MANASSAS, VA. — Prince William County Police report the arrest of Curtis Andrew Amon for DWI on June 10, 2017, a fourth such arrest within ten years. With his driver’s permit revoked for earlier arrests, including being arrested for DWI while being ordered to use an ignition interlock, Amon was performing key aircraft airframe and engine work and inspections for various Northern Virginia charter aircraft firms.

According to his Facebook page, Amon has been working at a charter aircraft firm based in Manassas, Va., which charters small jets and twin-engine aircraft.
According to Virginia Court records in Prince William County, Curtis Andrew Amon, of Oakton, Va., was charged in Fairfax County General District Court with DWI 1st. on Nov. 14, 2010. On Jan. 25, 2011, Amon was found guilty. He was sentenced to 30 days in jail and his driver’s license was suspended for one year with the restriction period to terminate on Jan. 24, 2012. License Is Restricted To Use To And From Work, License Is Restricted To Use To And From ASAP Meetings, License Is Restricted To Use For Medically Necessary Travel , Transport Minor Child , Court Ordered Visitation , To And From Court Ordered Facility. Court records show he was fined $300 with courts costs of $182.00.
Amon was charged with DWI 2nd offense within five years, with a blood alcohol reading over .20% on Oct. 4, 2011 – while his driver’s license was suspended for the earlier DWI. On April 30, 2012, Amon was found guilty in Fairfax County District Court and was sentenced to 90 days in jail and given unsupervised probation. Seventy-five days of the jail sentence was suspended. Amon’s driver’s permit was suspended for three years with restrictions that allowed him to drive for medical appointments, to and from court ordered facilities, to and from work and all the time with ignition interlock. The restriction end date was set for April 29, 2015. A fine of $500 was ordered as part of the plea deal.
According to Amon’s LinkedIn profile, he asserts in his resume that he is an FAA licensed airframe and power plant mechanic, at the same time that the Commonwealth of Virginia restricted his ability to drive motor vehicles on Virginia highways. The FAA also lists him as an licensed mechanic.

THE FAA AND ALCOHOL
The following guidelines were issued by the FAA in regard to Pilots. While it may be logical to figure that aircraft mechanics are just as important to aircraft safety, the FAA rules apply to pilots only in regard to alcohol.
Hard Facts and Erratic Effects
Alcohol is a sedative, hypnotic, and an addicting drug that quickly impairs judgment and leads to behavior that can easily contribute to, or cause, accidents. Its toxic effects, which vary considerably from person to person, are influenced by gender, body weight, rate of consumption (time), and total amount consumed. Consider these facts:
Alcohol and Aviation
The majority of adverse effects produced by alcohol relate to the brain, eyes, and inner ear— three crucial organs to a pilot.
Pilots have shown impairment in their ability to perform even routine VFR flight tasks while under the influence of alcohol, regardless of individual flying experience. The number of serious errors dramatically increases as your blood alcohol level goes up. Some studies have shown diminished pilot performance with blood alcohol concentrations as low as 0.025 percent. If other variables (e.g., sleep deprivation, fatigue, medication use, altitude hypoxia, or flying at night or in bad weather) are present, the negative effects are significantly magnified.
Regulations and Recommendations
The use of alcohol and drugs by pilots is regulated by Title 14 Code of Federal Regulations section 91.17: No person may operate or attempt to operate an aircraft within eight hours of having consumed alcohol, while under the influence of alcohol, or with a blood alcohol content of 0.04 percent or greater. A more conservative approach is to wait 24 hours from the last use of alcohol before flying.
This is especially true if intoxication occurred or if you plan to fly IFR. Also, consider the effects of a hangover. Eight hours from “bottle to throttle” does not mean you are in the best physical condition to fly or that your blood alcohol concentration is below the legal limits. Time is the only real solution and, ideally, every pilot should strive for total avoidance of alcohol in planning or accomplishing a flight. Lives are at risk if you drink and fly.

