Sussex County Council Candidate Mark Schaeffer is now speaking out about his arrest for DUI last week….sort of.

Schaeffer initially told Delaware 105-9’s Dan Gaffney that he took responsibility for his arrest and apologized for his arrest. But it wasn’t clear at the time what he was apologizing for…..exactly. Today (Friday), Schaeffer told Gaffney:

“I take responsibility for being out in 100-degree weather for six hours and ended up being dehydrated and exhausted and getting behind the wheel and driving. We confirm our innocence.”

Gaffney point blank asked Schaeffer if alcohol was involved; if he was drinking at all:

“My attorney Eric Mooney has asked me not to discuss that; I maintain my innocence and I take full responsibility. I own it; it’ll never happen again. I’ll never put myself in that position or anyone else.”

Lewes Police say they stopped Schaeffer around 11 p.m. on Monday, August 15 and charged with driving under the influence.

Schaeffer claims he had been out all day in the heat knocking on doors and checking on campaign signs.

Schaeffer is one of four Republicans in a primary race for the 3rd District in Sussex County.

DUI/Driver’s License checkpoint Planned The San Diego County Sheriff’s Department is well aware of the community’s concern for persons Driving Under the Influence of Alcohol and/or Drugs. The San Diego County Sheriff’s Department is taking a major countermeasure by implementing a DUI/Driver’s License Checkpoint. The primary intent of this checkpoint is to educate the public of the dangers associated with drinking and driving. Additionally, this checkpoint will serve as a deterrent to potentially impaired drivers. Finally, this checkpoint provides an important governmental service by promoting public safety.

The focus of the operation will be the apprehension of suspects who are determined to operate a motor vehicle while intoxicated and/or under the influence of drugs or alcohol. We will also be checking for drivers who are driving while unlicensed or suspended. On Saturday, August 27, 2016, from 7:30 p.m., to Sunday, August 28, 2016 at 2:30 a.m., deputies from the San Diego County Sheriff’s Department‘s Vista Station will be conducting a Sobriety and Driver’s License checkpoint in the city of Vista. The checkpoint will consist of D.U.I and Drug Recognition Expert (D.R.E) trained deputies who will be evaluating drivers’ abilities to safely operate motor vehicles if they are under the influence of alcohol or drugs.

As part of the checkpoint, all drivers passing through the checkpoint will be checked to make sure they have a valid driver’s license.

CHARLOTTE HALL, MD.  What used to work a little bit doesn’t’ work at all anymore, but the Maryland State Police haven’t yet adjusted to the tech times of today. While the party hardy crowd who insist on driving drunk on public highways all have smart phones with apps to alert them to sobriety checkpoints, the cops, who also have smartphones, but apparently aren’t that smart, are still employing tactics developed before the internet was invented.

The result?

The Maryland State Police put on a sobriety checkpoint and didn’t net one single DUI arrest.

The Leonardtown Barrack of the Maryland State Police report the following:

On Saturday, August 27, 2016, from midnight until 2:14 am, The Maryland State Police- Leonardtown Barrack hosted a sobriety checkpoint, which is intended to detect and deter motorists from driving under the influence of alcohol and drugs.  The operation consisted of 13 Troopers from the Maryland State Police- Leonardtown Barrack and two (2) St. Mary’s County Sheriff Deputies.  The checkpoint was conducted on MD Rt. Five south of Mohawk Drive, Charlotte Hall, St. Mary’s County. The checkpoint focused on the Charlotte Hall area since it has been identified as a high occurrence area of DUI arrests and DUI related collisions.

During this operation, a total of 450 vehicles passed through the checkpoint.  Of the 450 vehicles, six (6) drivers were pulled to the testing area for sobriety testing and one probable cause search was conducted.

Additionally, twelve (12) vehicles were stopped for traffic violations in the Charlotte Hall area away from the checkpoint location.  Of those 12 vehicles, five (5) operators were placed through sobriety testing and one probable cause search was also conducted.

As a result of this operation, one subject was issued a civil citation for possessing marijuana less than 10 grams.

What works?

Saturation patrols.  With the number of officers used in the above effort, as many as a dozen DUI arrests could have been accomplished.

While some Apps have been deleted from various venues, Mr. Checkpoint is still available for Android devices and others are available on iTunes.  Customer reviews of Mr. Checkpoint show it is likely a much better deal to call Uber for a trip home than take a $10,000 walk down Drunk Driving Lane with a pricey attorney.

