COACHELLA, CALIF. — 06/04/2016 — According to Riverside Sheriff’s Department John Gaw, on Saturday, June 4, 2016, at 6:26 AM, Coachella Police Department officers responded to a hit and run traffic collision at the intersection of Avenue 48 and Jackson Street in Coachella.

A 2010 gray Honda Accord, driven by Jesus Vidal Serrato, age 31 of Coachella, was driving east on Avenue 48 at a high rate of speed, lost control, and struck a traffic control pole on the south-east corner of the intersection.

Serrato fled the scene on foot but was located and detained by an Indio Police Officer who was in the area.  Serrato complained of difficulty breathing and was transported to a local hospital for evaluation and treatment.

The investigation revealed that alcohol was a factor in this collision.  After a medical clearance, Serrato was arrested for driving under the influence of alcohol and booked at the Indio Jail.

Sam Ellis will face double DUI rap for deaths of Calvin Li and Alex Murk

JUST ONE YEAR LATER THE CIRCUIT COURT JUDGE GIVES SAM ELLIS A FREE PASS FOR KILLING HIS BUDDIES IN HELL-RIDE

UPDATE:
ROCKVILLE, MD. 06/09/2016— With a guilty plea on the table and a pre-sentence investigation completed, a Montgomery County Circuit County Judge didn’t throw the book at Sam Ellis, he let him off with just serving four years in prison and a suspended sentence on top of that of sixteen years.  Ellis will have to “live with what he did in killing his pals.  He will live with it while he is on travel overseas, off to the beach with his friends, when he plays golf or watches football on TV.  And since this is liberal Montgomery County where the prosecutors had all of Ellis’s friends trying to lie for him and to protect him, even under threat of Grand Jury subpoenas; his lenient sentence could be further water-downed if the Judge decides to “reconsider” the sentence and let him out of jail with an ankle monitor.

ROCKVILLE, MD. — Samuel Joseph Ellis has been indicted by a Montgomery County Circuit Court Grand Jury on seven counts of negligent manslaughter, negligent homicide and causing life-threatening injury for killing Alex Murk and Calvin Li,  two of his high-school friends in a DUI crash in North Potomac last June.

Ellis faces Judge John W. Debelius III on Nov. 20, 2015 for a scheduling hearing.  A video bench warrant hearing was held on Nov. 6, 2015 at 1:30 pm before Judge Cynthia Callahan. Ellis, of 14609 Snapdragon Circle in North Potomac, Md.,

Ellis also faces a criminal hearing on Nov. 18, 2015 in Ocean City from charges brought by Ocean City Police Officer R. Flanagan for being involved in a fight on June 2, 2015. A civil citation for possession of alcohol under the legal age on March 15, 2015 was dropped by Montgomery County States Attorney John McCarthy on June 9, 2015.

Kenneth Saltzman, a parent who was at the party on 14600 Boat House Way in North Potomac, and whom hosted the teen party, was charged on Oct. 28, 2015 with furnishing alcohol to a minor. He faces trial in District Court for Montgomery County on Dec. 10, 2015.

Montgomery County States Attorney McCarthy dumped the alcohol charge

ROCKVILLE, MD. — The driver who police say killed two of his passengers while on a high-speed booze cruise after a teenage drinking party was busy racking up a record of alcohol and fighting in two Maryland counties in recent months.

While Samuel Joseph Ellis, of 14609 Snapdragon Circle in North Potomac Maryland rests up in his hospital bed from injuries which were apparently self-inflicted by his reported speeding into the grounds of a home after a teen drinking party; an examination of his court record shows a civil citation for underage possession of alcohol was served on him by Montgomery County Police Officer N. Culler on March 15, 2015.

The incident of underage alcohol was just three months prior to the fatal crash in which police say he killed two of his school chums. Dead are Alexander Murk and Calvin Jaixing Li, both recent graduates of Wooten High School.

On June 9, 2015, the Montgomery County States Attorney John McCarthy dropped the citation, which carried no criminal record but did have a fine payable of $100.  The court record doesn’t show any public service assessed in lieu of the fine.

On June 2, 2015 the party boy Sam Ellis was reveling in Ocean City, Maryland along with thousands of other newly graduated high school students when he was arrested by Ocean City Police Officer R. Flanagan.  The criminal charge which is pending in Worcester County District Court for a hearing on July 9, 2015 is for the criminal charge of “affray”, which means participating in a fight among several persons, often associated with a riot or rumble.