Winnetka, Calif. — According to the Los Angeles Police Valley Traffic Division on Thursday, July 13, 2017, at approximately 2:05 a.m., Jose Miguel Mejia, 28, a resident of Northridge, was driving a black 2016 Dodge Challenger Eastbound on Roscoe Boulevard.
Police say that the Challenger collided with a 2001 Subaru Impreza traveling eastbound in the number one lane and a 2013 Ford Escape traveling eastbound in the number two lane just west of Irondale Avenue. The impact caused the Subaru to spin out of control and it came to a stop in the opposing traffic lanes. The Ford Escape was forced into an easterly direction out of control as it collided with the curb, a street sign, a tree, and a power pole.
The Ford Escape was being driven by a sole female occupant who was pronounced dead at the scene as a result of the traffic collision. She was Rosario Chavez, 42, of Northridge, said Lt. Larry Dietz of the coroner’s office.
The Subaru was being driven by a sole male occupant, 27 years old, a resident of Northridge. He sustained minor injuries. The driver of the Dodge Challenger, Mejia remains hospitalized with severe injuries and was ultimately arrested for the crime of 187(a)PC 2nd Degree Murder. Mejia had two male passengers in his vehicle at the time of the collision; one passenger is listed in critical condition and the other is in serious condition. They are both being treated at a local hospital.

John Giumarra III charged with killing Angela Holder while DUI and hit and run Jan 16, 2017 felony hit and run
BAKERSFIELD, CALIF. — Kern County District Attorney Lisa S. Green announced the filing of two charges against John George Giumarra Ill. Giumarra, 48, was charged with one felony count of hit and run (Vehicle Code section 20001) arising out of a collision where a death occurred. He was charged with one misdemeanor count of driving while impaired (Vehicle Code section 23152) with a prior misdemeanor conviction for driving while impaired. The criminal case originated from a collision that took place on January 16, 2017, on Golden State Avenue near the intersection with F Street. Angela Holder, 32, was killed in the collision.
The Bakersfield Police Department requested felony DUI charges and the felony hit and run charge. District Attorney Green explained why the felony DUI charge was not filed: “The law is absolutely clear that an individual must commit an independently unlawful act other than driving impaired, and that act must be the cause of death.
Giumarra did not commit any separate act that caused Ms. Holder’s death, therefore there was insufficient evidence to support the filing of a felony driving while impaired. A felony hit and run causing death have no similar independent unlawful act requirement, and therefore the evidence supports the filing of the hit and run.”
If convicted, Giumarra faces a maximum sentence of four years in state prison.

John Giumarra III, a member of the prominent Bakersfield farming family that runs Giumarra Vineyards Corporation, pleaded not guilty Monday to hit-and-run and DUI charges stemming from a crash in January that killed a bicyclist.
Giumarra, 48, agreed to waive time so his preliminary hearing could be scheduled for Aug. 17 instead of within 10 days. He also signed a Watson advisal acknowledging he’s been told if he drinks and drives and someone dies, as a result, he could be charged with murder.
Attorney Jeremy Brehmer said Giumarra would post bond after the hearing.
Police said Giumarra was driving in the 1600 block of Golden State Avenue when he collided with a bicyclist around 9:30 p.m. Jan. 16.
He left the scene, according to police, and was found at a Mobil station on F Street, where officers determined he was under the influence.
The bicyclist, Angela Holder, 32, died the next day at Kern Medical Center. MORE

Washington State Patrol Detectives Seek Witnesses in Crash of DUI Driver Kyle Warren Kay into SUV on Northbound I-5
King County: At approximately 11:29 pm on July 2, 2017, Washington State Patrol troopers responded to a three car injury collision NB I-5 near S. 375th.
A white Jeep SUV was traveling NB I-5 when it struck a silver Ford Focus in the left rear and subsequently struck a maroon SUV. The maroon SUV lost control due to this collision and struck the jersey barrier causing the driver to sustain multiple rib fractures. The Jeep ended up stopping about one mile north of the scene.
Further investigation led troopers to believe that the driver of the Jeep was impaired by drugs or alcohol and was placed into custody for investigation of Felony Vehicular Assault due to the nature of the injuries to the other driver. The driver of the Jeep was 25-year-old Kyle Warren Kay from Seattle. A blood search warrant was obtained and served after which Kay was booked into the King County Jail.