U have helped me a lot even though I don’t drive, lol is really helpful cause I let my honey and family know about the checkpoints.

Some law enforcement agencies point to the positive reaction from the public about the checkpoints and strong public support for them to continue while acknowledging that saturation patrols are the only effective way to remove impaired drivers from public roadways.

The booze droids, as shown above, believe they have the right to maim and kill and they don’t care who gets in their way.  Of course, for them to simply slam into an oak tree when driving by themselves without anyone else being involved, is Darwin’s theory at work, and the sooner they exit life, the better for everyone else.

HUNTINGTOWN — A teen was killed by his buddy in a late night booze cruise on June 30, 2007, wrapping up a Saturday night of fun and turning it into yet another time of tragedy and unbelievable sadness for the dead teen’s family.  Dead was Kevin Stavely, 17, of Sunderland.

Calvert Sheriff’s officers report that on June 30, 2007, at 11:03 p.m. DFC Christopher Childress, other members of the Calvert County Sheriff’s Office and members of the Maryland State Police Prince Frederick Barrack responded to the scene of a motor vehicle crash at Walnut Creek Road and Shelley’s Crossing in Huntingtown.

Upon arrival responding officers determined that it appears speed was a factor when a 2000 Subaru was traveling westbound on Walnut Creek Road and the driver lost control of the vehicle.  The car left the roadway and struck the edge of a driveway becoming airborne, then slid across the roadway, struck a curb and came to rest in a ditch.

The left rear passenger, who was not wearing a seatbelt, a 17-year-old male from Sunderland, was ejected out the rear windshield.  He was pronounced dead at the scene.  The driver, identified as David Maxwell Clark, 19, of 1214 Fairfax Ave., Churchton, Md. was found to be under the influence of alcohol.

He was charged with homicide by motor vehicle while under the influence in addition to ten other charges including driving under the influence and failure to reduce speed to avoid a collision.

The driver along with a third passenger in the vehicle, 19-year-old Craig M. Gleason of Dunkirk, were both wearing seatbelts and were not injured in the crash.  Clark’s bond was set at $250,000.

Gleason left the scene of the wreck, causing firefighters to search for him.

Clark entered a guilty plea to negligent manslaughter in Calvert County Circuit Court on Jan. 28, 2008,  in a plea deal with Calvert County States Attorney Laura Martin that gave him a ten year sentence in prison with all but eight and one-half years suspended, which meant that he served his time in the local jail instead of going to prison. He was also given five years of supervised probation. Five other charges including DUI were dropped in the plea deal.

Booze ended Frizzell’s Cruise When Driver Smashed into Tree

Washington State Patrol of the Marysville Barrack, reports that Tauna J. Frizzell, 34, of La Conner, Wa., was the operator of a 1996 Chevy Blazer that was totaled when it left the roadway on Colony Road, seven miles north of Burlington, Washington, and hit a tree.  Frizzell was injured and taken to Skagit Valley Hospital and her passenger, Kristen R. Stallings-Sande, 36, of Sedro was airlifted to Harborview Medical Center. The crash took place at 7:12 pm on Oct. 15, 2016, according to Trooper R. Thomas.

Charges of vehicular assault against Frizzell in the crash which police report was alcohol involved, are pending.

SCOTCH PLAINS POLICE OFFICER INDICTED FOR ELUDING IN READINGTON TOWNSHIP

Hunterdon County Prosecutor Anthony P. Kearns III, announced the indictment of Scotch Plains Police Officer Stephanie Roggina, age 26, of Flemington. On October 13, 2016, Ms. Roggina was indicted by a Hunterdon County Grand Jury for Eluding, a third-degree crime.

According to Prosecutor Kearns, “Ms. Roggina was stopped by the Readington Township Police Department on August 26, 2016, and subsequently arrested for eluding and driving while under the influence. An arraignment date will be scheduled by the court.” The filing of a criminal complaint is merely a step in the criminal justice process.

Roggina was charged with drunken driving, obstructing the passage of other vehicles, reckless driving, failing to yield to an emergency vehicle and leaving the scene of an accident.

The defendant is presumed innocent until the matter is resolved in a court of law.

