickup truck.

The male passenger in the Subaru survived the crash and was hospitalized with serious injuries. His wife died of her injuries, police said.

“I find this case to be devastatingly troubling,” District Attorney Katayoun Copeland said. “On a day where the defendant should have been with his family mourning the passing of his mother, he instead brought tragedy to another family.” MORE

JESUS saved everyone on this bus being operated by drunk driver Wilton B Carr, 82, of Gary, Indiana on their way home from Chicago on Indiana Toll Rd. Feb. 25, 2019

JESUS DOES SAVE! And forty-seven people are thankful that he brought them home safely, no thanks to their drunk bus driver!

Impaired Church Bus Driver Hits Embankment Injuring Numerous People

Lake County– The Indiana State Police report that the driver of a church bus drove up and onto an earth embankment on the Indiana Toll Road causing passengers on the bus to be injured when tossed/thrown from their seats.

Preliminary investigation by Trooper Kenneth Payonk revealed at approximately 10:37 P.M., Monday, February 25th, 2019, a 1998 Motor Coach Industries bus, owned by Jesus Saves Missionary  Baptist Church in Gary, and driven by Wilton B. Carr, 82 of Gary, was east bound in the right lane on I-80/90 (Indiana Toll Road) at the 9.6 mile marker (this is just before the Cline Avenue exit) when he drove straight off the roadway into the gore area that separates the mainline road from the exit (gore is grass/dirt/rocky filled area between two guard rails). When the bus drove into that area the underbelly of the bus hit a gravel/dirt embankment which caused the front tires of the bus to be completely off the ground.  The impact caused people inside the bus to be tossed and thrown from some of their seats.

Jesus Saves Bus Ministry crashed on I-80 Indiana Toll Road injuring five people piloted by 82-year-old Wilton B. Carr of Gary, Indiana jailed on OWI charge.

The bus was returning from a trip to the United Center in Chicago and was loaded with approximately forty seven (47) people (adults and children).  Everyone at the scene was checked out for complaint of pain, five (5) people (one adult, age 49 and four children-ages ranging from 10-14) were taken to local hospitals for leg injuries and head/neck pain.

Further investigation revealed that Carr was driving impaired and was taken to a local hospital for a certified test to which he failed.  Carr was arrested and taken to Lake County Jail in Crown Point.

Carr was charged with:

  • Operating While Intoxicated (OWI) causing Bodily Injury –level 6 Felony
  • OWI with passengers under 18 years of age-Level 6 Felony
  • OWI- Class C Misdemeanor
  • OWI Endangerment- Class A Misdemeanor

TROOPERS ON TRAFFIC STOP HIT WHEN RECKLESS DRIVER FAILED TO SLOW, LOST CONTROL AND IMPACTED ANOTHER CAR WHICH WAS PROPELLED INTO STOPPED POLICE CAR

Rockingham County — Virginia State Police report that two troopers struck during a multi-vehicle crash in Rockingham County, March 1, 2019, continue to recover from their injuries.

At approximately 2:35 p.m. Friday (March 1), Virginia State Police initiated a traffic stop on a vehicle traveling north on Interstate 81 in Rockingham County. The vehicle stopped on the right shoulder at the 253 mile marker. The violation was for speeding and suspected impaired driver.

DWI HIT PARADE Copyright 2019

During the course of the traffic stop, a 2005 Saturn traveling north on I-81 in the left lane lost control and spun around in the travel lanes. A northbound 2001 Honda Accord, trying to avoid the Saturn, ran off the right side of the highway and struck the state trooper’s car and the other vehicle stopped on the shoulder.

The crash also resulted in two of the Virginia State Police troopers involved in the initial traffic stop to be injured. Trooper G.E. Peele was transported to Rockingham Memorial Hospital and then on to UVA Medical Center where he is still being treated for serious, but non-life threatening, injuries. Sgt. S.D. McCurry was later transported to Rockingham Memorial Hospital for treatment of minor injuries.

The driver of the Saturn, Nicole T. Rudzik, 26, of Harrisonburg, Va., was not injured in the crash. Rudzik was charged with Reckless Driving.