Sixth Precinct Patrol officers arrested and charged Duncan, 56, of Coram, New York, with Aggravated Driving While Intoxicated with a Child Passenger 15 Years or Younger (Leandra’s Law), Driving While Intoxicated and Endangering the Welfare of a Child. Duncan will be held overnight at the Fourth Precinct and will be arraigned at First District Court in Central Islip on July 19.

A DUI investigation was conducted on scene and the driver of Vehicle 1 was found to be under the influence of alcohol and/or drugs. The driver of Vehicle 1 was placed under arrest for DUI Manslaughter and transported to the Cape Coral Police Department where he was booked (and later transported to the Lee County Jail).
The next-of-kin HAS BEEN contacted. This traffic crash IS alcohol/drug related. It was determined that the driver of Vehicle 2 was NOT wearing a helmet at the time of the traffic crash. Due to the investigation, the West lanes of SW Pine Island Road were shut down for several hours.

SAN DIEGO (KGTV) – Emotions overflowed during a preliminary hearing for a deadly crash Tuesday.
Alexandria Bayne turned her face toward the wall, hiding her emotion as her estranged husband testified about her actions as a mother.
She’s charged with murder in the wake of a wrong-way, head-on crash last December that killed Sarita Shakya, a nurse at Scripps Hospital and mother of a four-year-old daughter.
The prosecutor said Bayne’s blood alcohol level was between .31 and .34–about four times the legal limit.
She has two prior DUIs but her driver’s license was valid at the time of that crash in 4S Ranch.
California Highway Patrol investigator James McBreaty said he interviewed Bayne’s teenaged daughter about her mother’s drinking.
She recalled a moment earlier that day when her younger brothers were arguing and she went looking for mom.

PANAMA CITY — A motorcyclist jailed on charges he was driving intoxicated when he killed his passenger told officers he had been consuming alcohol and narcotics before the crash, according to arrest reports.
James David Watson, 57, appeared in court Tuesday to set a bond on a charge of DUI manslaughter. He was arrested after the 4:15 a.m. crash Monday resulted in the death of his passenger, 39-year-old Candi Michelle Bailey. The crash occurred near the Casa Loma Motel, 13615 Front Beach Road.
Watson was given a $25,000 bond and still is being held at the Bay County Jail, court records stated. Judge Thomas Welch struggled with determining a bond for Watson, saying he was weighing his relationship to the victim against the possibility he could be a danger to the public.
Watson, of Dothan, Alabama, did not comment during the first appearance, where he appeared in a wheelchair with a sling around his arm. Several of his family members attended in support of Watson’s release, and a woman identifying herself as his mother pleaded with Welch for a low bond out of medical concerns. MORE

07/28/2017 — A man is facing felony charges after a passenger in his SUV was killed in a rollover crash late Sunday in the Southwest Side Archer Heights neighborhood.
David A. Arocho, 24, was driving a 1996 GMC Carryall about 11:30 p.m. in the 4800 block of South Avers when he rear-ended a 2003 Jeep SUV that was stopped in traffic, according to Chicago Police. The GMC flipped over when it hit the Jeep.
Arocho’s passenger, 26-year-old Jessica Kall, was pronounced dead at the scene after she possibly fell out of the SUV, according to police and the Cook County medical examiner’s office. She lived in the Southwest Side Garfield Ridge neighborhood.
An autopsy Tuesday found she died of multiple blunt force injuries from the crash, according to the medical examiner’s office. Her death was ruled an accident. MORE

Maryland State Police report that on Friday, July 28, 2017, at approximately 2307 hours, troopers from the Maryland State Police Frederick Barrack responded to a fatal motor collision at Taneytown Pike east of Simmons Rd.
Police say that their preliminary investigation revealed Vehicle 1, a 2015 Chrysler 200 was traveling eastbound on Taneytown Pike in the 11000 block. The operator, Yvonne Loree Avaritt, lost control of Vehicle #1 which began to spin. Vehicle #1 exited the roadway on the westbound side. The passenger side of Vehicle #1 struck a standing tree. There also was a passenger, Louis Stephen Romanell, in Vehicle #1.
Initial investigation revealed that neither Avaritt nor Romanell were wearing their seatbelt.
Police say that Avaritt is suspected to have been under the influence of alcohol. Avaritt was transported to Sinai Hospital by ground for treatment. Romanell was pronounced deceased on scene.