PURSUIT / DWI ARREST

On Friday, August 26, 2016, at approximately 11:36 pm, police observed a black Ford Edge stopped at the stop sign on Hillcrest Road at the intersection of County Route 629. The officer watched the Ford for a lengthy period of time and when the vehicle did not move, despite there being no traffic in the area, the officer activated his emergency lights to conduct a motor vehicle stop and check on the driver.

When the officer activated his emergency lights the driver of the Ford turned west onto County Route 629 and began to accelerate away from the officer. The officer pursued the Ford with lights and siren activated with the Ford being driven off the roadway several times and in a reckless manner, once striking a guardrail on County Route 629. The officer finally stopped the Ford on Locust Road.

When the officer made contact with the driver, Stephanie Roggina, 26, of Flemington, NJ, he observed signs of intoxication. Roggina was arrested and charged with Eluding, Driving While Intoxicated, Obstructing Passage of Other Vehicles, Reckless Driving, Failure to Yield to an Emergency Vehicle, and Leaving the Scene of a Crash; she was later released and turned over to a sober adult with a pending court date.

DRUNK DRIVING ARRESTS

Readington Township Police Department reports on Friday, September 23, 2016, at 2130 hours, Corporal Rindock arrested John W. Collins, 50, from Flemington, NJ for driving while intoxicated. The officer stopped Collins for reckless driving on County Route 523 and detected the odor of an alcoholic beverage while speaking with him. Collins was arrested after failing several field sobriety tests. He was charged with DWI, reckless driving, and speeding. After being processed at headquarters, he was released to a friend pending a municipal court date.

Hit & Run Leads to Arrest

Police say that on October 8, 2016, at approximately 1928 hours, Ptl David Bodine was dispatched to the area of 202 and Pleasant Run Rd for a hit and run accident. Reports advised that a subject struck a vehicle that was traveling on County Rd 629 North. Ptl Bodine observed the vehicle while responding to the call on Rt 523. Ptl Bodine stopped the vehicle on Country Club Dr in Stanton Ridge and made contact with the driver Elizabeth Lowe (age 30) of Emmaus PA. and detected the odor of an alcoholic beverage.

Lowe was asked to step out of the vehicle and Ptl Bodine attempted to conduct field sobriety tests. Lowe refused and attempted to walk away from officers and down the sidewalk. Lowe was taken into custody at which time she attempted to pull away and twist her body to get away from the officers. Lowe was arrested for DWI, Obstruction of Justice and Resisting Arrest. Additional motor vehicle citations were given to Lowe for leaving the scene of an accident, reckless driving, driving while intoxicated, and failure to submit to breath test. Lowe was released to a sober adult and given a future court date to appear.

 

DWI – Marijuana

On Friday, August 12, 2016, at 0255 hours, Patrolman Brown stopped a suspicious vehicle that was seen leaving a boarding house on Route 22. The driver, Andres S. Villa-Cardosa, 22, from Whitehouse Station, NJ was arrested after failing to pass several field sobriety tests. He was charged with DWI and possession of an open alcoholic container. After being processed at headquarters, he was released to a friend pending municipal court.

A passenger in the vehicle, Amanda M. Veneziano, 19, from Flemington, NJ was found to be in possession of Marijuana wax. She was arrested and charged with possession of under 50 grams of Marijuana. After being processed at headquarters, she was released pending municipal court.

 

DWI Arrest

On Thursday, July 21, 2016, Jozsef Varga Jr., 35, from Lebanon, NJ was arrested during a motor vehicle stop on Mountain Road. Corporal Ayotte stopped Mr. Varga for maintenance of lamps and detected the odor of an alcoholic beverage while speaking with him. Mr. Varga was not able to complete standard field sobriety tests and was arrested for DWI. He was charged with DWI, refusal to submit to breath testing, and maintenance of lamps. After being processed at headquarters, he was released with summonses to appear in municipal court.

