Fulton Police report that on the 15th day of July 2015 at 1:30 a.m. while at 260 S. Second St. in the City of Fulton, County of Oswego, State of New York, the defendant, John W.
Boyett II was arrested for DWI and Refusal to Submit to Breath Test.
On the 15th of July 2015 at 1:21 a.m. while at 260 S. Second St. in the City
of Fulton, the defendant, John W. Boyett II did operate a 2001 Red Jeep
Cherokee Sport in an easterly direction across the Broadway Bridge in an intoxicated
condition. The defendant did have the odor of a consumed alcoholic beverage on his
breath, was unsteady on his feet and did have glassy eyes. The defendant did refuse to
submit to a breath test and all field sobriety testing.

According to Fulton Police on the 18th day of June, 2015, at approximately 5:52P.M., while at 810 W. Broadway, in the City of Fulton, County of Oswego, State of New York, the
defendant, Misty B. Simmons, was arrested for Driving While Ability Impaired
By Drugs, Criminal Possession of a Controlled Substance Seventh Degree,
Criminal Use of Drug Paraphernalia Second Degree, and Unlicensed
Operator.
It is alleged that on the 18th day of June, 2015, at approximately
5:18P.M., the defendant, Misty B. Simmons, while in the 800 block of W.
Broadway, did operate a red 2001 Ford Focus while knowing that she did
not possess a New York State Drivers License and while in an intoxicated
condition. Furthermore the defendant’s records from the New York State
Department of Motor Vehicles show that the defendant was previously convicted
of Driving While Intoxicated on December 4, 2006 in Oswego Town Court.
It is further alleged the defendant, Misty B. Simmons, did knowingly
possess 13 glassine envelopes containing an off white powdery substance
that did field test positive for the presence of heroin, a controlled substance,
and were individually packaged and suitable for sales. Said envelopes were
located in the left side of the defendants bra.