On July 27, 2017, at approximately 10:14 pm, a fatal pedestrian collision occurred at the intersection of West Charleston Boulevard and South Scholl drive. Evidence at the scene and witness statements indicated a pedestrian was walking north across Charleston Boulevard at the intersection with Scholl Drive when she was impacted by an eastbound Ford pickup. The pedestrian was knocked to the roadway and slid to a stop. The Ford continued east and left the collision scene. The operator of the Ford did not stop to render aid or call the police.
Emergency Medical Services arrived at the collision scene and the pedestrian was pronounced dead. The operator of the Ford returned to the collision scene with the vehicle approximately two hours after the incident occurred. He was arrested for hit and run and for suspicion of driving under the influence of drugs.
This was the 81st traffic related fatality in LVMPD’s jurisdiction for 2017. This collision remains under investigation by the LVMPD Collision Investigation Section.

According to the S.C. Highway Patrol, Collier was driving the motorcycle west on Edwards Road when he lost control, ran off the right side of the road and hit a ditch.
A passenger, who was not wearing a helmet, was thrown from the bike and died at the scene.
The Greenville County Coroner’s Office identified the passenger as Sandy Lynn Shook, 40, of Pelzer.
Sandy Lynn Shook, 40 died on Saturday, July 22, 2017. A native of New London, Ohio, Mrs. Shook was the daughter of Debra O’Connor and the late Fred David Sayers.
Mrs. Shook was the manager of Tony’s pizza and enjoyed shooting pool and riding motorcycles.
Leaving behind with memories to cherish are two sons, William Dean (Cotton) Shook III and Benjamin Shook; a daughter, Katelynn Marie Shook; a brother, Christopher Sayers; a step brother, Clint Johnson; a step sister, Tera Johnson Terry; and step-fathers, Michael Hedderly and Terry Johnson.

Johnny Mendoza sentenced to 15 years in prison for DUI Manslaughter Tulare County Calif. July 27, 2017
On July 21, 2017, in Department 17 of Tulare County Superior Court, South County Justice
Center, Judge Michael Sheltzer sentenced Johnny Mendoza, 27, of Visalia, to 15 years in state prison for DUI manslaughter.
On May 26, 2017, Mendoza pleaded no contest to one count of gross vehicular manslaughter while intoxicated with a special allegation of causing injury to more than one person and one count of DUI causing injury with a prior DUI conviction, with three special allegations of causing great bodily injury. Mendoza possesses a prior misdemeanor DUI conviction from 2014 in which his BAC was .23%. Mendoza was on probation for that case when this crash occurred.
He also failed to attend mandated DUI classes and had not installed an ignition interlock device that had been instructed by the Court.
At approximately 3:30 pm on June 12, 2016, the 42-year-old female victim was driving
westbound on Highway 65 near Spruce Avenue with 5 passengers. The victim and her 13-year old daughter were talking and laughing when they saw Mendoza heading towards them in their lane of travel.
The victim attempted to swerve her van out of the way but Mendoza crashed into them head on.
The driver died shortly after the collision, her 13-year-old daughter sustained a broken arm, her 6-year-old son suffered a severe head laceration, and a 22-year-old passenger sustained a broken neck.