 

Warrant Arrest – DWI Arrest

On Tuesday, July 12, 2016, officers arrested Nicholas M. Veglatte, 31, from Whitehouse Station, NJ at his residence for two outstanding traffic warrants out of Bridgewater Township and North Plainfield Township. After posting bail at headquarters, he was released pending Municipal Court. Later in the evening, On Wednesday, July 13, 2016, at 0017 hours, officers responded to reports of a suspicious vehicle and located Veglatte driving his 2014 GMC erratically. Patrolman Wright suspected that Veglatte was under the influence of a controlled and dangerous substance and after failing to complete several sobriety tests, he was arrested for DWI. Additionally, he was charged with being under the influence of a controlled and dangerous substance and traffic summonses for DWI, reckless driving, driving while suspended, driving an unregistered vehicle, and failing to present current insurance. After processing at headquarters, he was released to a responsible third party pending a future Municipal Court date in Readington Township.

 

DWI ARREST

On Tuesday, June 28, 2016, at approximately 2324 hours, Sgt. Carlos Ferreiro stopped a vehicle for speeding on Central Ave. The vehicle was driven by Alisia Stewart (35) of Whitehouse Sta. NJ. During the motor vehicle stop the officer detected the odor of an alcoholic beverage coming from Stewart. The officer had Stewart perform Standardized Field Sobriety Test, which she failed. Stewart was arrested for DWI and later charged with speeding, DWI and refusal to submit to breath testing. Stewart was released to a sober adult pending a future court appearance.

 

Marijuana / Alcohol Arrest

October 8, 2016, Pfc Serrone was on patrol when he observed a 2014 Toyota traveling East on Pleasant Run Rd with no taillights. Pfc Serrone conducted a motor vehicle stop on the vehicle and made contact with the driver, Lindsay Berger (age18) of Hillsborough NJ and passenger Samantha Morrison (age 19) of Bridgewater NJ. During his contact with the two subjects, he observed a marijuana grinder in the console of the vehicle. A subsequent search of the vehicle revealed an open bottle of vodka and a glass marijuana pipe. Following the search, Morrison was arrested for possession of less than 50 grams of marijuana and paraphernalia. Berger was arrested for underage possession of alcohol. A third person in the vehicle of Pohatcong NJ was released with no charges.

Troopers in Mayfield arrested 26 y.o. Harold Lampkin for DWI and refusal to take a breath test. Troopers received a report of a disabled vehicle in the area of 182 N. Main Street in the Village of Broadalbin. Upon arrival, Troopers located the vehicle stopped in the middle of the roadway with the engine running and the operator- Lampkin, was sleeping at the wheel with his foot on the brake. Upon interviewing Lampkin, Troopers detected an odor of an alcoholic beverage coming from his breath. He was administered SFST’s and failed. He was placed under arrest for DWI and was transported back to New York State Police Mayfield for processing. While at SP Mayfield Lampkin refused to take the breath test and was subsequently arraigned in the Village of Broadalbin Court. He was remanded to Fulton County Jail in lieu of $1,000.00 cash and $2,500.00 bond. He is to reappear back in the Village of Broadalbin Court on 11/3/16 10:00 am.

On October 13, 2016, at approximately 9 p.m., State Police conducted a traffic stop on State Route 73 in the town of North Elba, south of River Road on a 2006 Nissan Pathfinder. The vehicle was traveling south on State Route 73 and nearly struck a patrol vehicle which was stopped on the shoulder with lights activated, conducting an unrelated investigation.

The driver, Thomas J. Clark, 73, of Lake Placid, was subsequently arrested for DWI. His blood alcohol content was determined to be .14%. Clark was charged with DWI, and additionally ticketed for failure to yield the right of way to an emergency vehicle, and unsafe speed. Clark was released on tickets to appear in the Town of North Elba Court on October 25, 2016, at 3 p.m.

New York State Police reports that on October 14, 2016, the New York State Police in Latham arrested Antwan Henry, 33, of Rensselaer for Felony DWI-Leandra’s law. Henry was stopped for speeding on State Route 910F in the Town of Guilderland. As the trooper was conducting his investigation, Henry attempted to flee but was subsequently taken into custody without further incident.

Henry was transported to SP Latham and processed for Felony DWI-Leandra’s law due to the fact he had 4 children under the age of 16 in the vehicle, as well as Resisting Arrest, Reckless Endangerment 2nd, and numerous VTL violations.

New York State Police at Machias – Man arrested for DWI

On October 5, 2016, at approximately 7:54pm, Troopers arrested Nicholas G. Boitschenko, 37, of Machias NY for Driving While Intoxicated.