Arrested at the same time as Ellis was one of the teens who died in the crash, Calvin Jaixing Li, of 2326 McCormack Rd. in Rockville, Md. The pair were charged by Ocean City Police in a June 2, 2015 2:27 am incident which took place at 6007 Coastal Highway.

Court records show that Rockville attorney Brian Clark represented Li and has filed an order with the Worcester County District Court on June 29th for abatement of the charge due to Li’s death.

Montgomery County lawyer and former Delegate Robin Ficker made this comment on aWashington Post article about the double fatal teen crash:

“Just this past week in Montgomery County Circuit Court, Vincent Olalo was sentenced to 3 years in jail by Judge Mason because his drunk driving accident contributed to the death of a man who already had very serious health problems. Let’s see if States Attorney McCarthy administers justice even-handedly.”

Coverage from WUSA9 News

NORTH POTOMAC, Md. Sept. 22, 2015 – (WUSA9) — The family of one of two 18-year-old Wootton High School graduates killed in a car crash after a party released a statement Monday expressing shock about the news a parent was present for the party, and a desire to make sure the laws change.

The statement by David and Pamela Murk comes days after a WUSA9 report into the investigation into the crash that killed their son Alex Murk and fellow Wootton graduate Calvin Li on June 25. The two were killed after the car they were traveling in flew into a fence, hit a tree and landed in a yard.

The report on the fatal accident

According to documents obtained by WUSA9, the driver of the car, Sam Ellis, was traveling at least more than 30 miles above the speed limit and has a blood alcohol content of .09 two hours after the crash.

“Needless to say, this has been a lot — almost too much — for us to absorb. The details into what happened that night re-opens fresh wounds and our family is absolutely devastated,” David and Pamela Murk said in the statement.

PREVIOUS STORY:
Sources: Parent was at party that led to fatal N. Potomac crash

The two also expressed disgust at the circumstances at the party, specifically the knowledge that a parent was present at the party. According to sources, Kenneth Saltzman knew about the party his daughter was hosting, and at one point jokingly asked a partygoer if one of the 30-packs of beer they brought was for him.

Salzman is expected to be charged with adult responsibility, but the Murks believe punishment associated with that charge is too little.

“What is even more shocking is the fact that under Maryland law, a first offense for behavior such as Mr. Saltzman’s carries no jail time, but merely a maximum fine of $2500,” the Murks said in the statement. “$2500 for something that results in the death of two young men.”

WEB EXTRA:

The two also call for a change to the laws, specifically the potential punishments that can be held against drivers.

“Slaps on the wrist, or short jail sentences, will NOT deter other teenagers from acting as grossly irresponsibly as Sam Ellis did that night,” the Murks said in the statement.

“It goes without saying, we were extremely disappointed that so many family and friends of Alex and Calvin within our community who had knowledge of what took place that evening, were unwilling to come forward without subpoenas and a Grand Jury proceeding,” the Murks said in the statement.

La Quinta Police charged James Tucker with being DUI-druggie coward who hit and ran from crash

LA QUINTA, CALIF.  – 06/12/2016  –  According to Riverside County Sheriff’s Sgt. Jon Gaw, on Friday, June 10, 2016, La Quinta Police Officers responded to the 52000 Block of Avenida Martinez in La Quinta, regarding a single car hit and run traffic collision, involving a possibly intoxicated driver.  A witness observed a white 2006 Ford F-150 swerving in the roadway.  The vehicle lost control and collided with a stucco wall at the roundabout at Calle Sinaloa and Eisenhower Dr., and then left the scene.  The witness followed the vehicle to Avenida Martinez, where the driver entered a residence.  The driver of the F-150, James Tucker, age 53 of La Quinta, was contacted and detained for the investigation of the Hit and Run.  Tucker sustained minor cuts and abrasions in the collision and was treated at the scene by paramedics.

The investigation revealed that controlled substances were a factor in this collision.  Tucker was determined to be under the influence of a controlled substance and was arrested at the scene.  Charges will be filed with the District Attorney.  The investigation is ongoing and anyone with information about this incident is urged to contact La Quinta Police Department at 760-863-8990, or anonymously through Crime Stoppers at 760-341-STOP (7867).