ANADARKO, Okla. – An Anadarko city councilman is caught on tape bargaining with officers to get out of a DUI charge.
Jeffrey Jason or “J.J.” Vance was arrested early Wednesday morning.
It started with a routine traffic stop after an officer saw him swerving in his pickup truck, then run a red light.
“Just prior to him failing to stop at the red light, another vehicle had gone through the light while it was yellow,” said Anadarko Police Chief Tracy Roles. “Mr. Vance was well behind that vehicle.”
Vance admitted to the officer he had been drinking, but before the officer could walk back to his vehicle, body camera footage shows Vance mentioned one more thing.
“City council,” said Vance.
“What?” said the officer.
“City council.”
“What about city council?” asked the officer.
“Nothing,” said Vance. “I’m on city council.”
“Ok,” said the officer. “Ok, sit tight.”
The police ignored the comment and they conducted a field sobriety test on Vance. According to the report, officers could smell alcohol on his breath and he was unsteady on his feet.
After failing the field test, they arrested him and brought him back to the station.
Vance blew a .18 on a breathalyzer test, which is above the limit to earn a DUI charge.
But while waiting in the station, he elaborated on what he started on in his truck.
“All I can tell you all is you all just be as nice as you can to me,” Vance can be heard saying on the body camera footage, “because I am on the city council.”
He didn’t stop there, offering to pay a $700 or $800 fine, even bargaining his vehicle.
“Or, or better than that, you can even repo my car so you can make more,” Vance said.
He even made promises based on his position as a councilman.
“If you all can just fine me and let me go home, I will f****** raise all kinds of money for your a**,” Vance said. “I’ve been raising all kinds of money from the police department, forthe police department. For the dogs. I f****** raised like $1,000 for the f****** dogs. I’m not bulls********, I did do that.”
The officers deflected his pleas, saying “we don’t make deals” and “that’s not how it works,” or just ignored him.
“If you’re a city council member, or another elected official, or a member of some sort of other city or governmental agency, that does not make you above the law,” said Roles.
Anadarko Mayor Kyle Eastwood declined to go on camera for the story, but he said in a statement over the phone, “If the allegations are accurate, I would find that to be inappropriate for an elected official. But Mr. Vance is accountable to his constituents, and matters like this should be resolved at the ballot box.”
Mayor Eastwood sent the following longer statement later:
“As I said over the phone, if the allegations against Mr. Vance are true, the judicial process should be allowed to play out and the appropriate punishment determined by a jury. The matter is under investigation by local law enforcement in conjunction with the District Attorney’s Office. I have great confidence in our law enforcement officials and district attorney staff to conduct a fair investigation into the matter.
As to the political implications for Mr. Vance as a public official, it is behavior I do not condone and is unbecoming an elected official in the City of Anadarko. However, I am without authority to address his position on the City Council. That authority rests with the voters at the ballot box.
With regard to the body cam video you mentioned, I have not seen that video and cannot comment directly on what it shows. However, if it shows Mr. Vance making inappropriate comments or requests to law enforcement, I would expect that evidence to be turned over to the district attorney for review and the appropriate prosecution.”

Milford, Del. – Delaware State Police Master Corporal Gary Fournier reports that a motor vehicle duel between two drivers ended with both of them being charged with their third offense DUI after one of them crashed into the other early in the evening on July 30, 2017.
The incident occurred around 9:08 p.m. Sunday, July 30, 2017, as Carlell Smith, 34 of Lincoln, was operating a 2009 Chrysler Town and Country minivan westbound on Benson Road approaching a stop sign with Cedar Creek Road (SR30). Smith failed to remain stopped at the stop sign and pulled into the intersection, striking a 1994 Chevrolet Astro Van being operated by Michael J. Flood, 52 of Ocean View.
Both operators were removed from the scene and transported to Bayhealth Milford Memorial Hospital for non-life-threatening injuries. While there, a DUI investigation ensued with Carlell Smith. He was charged with Third Offense Driving Under the Influence of Alcohol (two previous: 05/19/2008 and 12/16/2015), Vehicular Assault 1st, Reckless Endangering 2nd, Driving While Suspended or Revoked, No Proof of Insurance, and Failure to Remain Stopped at a Stop Sign. He was arraigned at JP2 and committed to Sussex Correctional Institution on $6,502.00 secured bond.

ANACORTES, WASH. — The Washington State Patrol reports that a repeat offender DUI driver struck and injured a pedestrian after crossing the center line of Rosario Road south of Anacortes, Washington and fled the scene.
Trooper A. Kinkade reports that Faris M. Diemert, 23, of Anacortes was operating a 1998 Lexus GS400 when he hit a 16-year-old juvenile who was westbound with a bicycle on Rosario near Sharpe Road, about a half-mile from Anacortes at 11:51 pm on Aug. 4, 2017. Police say that Diemert fled the scene and was captured and jailed on DUI vehicular assault charges as well as violation of ignition interlock requirements, hit and run and driving while license is revoked.
Diemert was booked into the Skagit County Jail and held without bond.
The injured teenager was airlifted to Harborview Medical Center.