Boitschenko was stopped on South St. in the Town of Yorkshire.  While interviewing Boitschenko the odor of alcoholic beverage was present.  Police say that Boitschenko was given standard field sobriety test’s in which he failed.  Boitschenko was taken to SP Machias for processing.  Boitschenko recorded a .10% BAC.

SP Amity – Woman arrested for drug charges after car crash

New York State Police reports that on September 25,  2o16, at 10:47pm, Troopers arrested Samantha J Bailey, 22 of Wellsville, NY for driving while intoxicated and unlawful possession of marijuana.

Troopers responded to a one car rollover crash on County Route 31 in the Town of Scio.  Troopers interviewed Bailey and smelled the odor of an alcoholic beverage.  Bailey was given SFST’s in which she failed.  Bailey was treated for minor injuries at Jones Memorial Hospital and released to the Troopers.  Bailey was then processed at SP Amity where she recorded a .09 BAC.  During the investigation, a small amount of marijuana and a smoking pipe were found in Bailey’s vehicle.  Bailey was issued tickets for driving while intoxicated and an appearance ticket for unlawful possession of marijuana, all returnable to the Town of Scio court October 2016.

(Kirkwood, NY – October 11, 2016) On October 9, 2016, at about 11:55 p.m., New York State Police at Binghamton arrested Kimberly N. Diffendorf, 37, of Kirkwood, NY for the felony of driving while intoxicated.

This arrest occurred after Diffendorf was observed moving from her lane unsafely as she drove on State Route 11 in the Town of Kirkwood.  After stopping in a driveway an investigation determined that she was driving while intoxicated.  This DWI arrest was a felony because Diffendorf has a prior conviction for DWI within the last ten years.

She was issued tickets returnable to the town of Kirkwood court on October 18, 2016.

New York State Police report the following DWI arrests:

On the early morning hours of Sunday, October 9, 2016, New York State Police responded to the report of a motor vehicle accident on Michigan Hollow Road in the Town of Avoca.

The driver of the vehicle, Brenda Pruden, aged 35 of Avoca, was located at her residence and displayed signs of intoxication. Pruden was arrested for DWI and was found to have a BAC level of .18%, over twice the legal limit of .08%.  Pruden is to return to the Town of Avoca court on October 18th.

 

On 10/9 at approximately 2:30 a.m., the New York State Police in Rochester arrested Ayana Brown, 22, of Rochester, following a traffic stop for a signal violation while traveling on I-490 in the city of Rochester.  During the traffic stop, Troopers observed several signs of intoxication and Ms. Brown failed roadside field sobriety tests.  While attempting to take Brown into custody, she physically resisted arrest.  Once secured, it was learned that Ms. Brown initially provided a false name to the Troopers during the traffic stop.  A DMV inquiry of her license revealed it to have 14 active suspensions.

Brown was transported to the Monroe County Jail and charged with misdemeanor Driving While Intoxicated, Criminal Impersonation 2nd, Aggravated Unlicensed Operation 1st degree and Resisting Arrest.

Shank, 29, of Buffalo, NY, was found to be intoxicated.  She was transported and processed at SP Buffalo, where her blood-alcohol content was determined to be 0.18%.  She was subsequently charged with:

Buffalo, NY – On September 28, 2016, at approximately 3:47 a.m., State Police stopped a vehicle on I-190 for multiple traffic violations.  The driver of the vehicle, Reina M. McClain, 25, of Lackawanna, NY, was found to be intoxicated.  She was transported and processed at SP Buffalo, where her blood-alcohol content was determined to be 0.23%. She was subsequently charged with:

  • Aggravated Driving While Intoxicated; a Misdemeanor
  • Aggravated Unlicensed Operation in the 3rd Degree; a Misdemeanor

Cornwall, NY – On September 27, 2016, at approximately 5:26 a.m., State Police stopped a vehicle on I-87 for a speeding violation. The driver of the vehicle, Alejandro Martinez, 29, of Newburgh, NY, was found to be intoxicated.  Additionally, Martinez has a revoked license from a prior DWI conviction and is required to operate a vehicle with an ignition interlock device.  He was transported and processed at SP Newburgh, where his blood alcohol content was determined to be 0.08%.  He was subsequently charged with:

  • Driving While Intoxicated; a Class E Felony
  • Aggravated Unlicensed Operation in the 1st Degree; a Class E Felony
  • Operating a Motor Vehicle with No Ignition Interlock Device; a Class A Misdemeanor
  • Multiple Vehicle and Traffic Violations
Martinez was arraigned before the Town of Cornwall Court and released on his own recognizance to reappear on October 20, 2016.