The La Quinta Police Department urges all drivers not to drink and drive.  To report suspected drunk drivers, please call 911.

Driver’s License Checkpoint Results

Norco, CA – The Riverside County Sheriff’s Department/Jurupa Valley Station/Norco Office conducted a DUI/Driver’s License checkpoint on June 11, 2016, at Hidden Valley Pkwy. and Corona Ave.  between the hours of 8:00 p.m. and 2:00 a.m. Checkpoints are placed in locations that have the greatest opportunity for achieving drunk and drugged driving deterrence and provide the greatest safety for officers and the public.

DUI/Driver’s License checkpoints have been shown to lower DUI deaths and injuries.  A major component of these checkpoints are the deterrent effects it has on those who might drive drunk or drug impaired, bringing about more awareness and encouraging everyone to use sober designated drivers.

According to the National Highway Traffic Safety Administration (NHTSA), checkpoints have provided the most effective documented results of any of the DUI enforcement strategies, while also yielding considerable cost savings of $6 for every $1 spent.  Ninety Percent of California drivers approve of checkpoints.

DUI/Driver’s License checkpoint results:

  • 735 Vehicles traveled through the checkpoint.
  • 673 Vehicles were screened.
  • 3 Drivers were given field sobriety tests.
  • 2 DUI-Alcohol suspects were arrested.
  • 2 Drivers were cited for driving while unlicensed.
  • 6 Drivers were cited for driving while their driver’s license was suspended.
  • 7 Vehicles were towed.

The Riverside County Sheriff’s Department/Jurupa Valley Station/Norco Office will be conducting additional DUI/Driver’s License Checkpoint operations throughout the year, in our ongoing commitment to lowering deaths and injuries upon our streets and highways.

From KOB

06/24/2016 — KOB has obtained shocking video of what appears to be a drunk driver dangerously swerving across narrow county roads near Silver City. When police arrived, they soon realized that driver is a popular elected official.

It might surprise some to learn that the elected official drove away free not long after she was pulled over.

She is Francesca Estevez, the district attorney for Grant, Luna and Hidalgo counties.

After pouring through lapel camera video, it’s hard to say Estevez was treated like anyone else during the stop. According to officers she was acting strange, stumbling, and even practicing a field sobriety test on her own.

It all started with a 911 call and cell phone video taken by a concerned driver. The video catches a Dodge sedan weaving and swerving all over Highway 180 near Silver City.

That driver called police. When they caught up to that driver, everything gets surreal.

“How are ya?” Silver City Police officer Leticia Lopez said as she approaches the car.

“I have a flat! And I kept going over, and over!” Estevez said from inside the car. “I was coming in from Deming and the car kept swinging this way!”

It might surprise some to learn that the elected official drove away free not long after she was pulled over.

She told the Silver City officer she was in Deming, and just moments later changed her story.

“You were in Deming?” Lopez asked.

“No, I was coming from Lordsburg,” Estevez said.

Lopez appears to play along with the flat tire story, getting a jack from Estevez’s cluttered trunk. She had won re-election to the DA’s office just days earlier.

“There you go, Francesca. How are ya? Congratulations,” Lopez said.

“Well, I’m very nervous. Cause I couldn’t control the car,” Estevez responds.

Lopez and a rookie Kyle Spurgeon seem to be delaying the traffic stop. They seem to be using the flat tire to keep Estevez in the parking lot.

Eventually, they called over a corporal as Estevez started to weave a tale, struggled with her phone, and went on a strange rant about her bad relationship with police.

“We don’t want the U.S. Department of Justice to start looking down here,” she said. “It’s gotten to that point. Most of you are good.”

Her speech was slurred as she spoke to the officers.

“How’s Deming doing?” Lopez said.

“Deming’s doing great,” Estevez responded in a sing-song voice.

Estevez fell into the passenger seat of her car twice.

At some point, police reports indicate Silver City cops called in New Mexico State Police to take over the stop. Officer Alyssa Carasco arrived.

“I smell just perfume, but I don’t know if she’s on prescription meds,” Lopez said to Carasco.

But Carasco seems completely disinterested in performing a DWI stop. Lopez seemed okay with it, and Estevez randomly asked if she’s a bad person. ....MORE