The driver of the Honda, Patrick A. Fruchterman, 21, of Annandale, Va. was not injured in the crash.

The driver of the vehicle originally stopped on I-81 by state police was not injured in the crash. William D. Blackwell, 45, of Timberville, Va., was charged with speeding and arrested for DUI.

Maybe this cupcake was ‘Bewitched” by Moll Dyer

LEONARDTOWN, MD. – It was a tough day for a driver who while allegedly engaged in the use of drugs while piloting his 2008 Chevy on Rt. 5 south of Leonardtown, when failed to stay on the roadway right about the spot where the legendary Moll Dyer once lived and was said to be involved in witchcraft.

Joseph Alexander Hall, age 23 of Chaptico, Md. This cupcake was charged with DUI after a crash by St. Mary’s Sheriff Deputy Matt McCuen.

St. Mary’s Sheriff Tim Cameron reports that on Feb. 20, 2019, at about 10:30 in the morning, DFC. Matthew McCuen responded to the 23500 block of Point Lookout Road in Leonardtown, for the reported single vehicle accident.  DFC. McCuen arrived on scene and observed the vehicle in a ditch; contact was made with the vehicle operator Joseph Alexander Hall, 23, of 23758 Hurry Road, Chaptico, Md.  It was determined by police that Hall was operating the vehicle while impaired by CDS; Hall was arrested and charged with Driving Vehicle While Impaired by a Controlled Dangerous Substance.  About a dozen other traffic charges are pending for his trial on April 17, 2019.

  • Hall has a pending criminal trial to answer a charge of theft in St. Mary’s District Court on March 5, 2019 following his arrest by St. Mary’s Deputy T. Seyfried.  Other trials have been pending for repeated citations of driving while suspended and failing to attend Driver Improvement Classes – which Maryland evidently doesn’t allow to be taken online – after all, a busy guy who can’t show up for DIP classes shouldn’t be bothered with such penny-ante legal stuff. But Hall can explain to the District Court Judge his views on the matter when he bothers to show up in court.
  • On Feb. 23, 2017, Hall entered a guilty plea to driving without a permit in a plea deal with St. Mary’s States Attorney Richard Fritz. THE DEAL: A verdict of Probation Before Judgement with a 30-day suspended sentence.
  • On August 12, 2015, Hall entered a guilty plea to driving without a permit in a plea deal with States Attorney Fritz. THE DEAL: a fine of $92.50 and a ten-day suspended sentence.  On July 27, 2014, an assault charge was put on the Stet Docket following his arrest by St. Mary’s Deputy Mike Phelan.

Mystery Heroin arrest not mentioned by Sheriff when Mark Braaten was busted for DUI

GREAT MILLS, MD. – In an unusual press release about a DUI arrest, there was no photo of the suspect and no mention of the drug arrest of the suspect found with heroin in Lexington Park, Md. Photos were provided of most of the other DUI suspects.  At a time when Sheriff Cameron serves on an opioid task force, appointed by Gov. Larry Hogan, during a national opioid crisis, it is unusual for a heroin arrest to not be reported, however, the Sheriff really has nothing to do with issuing press releases, thus the omission could be an oversight.

St. Mary’s Sheriff Tim Cameron reports that on Feb. 24, 2019, at 11:57 pm, St. Mary’s Sheriff Cpl. Reppel responded to the St. Mary’s Square Shopping Center in Great Mills, for the reported vehicle operating behind a closed business.  Contact was made with the vehicle operator, Mark Philip Braaten, 53, of Scotland, Md. Police say that Braaten was operating the vehicle under the influence of alcohol.  According to Maryland real estate records, Braaten lives at a home owned by a contracting officer attached to the Naval Air Systems Command at the Naval Air Station at Pax River, Md. The home is listed as the principal residence of that person.

Braaten was charged by Deputy M. Boyer with possession of heroin and paraphernalia. He was charged by Cpl. Reppel with Driving Vehicle While Impaired by Alcohol, Driving Vehicle While Under the Influence of Alcohol, and Driving Vehicle While Under the Influence of Alcohol Per Se.  A trial date for the drug charge has been set for April 19, 2019.

LEONARDTOWN, MD.