Connecticut State Police report that on October 25, 2015, at approximately 10:00 p.m. troopers from Troop A – Southbury responded to a two-car motor vehicle crash on I-84 westbound near the South Street Bridge overpass in Middlebury.
Upon arrival, troopers found two vehicles, a Ford Escape and a Porsche Cayman, stopped in the left lane on I-84 in Middlebury. The operator of the Porsche Cayman was fatally injured, the passenger was also injured and transported to Waterbury Hospital for evaluation. The operator of the Ford Escape, Erica Weinman, was transported to St. Mary’s Hospital for the evaluation of injuries.
Troopers initiated an investigation and determined that Weinman was traveling eastbound on I-84 in the left lane when her Ford Escape exited the roadway, crossed over the center median, and struck the Porsche Cayman which was traveling westbound on I-84 in Middlebury. After being struck, the Porsche Cayman rolled over and came to rest on its roof.
Troopers from the Connecticut State Police Collision Analysis and Reconstruction Squad (CARS) responded to the scene and assisted with the investigation.
After a nearly year-long investigation troopers applied for and were granted an arrest warrant for Erica Weinman.
On October 14, 2016, law enforcement officers in New Jersey took Weinman into custody as a Fugitive from Justice based on the strength of the Connecticut arrest warrant. Weinman was transported from Monmouth County Jail in Freehold, NJ to Troop A – Southbury where she was fingerprinted, photographed and released after posting bond pending her court date.

SAN DIEGO — A Coronado-based Navy petty officer was under arrest Monday for allegedly being drunk when his truck vaulted off an elevated freeway connector to the Coronado Bridge and landed on a group of people in Chicano Park, killing four of them.

Richard Anthony Sepolio, 24, remains hospitalized with serious injuries he suffered in the weekend crash. He is expected to face charges of felony DUI and vehicular manslaughter upon his release from medical care.

The Texas native lost control of his GMC pickup about 3:45 p.m. Saturday while trying to merge from northbound Interstate 5 onto the bridge over San Diego Bay, according to the California Highway Patrol.

Third DUI conviction fails to net jail time for Charles Wathen in plea deal with St. Mary’s States Attorney Richard Fritz

LEONARDTOWN, MD. Three strikes for a DUI driver and he’s not out.  That is the justice system operated by St. Mary’s County States Attorney Richard Fritz when it comes to Charles Bernard Wathen, of Mechanicsville, Md.

Wathen was charged by St. Mary’s Sheriff’s Deputy Emory Johnson on April 12, 2015 at 6:24 am with DUI as he operated a 1998 Chevy at Cusic Court and Dallas Drive.  In a guilty plea deal with Fritz, Wathen was given no jail time and a fine of $484.50 with $252.50 of the fine suspended.  This deal for Wathen was on the occasion of his third DUI within ten years. Putting together this plea deal with Fritz was DUI attorney Joseph F. Vallario III, of Suitland, Md.

Wathen rang up his second DUI conviction when he was arrested by a Sheriff’s Deputy on Dec. 26, 2009 at 8:54 pm while operating a 2000 Chevy northbound on Rt. 5 south of Foley Mattingly Road and the charge of driving while under the influence of alcohol contributed to a collision.  Represented by Leonardtown Attorney Shane Mattingly, Wathen entered a plea of guilty in a deal with Fritz that ended with a fine of $300 and a year in jail with six months suspended.

Arrested on May 14, 2006, by a Maryland State Trooper while operating a vehicle southbound on Maryland Rt. 5 just north of the St. Mary’s County line, Wathen was charged with DUI. In a plea deal in Charles County District Court and represented by Leonardtown attorney Michael Davis, Wathen was given Probation Before Judgement, fined $92.50 and given a jail sentence of ninety days with all but two days suspended.

William Scholten Skates on DUI Plea Deals

LEONARDTOWN, MD. – William Hamilton Scholten pays a small price for driving while intoxicated in St. Mary’s County, Md.

When arrested by a St. Mary’s County Sheriff’s Deputy for DUI at 9:17 pm on Nov. 9, 2009, on Rt. 5 at Heritage Lane, Scholten struck a deal with St. Mary’s States Attorney Richard Fritz for a Probation Before Judgement in return for a plea of guilty in St. Mary’s District Court on Feb. 4, 2010. The deal called for a jail sentence of thirty days with all of the jail time suspended and a fine of $192.50.

Not quite a month passed before Scholten was arrested again for DUI by a St. Mary’s Sheriff’s Deputy as he operated a 2002 Ford on Rt. 245 at Hayden Farm Lane on Dec. 12, 2009, at 5:31 pm.  Scholten was represented by Leonardtown attorney Michael Davis in the first arrest.

In the second DUI, Shawn Hrotic, a public defender, who is paid by the taxpayers, struck a deal with Fritz for his client in exchange for a guilty plea. On Feb. 24, 2010, Scholten was sent to jail for fifty-four days and fined $250.  On Jan. 4, 2011, Scholten violated his probation and was jailed once more.

District Court Judge Greg Wells allowed Scholten to leave the slammer and report to Walden for treatment the day after the plea deal was made, leaving Scholten to spend but one day in jail for his third DUI arrest.

On March 9, 2010, Scholten was arrested by a Maryland State Trooper for reckless driving and DUI, his third such arrest in less than six months. In a plea deal on May 4, 2010, arranged by Leonardtown attorney Michael Davis with Fritz, the DUI charge was dropped and Scholten entered a guilty plea to reckless driving. The Deal: One year in jail with six months suspended and a fine of $500.  District Court Judge Greg Wells allowed Scholten to leave the slammer and report to Walden for treatment the day after the plea deal was made, leaving Scholten to spend but one day in jail for his third DUI arrest.

New Mexico: Bernalillo County Sheriff gets the keys to a new mobile DWI; highest rates of DWI killers in the state with more than 10,000 open arrest warrants

ALBUQUERQUE, N.M. (KRQE) – Friday the governor handed the Bernalillo County Sheriff the keys to a brand new mobile DWI unit.

The new van is high-tech and features more ways to get drunk drivers off the streets, including two breath-test stations, its own booking station and a drunk tank that can hold ten DWI suspects.

Ultimately eliminating the need for deputies to travel back and forth to the station each time a suspect is arrested.

“As long as we continue to hopefully try to eradicate DWI, however, we can this is going to be a very useful tool for that,” said Sheriff Manuel Gonzales.

Bernalillo County has the highest rate of alcohol-related traffic deaths in the state.

October 29, 2016 – According to Lexington Police spokesman Brenna Angel, a Lexington woman is charged in connection with a collision that killed two pedestrians early Saturday morning. Suzanne M. Whitlow, 26, is charged with two counts of Manslaughter 2nd and one count of DUI 1st.

Around 2:30 a.m. Saturday, October 29, officers responded to South Upper Street near Bolivar Street for an injury collision. Ms. Whitlow was driving outbound on Upper Street when for unknown reasons she lost control of the vehicle and struck two pedestrians.

The pedestrians were transported to a hospital where they succumbed to their injuries. One of the victims was a Louisville Metro Police Officer.  The second pedestrian killed has been identified as Timothy Moore, 56, of Lexington, according to the Fayette County deputy coroner. 

The causation factors of the collision remain under investigation.

“This is a sad day for LMPD. Early this morning, we were astonished to learn of the tragic death of Detective Jason Schweitzer of our 6th Division. Jason was the FOP Vice-President and was in Lexington this weekend attending a FOP conference. Around 2:30am, he and another pedestrian were struck and killed by a vehicle which had left the roadway.

It is with heavy hearts that we report to you that Louisville Metro Police Detective Jason Schweitzer passed away early this morning October 29. Detective Schweitzer was in Lexington, Kentucky for a FOP conference when he and another pedestrian were struck and killed by a drunk driver early this morning. Detective Schweitzer began his career with the Jefferson County Police Department in November 2001 and has been serving as a Detective in the LMPD 6th Division. Jason has also served as the Vice President of the River City FOP Lodge 614 since 2010.

Louisville Mayor Greg Fischer released a statement Saturday via Twitter:

“Our community mourns the death of Det. Jason Schweitzer, who served, protected our city and its citizens as an officer in the 6th division. We send our deep condolences to his family and his fellow officers of LMPD.”

Kentucky Governor Matt Bevin posted Saturday to his Facebook page:

“It is with great sadness that we learned of the tragic death of LMPD officer, Jason Schweitzer. I had an opportunity to meet with Jason a few months ago. He was part of multi-generational family of law enforcement officers and his presence on the force and in his community will be greatly missed. We are heartbroken for his wife and children, both born and unborn, at the news of this devastating loss. Our thoughts and prayers are with his entire family both now and in the months and years ahead.”

KERSHAW COUNTY SHERIFF REPORTS:
At approximately 2:45am on October 28, 2016 a Kershaw County Sheriff’s Office deputy arrested Justin Matthew Littlejohn (26) who lives on Wildwood Lane in Elgin, SC and charged him with failure to stop for a blue light (2nd offense), assaulting a police officer while resisting arrest and receiving stolen goods after he lead the deputy on a high-speed pursuit and intentionally rammed the deputy’s patrol car.

“The deputy did an outstanding job with this incident, from the pursuit to the arrest,” said Sheriff Jim Matthews. “Littlejohn, who is well known to us, is back in jail again. Hopefully, Littlejohn’s probation for a failure to stop conviction will be revoked as a result of this situation.”

At 2:31am on October 28, 2016, a Kershaw County deputy was dispatched to the area of Vistaview Dr. in Elgin in reference to a suspicious vehicle which was reported to have hit something that had knocked a headlight out. While en route to Vistaview Dr. the deputy spotted a Jeep Grand Cherokee which was missing a headlight, approach him. The deputy turned around on the vehicle and activated his blue lights and siren.

“The deputy did an outstanding job with this incident, from the pursuit to the arrest,” said Sheriff Jim Matthews. “Littlejohn, who is well known to us, is back in jail again. Hopefully, Littlejohn’s probation for a failure to stop conviction will be revoked as a result of this situation.”

The driver of the Jeep, later identified as Littlejohn, increased his speed and fled driving down opposing lanes and running off the road several times. The pursuing deputy followed Littlejohn as he turned down a driveway. When the deputy made the turn, Littlejohn who had turned around in the driveway, rammed the front of the patrol car and continued to flee.

The deputy’s vehicle was still operable and the deputy was able to drive a short distance where he found the Jeep off the road with Littlejohn still inside. Littlejohn was ordered out of the car and placed under arrest.

Following the arrest, the deputy conducted a check on the Jeep and determined that the tag on it was stolen. Investigators are attempting to determine if the vehicle itself is stolen. Additional charges may be pending.

The South Carolina Highway Patrol was called to the scene to handle the collision between Littlejohn and the deputy. Additionally, Littlejohn will be charged by the SCHP for driving under the influence as he was extremely intoxicated.

Littlejohn has previously been arrested for malicious injury to property, grand larceny, DUI, receiving stolen goods, shoplifting, driving under suspension, petty larceny, criminal conspiracy, burglary (2nd degree), possession of marijuana, failure to stop for a blue light (for which he is currently on probation), breach of peace, public disorderly conduct and various traffic offenses.

Littlejohn is currently being detained at the Kershaw County Detention Center where he is awaiting a bond hearing. The Office of Probation, Pardon and Parole has been notified of Littlejohn’s arrest.

On Saturday, October 29, 2016, at 11:52 A.M., the Coachella Police Department responded to a traffic collision on Expressway 86 and Avenue 52 in the City of Coachella.  A 1998 Chevy Silverado was traveling Southbound on Expressway 86 when the driver collided with the side of a semi-truck.  The driver was determined to be Miguel Bautista, 82 of Thermal.  Bautista was suspected to be driving under the influence.  Charges will be filed against Bautista for driving under the influence.

On Friday, October 21, 2016, at 11:19 P.M., officers from the Palm Desert Police Department responded to a single-vehicle traffic collision on Gerald Ford Drive, east of Cook Street, in Palm Desert.  The Police say that their investigation revealed a black, Kia sedan was traveling east on Gerald Ford Drive, east of Cook Street, when the vehicle lost control and collided into a tree.  No injuries were sustained as a result of this traffic collision.  The driver of the Kia sedan was identified as Vanessa Evans, 30 of Palm Springs.  Evans was arrested for suspicion of driving under the influence of alcohol and/or drugs.  Evans was taken to a local area hospital as a precaution before he was booked at the county jail in Indio.
